You have a civil case pending on the plaintiff's appeal of the KSU "Employment Center" of the State Institution "Department of Employment and Social Programs of the Akimat of the Zhitikarinsky district" against the court's decision on the claim against me to recover the amount of tuition fees. In accordance with Part 1 of Article 109 of the Civil Procedure Code of the Republic of Kazakhstan, the court awards to the party in whose favor the decision was made, on the other hand, all court costs incurred in the case. 102 of the Civil Procedure Code of the Republic of Kazakhstan – court costs consist of state fees and costs related to the proceedings. According to clause 9 of art. 108 CPC RK the costs associated with the proceedings include: other expenses recognized by the court as reimbursable, including those incurred by the parties in the procedures of mandatory pre-trial dispute settlement upon subsequent appeal to the court.
Application to the court for recovery of representative expenses
To provide qualified legal assistance, I contacted a lawyer, and I incurred expenses in the amount of 20,000 tenge for my services, which is confirmed by the legal assistance agreement and receipt dated 09/06/2021. I ask you to recognize these expenses as court expenses and to recover them from the plaintiff when making a decision on the appeal. Based on the above, I ask you to collect in my favor from the KSU "Employment Center" of the State Institution "Department of Employment and Social Programs of the Akimat of the Zhitikarinsky district" the costs of legal aid for a lawyer in the amount of 20,000 (twenty thousand) tenge. Appendix: a copy of the legal assistance agreement, a copy of the receipt.
