Statement

on sending a writ of execution to the regional Chamber of Private Bailiffs on territoriality

 

In your proceedings, there was a civil case No. 2711-24-00-2/6663 on the claim of Ma O. Kudaibergenovich (hereinafter referred to as the Plaintiff) against the Consumer Cooperative of Citizens "R.O.I" (hereinafter referred to as the Defendant) for the dissolution of marriage. A decision has been made in this civil case, which has entered into legal force.      

According to art.241 of the Civil Procedure Code of the Republic of Kazakhstan, a decision in accordance with the procedure established by this Code is enforceable after its entry into force, except in cases of immediate execution. After the court decision comes into force, a writ of execution is issued.

Paragraph 5 states that the enforcement document is issued to the recoverer or, upon his request, is sent by the court for execution to the appropriate judicial authority or to the regional chamber of private bailiffs for territorial jurisdiction.

Based on the above and guided by 47, 241 CPC RK,

 

I ask the Court:

 

o Send a writ of execution in civil case No. 2711-24-00-2/6663 to the Regional Chamber of Private Bailiffs.
