Article 1. Basic concepts used in this Law Chapter 1. GENERAL PROVISIONS of the Law on Safety of Machinery and Equipment

      1. The following basic concepts are used in this Law:  

      1) date of manufacture - the end date of the production process of machinery and equipment;  

      2) equipment - a technical device installed on a machine and necessary to perform the basic and (or) additional functions of machines, as well as to combine them into a single complex;  

      3) unacceptable risk is a risk exceeding the level of safety of machinery and equipment for human life and health, and the environment, established by the legislation of the Republic of Kazakhstan.;  

     4) acceptable risk level - the level of safety of machinery and equipment established by technical regulations and project documentation;

     5) danger zone - an area inside or around a car in which a person is at risk of harm to life or health.;

     6) dangerous machinery and equipment - machinery and equipment that pose a danger to human life and health, the environment and are recognized as not meeting the safety requirements established by this Law and technical regulations.;

     7) machine - a technical device or a set of devices designed to convert energy, materials and information, consisting of interconnected components, at least one of which can move;

     8) the designer of a machine and (or) equipment (hereinafter referred to as the designer) is an individual or legal entity that develops design documentation and instructions for the operation of machines and (or) equipment.;

      9) life cycle of machinery and equipment - processes of design, production, operation (including repair, maintenance and service), storage, transportation, sale, destruction and disposal;  

      10) safety of machinery and equipment - absence of unacceptable risk associated with harm to human life, health and the environment;  

      11) entities responsible for the safety of machinery and equipment - the designer, manufacturer, authorized representative, importer, personnel (operators), user of machinery and equipment;  

     12) confirmation of conformity of machinery and equipment – a procedure resulting in documentary evidence of compliance (in the form of a declaration of conformity or certificate of conformity) of machinery and (or) equipment with the requirements established by technical regulations, standardization documents or terms of contracts;

      13) declaration of conformity of machinery and equipment - a document by which the manufacturer certifies the conformity of machinery and (or) equipment put into circulation with the established requirements;  

      14) manufacturer - a natural or legal person who manufactures machinery and (or) equipment;  

      15) user - an individual or a legal entity operating a machine and (or) equipment;  

      16) personnel (operators) - persons involved in the start-up, operation, adjustment, routine maintenance, cleaning, repair, storage or transportation of machinery and equipment;  

      17) conformity mark - a designation used to inform buyers about the passage of machines and (or) equipment conformity assessment procedures;  

      18) authorized body - a state body that, in accordance with the industry orientation, within the limits of its powers, directs and coordinates the activities of other state bodies that ensure the safety of machinery and equipment.;  

      19) authorized representative - an individual or legal entity who has written authority from the manufacturer authorizing the conduct (implementation) of trade on his behalf;  

      20) terminal condition - the condition of machines and equipment in which their further operation or restoration of their working condition is impossible or impractical.;  

      21) failure is an event that results in a malfunction of machinery and equipment.  

      2. The concepts of the legislation of the Republic of Kazakhstan in the field of safety of machinery and equipment not specified in this article are used in the meanings defined in the relevant articles of this Law.  

 

 

The Law of the Republic of Kazakhstan dated July 21, 2007 No. 305.

     This Law regulates public relations in determining, establishing, applying and fulfilling requirements for machines and equipment, their life cycle processes, and establishes the legal basis for ensuring safety to ensure the protection of human life, health and the environment.
