The petition

By a ruling of the Zhitikarinsky District Court dated January 23, 2019, a settlement agreement was approved between plaintiff N.Z.Kh. and defendant B.D.T. in civil case No. 2-2241/2018 on the payment of an unfulfilled obligation in the amount of 210,990 tenge in equal installments of 70,330 tenge. On February 28, 2019, the deadline for payment of the first payment arrived, but the defendant did not fulfill the terms of the settlement agreement. In accordance with art. 178 h. 2 The Civil Procedure Code of the Republic of Kazakhstan, a settlement agreement that is not executed voluntarily, is subject to compulsory execution on the basis of a writ of execution issued by the court at the request of the person who concluded the settlement agreement.

Application for the issuance of a writ of execution in connection with non-fulfillment of the terms of the Mediation Agreement

Based on the above, I ask the court to issue a writ of execution in the above-mentioned civil case and send it for enforcement to the Regional Chamber of Private Bailiffs of Kostanay region.
