Article 1. Basic concepts used in this Law Section 1. General provisions of the Law on Transport in the Republic of Kazakhstan

     The following basic concepts are used in this Law:

     1) light rail transport is a type of urban rail transport that carries out regular socially significant transportation of passengers and luggage along separate tracks and is characterized by dimensions, carrying capacity and speed of communication that are smaller than those of the metro and railway.;

     1-1) socially significant passenger transportation – passenger transportation organized in order to ensure an affordable level of tariffs and the possibility of free movement of the population on the territory of the Republic of Kazakhstan;

     1-2) multimodal transportation is transportation by two or more modes of transport according to a single consignment note (single bill of lading);

     1-3) multimodal transport cooperation agreement – an agreement concluded between a multimodal transport operator and carriers of various modes of transport;

     1-4) multimodal transport operator – a natural or legal person who organizes multimodal transport;

     1-5) multimodal transport agreement – an agreement concluded between a multimodal transport operator and a customer (shipper, consignee, passenger, charterer) for multimodal transport;

     1-6) is excluded by the Law of the Republic of Kazakhstan dated 13.06.2017 No. 69-VI (effective after ten calendar days after the date of its first official publication);  

     1-7) military passengers – military personnel and members of their families, as well as persons designated by the list of the first head of the relevant state body;  

     1-8) military cargo – all types of weapons, military equipment, ammunition and other material and technical property transported in accordance with the procedure determined by the authorized state body;  

     1-9) military tariff – the tariff applied for intra-republican transportation of military goods, approved in accordance with the legislation of the Republic of Kazakhstan;  

     1-10) military transportation – transportation of troops, military cargo and military passengers carried out by carriers, regardless of the form of ownership, in accordance with the procedure determined by the authorized state body;  

     1-11) a single consignment note (single bill of lading) is a document certifying the acceptance of cargo by a multimodal transport operator for the delivery of cargo to its destination;

     2) customer (shipper, consignee, passenger, charterer) – an individual or a legal entity using transport in accordance with the concluded contract with the carrier, and in case of multimodal transportation in accordance with the concluded multimodal transportation contract;

     3) transport infrastructure facilities – a technological complex that includes railway, tram, light rail, monorail and inland waterways, highways, tunnels, overpasses, bridges, train stations and stations, passenger service points, subway lines, ports, port facilities, navigable hydraulic structures (locks), airfields, airports, transport and logistics centers, facilities communication, navigation and traffic control systems, main pipeline, as well as other buildings, structures, devices and equipment that ensure the functioning of the transport complex;

     4) transport enterprise – a legal entity engaged in the transportation of goods, passengers, baggage, storage, maintenance and repair of vehicles, operating in accordance with the legislation of the Republic of Kazakhstan;

     5) transport logistics is a set of interrelated actions of participants in the transportation process to plan and manage the transportation of goods from the shipper (manufacturer) to the recipient along the optimal route using various modes of transport (railway, automobile, sea, inland waterway, air), including monitoring the movement of goods at each stage of transportation;

     5-1) a transport and logistics center is an object of transport infrastructure, including a specially designated area with facilities located on it, designed to perform preparatory, distribution and final technological operations related to transportation with goods and vehicles, including inspection, including customs and border operations in accordance with the legislation of the Republic of Kazakhstan.;

   5-2) the object of tracking is goods (products) and vehicles determined in accordance with international treaties ratified by the Republic of Kazakhstan, concluded within the framework of the Eurasian Economic Union, and the legislation of the Republic of Kazakhstan.;

     6) transport of the Republic of Kazakhstan – railway, automobile, marine, inland waterway, air, urban rail transport registered in the territory of the Republic of Kazakhstan, as well as mainline pipeline transport located in the territory of the Republic of Kazakhstan;

     7) urban rail transport – a type of transport (subway, tram, light rail, monorail) designed to transport passengers along the tracks within the city and suburban area;

     8) subway – a type of urban rail transport that carries out regular socially significant transportation of passengers and luggage along tracks isolated (separated, without single-level intersections) from lines of other modes of transport and pedestrian passage to them;

 8-1) navigation seal – a technical device consisting of a sealing element and an electronic unit, operating on the basis of navigation satellite system technologies and providing the transmission of information related to the tracking object, meeting the requirements established by the law of the Eurasian Economic Union;

     8-2) tracking shipments using navigation seals is a process that includes activating the navigation seal, monitoring the tracking object, deactivating the navigation seal, and transmitting data obtained during monitoring of the tracking object.;

     8-3) transportation tracking information system is an information system that includes a hardware and software complex based on technologies of navigation satellite systems and navigation seals;

     8-4) the national operator of the transportation tracking information system is a legal entity that provides transportation tracking using navigation seals;

     9) carrier – a natural or legal person who owns a vehicle by right of ownership or on other legal grounds, provides services for the transportation of passengers, baggage, cargo and mail for a fee or for hire and has a corresponding permit issued in accordance with the established procedure.;

     10) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective ten calendar days after the date of its first official publication);  

     11) authorized state body – the central executive body responsible for the implementation of state policy in the field of transport, coordination and regulation of the activities of the transport complex of the Republic of Kazakhstan.

 Other concepts used in this Law for the purpose of tracking shipments using navigation seals are applied in the meaning in which they are used in international treaties ratified by the Republic of Kazakhstan, concluded within the framework of the Eurasian Economic Union, the legislation of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated September 21, 1994 No. 156.

     This Law defines the foundations of the legal, economic and organizational activities of transport in the Republic of Kazakhstan.
