The petition
on parole from serving a sentence
I, A.K.S., am serving my sentence in the Russian State Institution "Institution No. 10" of the Ministry of Internal Affairs of the Republic of Kazakhstan by the verdict of the Shuisky District Court of the Zhambyl region dated 12/24/2020 under art. 189, part 4, paragraph 2) of the Criminal Code of the Republic of Kazakhstan (hereinafter – the Criminal Code of the Republic of Kazakhstan). In accordance with Part 4 of Article 11 of the Criminal Code of the Republic of Kazakhstan, the crime I committed belongs to the category of serious crimes.
According to Part 1 of Article 72 of the Criminal Code of the Republic of Kazakhstan, a person serving a restriction of liberty or imprisonment, after actually serving the terms specified in parts three, four and five of this article, may be released by a court on parole if the court finds that he does not need to fully serve his sentence for his correction..
I was born on December 13, 1963, and currently I am 60 years old.
According to paragraph 2 of Part 4 of Article 72 of the Criminal Code of the Republic of Kazakhstan, conditional early release from serving a sentence can be applied to women aged fifty-eight and over after actually serving at least one third of the sentence imposed by a court for a serious crime.
The formal deadline for my application for parole from serving my sentence was 03/06/2024.
I believe that the court can now recognize that I do not need to serve my sentence in full for my correction.
In support of my petition, I present the following arguments:
On the part of the administration of the RSU "Institution No. 10" of the Ministry of Internal Affairs of the Republic of Kazakhstan, I am characterized only on the positive side. I have been serving my sentence in light conditions of detention since 18.10.2021. The third positive degree of behavior was determined on 22.05.2023. I carry out the tasks of the institution's administration efficiently and on time. I treat the work on the improvement of the institution's territory and the improvement of the cultural and living conditions of the detachment in good faith. I do community service. I actively participate in the organization and holding of cultural events of the institution. I treat my duties in good faith, and I treat the established procedure and conditions of serving my sentence positively. I do not violate the regime of detention. She is polite in dealing with the staff of the institution and other convicts. I constantly keep in touch with my relatives through telephone conversations, short-term and long-term visits.
During the time of serving my sentence, I have received 4 commendations in the form of gratitude – 07/13/2021, 01/28/2022, 30.09.2022, 09/11/2023. I have no penalties for the entire time of my detention or serving my sentence.
According to the data of the Electronic Register of Dispensary Patients medical information system, I am registered at the dispensary with a diagnosis of Bronchial asthma and Arterial hypertension. Due to my age and health condition, I cannot fully engage in physical labor.
Currently, out of the total amount of damage caused by the crime, I have reimbursed: 25,711,869 tenge, of which 1,000,000 tenge was mistakenly paid on behalf of my daughter D.A.M. to compensate for the damage for me.
Out of the total amount of compensation for the damage caused, it was paid:
- compensation for damages – 25,063,125 tenge;
- the state duty is 597,860 tenge.
- procedural costs – 2784 tenge.
- to the Victims' Compensation Fund – 48,100 tenge.
If my application for parole from serving my sentence is granted, I will reside at the following address: Almaty region, Karasai district, Raiymbek rural district, Kyrgyzyldy village, Akshi Street, 36, together with my spouse.
Also, if my application for parole from serving my sentence is granted, I will be employed by Diyar-7 LLP in order to continue to compensate for the damage caused by the crime.
My husband, children, and grandchildren are looking forward to my release.
I ask you, dear court, not to deny my petition.

- to release me on parole from serving my sentence of imprisonment imposed by the verdict of the Shuisky District Court of Zhambyl region dated December 24, 2020.
