about reimbursement of expenses for the representative's assistance

 

You have a Civil case No. 7519-22-00-2/519 dated 05/31/2022 on the claim of the plaintiff of the Limited Liability Partnership "Hyundai Transauto" (hereinafter referred to as the plaintiff) against A.B.R. (hereinafter referred to as the defendant) for recognition of a Nissan Almera car, VIN KNMCHLMSAP790236 located at: Almaty, ul. B...., 70 ownerless and transfer it to the ownership of the state.

A contract for the provision of legal assistance No. 1507/22 dated July 15, 2022 (hereinafter referred to as the Contract) was concluded between AK Law and Law and A.B.R., in accordance with which AK Law and Law  provides services to the defendant in representing the interests of the appellate instance in the Plaintiff's claim against the Defendant. The cost of services under the Contract was 200,000 (two hundred thousand) tenge. A.B.R. was paid 200,000 tenge, as evidenced by the receipt.

In accordance with paragraph 1 of Article 113 of the Civil Procedure Code of the Republic of Kazakhstan, at the request of the party in whose favor the decision was made, the court awards, on the other hand, the costs incurred by her to pay for the assistance of a representative (several representatives) who participated in the process and is not in an employment relationship with this party, in the amount of the costs actually incurred by the party.

Based on the above, and guided by art. 113 of the CPC RK,

 

I ask the Court:

 

To collect from the plaintiff of the Limited Liability Partnership "Hyundai Transauto" in favor of the defendant A.B.R., representative expenses in the amount of 200,000 tenge.
