In the proceedings of the investigator of the Department of Internal Affairs of the Medeu district of Almaty, A.A. Shalgimbayev, a criminal case is being investigated, registered in the ERDR for No. 217517031002351 against N.M.M., E.Zh. upon the commission of a criminal offense under art. 189 Part 1 of the Criminal Code of the Republic of Kazakhstan.
E.Zh. is a pensioner, currently 69 years old, on 03/01/2023, E.Zh. lost a close relative of her husband, Ch.M.M., born on 03/12/1949. Now E.Zh. is experiencing great grief and complains about her health condition.
According to Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, participants in criminal proceedings have the right to apply to the person conducting the pre-trial investigation, the prosecutor, the judge (to the court) with petitions for procedural actions or procedural decisions to establish the circumstances relevant during the criminal process, to ensure the rights and legitimate interests of the person who filed the petition, or represented by them faces.
Based on the above, using my rights provided for in Articles 65-1 of the Criminal Procedure Code of the Republic of Kazakhstan, I refuse to conduct an investigative action of confrontation between me and R.A.
