The reason for my appeal to you is a blatant injustice, namely an administrative offense in transport. On May 26, 2021, at night around 00:30, my parents and I passed a pedestrian crossing (the scene of the incident is attached to the application). Crossing the pedestrian crossing, we saw that a black Toyota Camry passenger car with GRNZ 686 AE 02 (hereinafter referred to as the driver) was driving towards us from Bayzakov Street at high speed, heading south. According to paragraph 1, paragraph 14 Resolution of the Government of the Republic of Kazakhstan "On approval of the Rules of the road, the Basic provisions for the admission of vehicles to operation, the list of operational and special services, the transport of which is to be equipped with special light and sound signals and painted according to special color schemes" (Hereinafter – SDA), which stipulates that the driver of the vehicle gives way to pedestrians, crossing the carriageway of the road, its direction of movement at an unregulated pedestrian crossing.
An application to the Administrative Police Department In accordance with paragraphs 1, 13 of the traffic Regulations, where, when turning right or left, the driver gives way to pedestrians crossing the carriageway in his direction of travel, which he turns into, cyclists crossing it on a bike path, fixed-route vehicles and other public transport moving in the lane marked 5.9 (subject to paragraph 2 of Section 18 of the Rules). However, the driver, driving at high speed, not inferior to me and my parents at a pedestrian crossing, created an accident situation, moreover, he almost hit us! We avoided a collision only because we ran across a pedestrian road. Thus, the driver violated Article 600 of the Code of Administrative Offences of the Republic of Kazakhstan, which stipulates that failure to comply with the requirements of the traffic rules to give way to pedestrians or other road users, with the exception of drivers of vehicles taking advantage of traffic, entails a fine in the amount of ten monthly calculation indices. Also, by exceeding the speed limit, the driver violated Article 592 of the Code of Administrative Offences of the Republic of Kazakhstan, where exceeding the set speed of a vehicle by an amount of forty or more kilometers per hour entails a fine in the amount of twenty monthly calculation indices. Moreover, the driver dared to stop along the road to further threaten me, which contradicts Article 614 of the Administrative Code, where intentionally creating obstacles to the movement of vehicles entails a fine of three for individuals and ten monthly calculation indices for officials.
Application to the Administrative Police Department
According to Article 611 of the Administrative Code, where failure by a driver to fulfill the duties stipulated by the legislation of the Republic of Kazakhstan in the field of traffic in connection with a traffic accident in which he is a participant, with the exception of cases provided for in part two of this Article, entails a fine in the amount of five monthly calculation indices. Based on the above and guided by Articles 600, 614, 611 of the Administrative Code of the Republic of Kazakhstan,
I ask you to:
To bring to administrative responsibility the driver of Toyota Camry 55, with GRNZ 686 AEF 02;
To respond to the application within the prescribed time limits.
