On October 03, 2010, citizen Kashkenbayeva Shokhsanam Babanazarovna (hereinafter the Applicant) entered into a registered marriage with citizen Ualikhanuly Asylkhan (hereinafter the Defendant)and they have imperfect children from a joint marriage: Ualikhan Esimkhan Asylkhanuli06.09.2011 year of birth, Ualikhan Nurlykhan Asylkhanuli 20.12.2012 year of birth, Ualikhan Rasulkhan Asylkhanuli 13.08.2014 year of birth. Since mid-2017, the Applicant and the Defendant have been living separately as the Defendant repeatedly beat the Applicant. gr. Ualikhanuly Asylkhan is the father of the child, which is confirmed by a copy of the birth certificate of the above–mentioned minor children. Currently, all minor children live permanently with their mother. Despite this, the debtor does not voluntarily provide financial assistance for the maintenance of minor children, and avoids fulfilling the duties of a parent. The defendant filed an application to the Karasai District Court for divorce, which is being considered in court. Based on the above, guided by Articles 138-140 of the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family", art. 140,145-147 CPC of the Republic of Kazakhstan,
I ASK THE COURT:
Obtain a court order to collect alimony from U.A... IIN ......., for the maintenance of underage children until adulthood in the amount of 1/2 of all types of earnings of the defendant in favor of the Applicant –K.Sh. B... IIN ...;
All expenses related to the recovery of alimony in accordance with the norms of the Civil Procedure Code of the Republic of Kazakhstan are assigned to the Defendant.
