Application for dispute resolution for communication with a child by a parent living separately from the child
I, A.A.A., am the father of the child A.A.A..
According to Article 60 of the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family" (hereinafter - the Code) Every child has the right to live and be raised in a family, the right to know his parents, the right to be cared for by them, and the right to live with them, except in cases where this is contrary to his interests.
A child has the right to be raised by his parents, to ensure his interests, comprehensive development, and respect for his human dignity.
According to article 61 of the Code, a child has the right to communicate with both parents, grandparents, brothers, sisters and other relatives. The dissolution of the marriage (matrimony) of the parents, its recognition as invalid, or the separation of the parents should not affect the rights of the child.
If the parents live separately, the child has the right to communicate with each of them. A child has the right to communicate with his parents also if they live in different countries.
According to article 73 of the Code, a parent living separately from a child has the right to communicate with the child, participate in his upbringing and resolve issues related to the child's education and other important issues for the child.
The parent with whom the child lives should not interfere with the communication of the child with the other parent, if such communication does not harm the physical and mental health of the child, his moral development.
I ask you to consider the dispute on communication with the child, since the child's mother categorically prevents me from communicating with the child from May 9, 2026, without explaining the reasons, and determine the following procedure for communication with the child:
a) every Friday from 21:00 to 21:00 on Sunday
b) on public holidays, by agreement between the parents, from 09:00 a.m. to 09:00 a.m. the next day
c) on my birthday on April 14th from 09:00 a.m. to 09:00 a.m. on April 15th every year
d) on the birthday of my mother (the child's grandmother) on July 5 from 09:00 to 09:00 on July 6 every year
e) May 7 (Defender of the Fatherland Day) from 09:00 a.m. to 09:00 a.m. on May 8 every year
f) autumn, winter, and spring school holidays – the second half of the holidays, and summer holidays from July 15 to August 31 each year.
