statement  ABOUT RECONCILIATION

In connection with the court's explanation to the parties of the possibility of reconciliation, "___" ________201__ of the year we, ____________________ and ___________________ we have reconciled, (the name of the person accused by you in private) (Your full name) as evidenced by mutual written obligations and a settlement agreement (copies in the appendix). According to paragraph 8, Part 6, Article 71 of the Criminal Procedure Code of the Republic of Kazakhstan, the victim has the right to reconcile with the accused in cases provided for by law, including through mediation. In accordance with paragraph 5 of Part 1 of art. 35 of the Criminal Procedure Code of the Republic of Kazakhstan, a criminal case is subject to termination if the private prosecutor refuses to charge – in cases of criminal offenses provided for in Part 2 of Article 32 of the Criminal Procedure Code of the Republic of Kazakhstan. As follows from Article 32 of the Criminal Procedure Code of the Republic of Kazakhstan, criminal offenses under Articles 130, 131 and 147 of the Criminal Code of the Republic of Kazakhstan include offenses under Articles 130, 131 and 147 of the Criminal Code of the Republic of Kazakhstan.

Application to the court for reconciliation of the parties

According to Part 6 of Article 409 of the CPC of the Republic of Kazakhstan, if the parties receive an application for reconciliation or an agreement to achieve reconciliation through mediation, the proceedings in the case are terminated by a judge's decision on the basis of paragraph 5 of Part 1 of Article 35 of the CPC of the Republic of Kazakhstan. With this reconciliation statement, we also reject complaints filed as private accusations against each other. Based on the above, in accordance with paragraph 2, Part 1 of art. 412 of the Criminal Procedure Code of the Republic of Kazakhstan, we ask you to accept this reconciliation statement with the appendices, accept our mutual and voluntary renunciation of the charges brought against each other in private and issue a resolution to terminate the criminal proceedings.
