Article 1. Basic concepts used in this Law Section 1. General provisions of the Law on Transport in the Republic of Kazakhstan
The following basic concepts are used in this law:
1) light rail transport – a type of urban rail transport that carries out socially significant regular transportation of passengers and baggage along separate designated roads and is characterized by a smaller size, carrying capacity and speed of communication than the metro and railway;
1-1) socially significant passenger transportation – passenger transportation organized in order to ensure an affordable level of tariffs and the possibility of free movement of the population through the territory of the Republic of Kazakhstan;
1-2) mixed transport-transportation by two or more modes of transport with a single bill of lading (single bill of lading) ;
1-3) contract of interaction in mixed transport – a contract concluded between the operator of mixed transport and carriers of various types of transport;
1-4) operator of mixed transportation – an individual or legal entity engaged in the organization of mixed transportation;
1-5) mixed Transport Agreement – a contract concluded between the operator of mixed transport and the client (shipper, consignee, passenger, charterer by ship) for the implementation of mixed transport;
1-6) excluded by the law of the Republic of Kazakhstan dated 13.06.2017 No. 69-VI (entered into force on the expiration of ten calendar days after the date of its first official publication);
1-7) military passengers – military personnel and members of their families, as well as persons identified by the list of the first head of the relevant state body;
1-8) military cargo – all types of weapons, military equipment, ammunition and other material and technical property transported in accordance with the procedure determined by the authorized state body;
1-9) military tariff - the tariff applied to intra-republican transportation of military goods, approved in accordance with the legislation of the Republic of Kazakhstan;
1-10) military transportation-transportation of troops, military cargo and military passengers, performed by carriers regardless of their forms of ownership in accordance with the procedure determined by the authorized state body;
1-11) unified bill of lading (unified bill of lading – - a document certifying the acceptance of the cargo at its disposal by the operator of mixed Transport for the delivery of cargo to the destination point;
2) client (shipper, consignee, passenger, charterer by ship) – an individual or legal entity using transport in accordance with the contract concluded with the carrier, and in the case of mixed transport in accordance with the contract of mixed transport concluded;
3) transport infrastructure facilities include railway, tram, light rail, monorail and inland waterways, highways, tunnels, overpasses, bridges, stations and stations, passenger service points, metro lines, ports, port facilities, navigable hydraulic structures (gateways), aerodromes, airports, transport and logistics centers, objects of communication, navigation and vehicle traffic management systems, main pipelines, as well as a technological complex, including other buildings, structures, devices and equipment that ensure the operation of the transport complex;
4) Transport Enterprise – a legal entity that acts in accordance with the legislation of the Republic of Kazakhstan, is engaged in the transportation of goods, passengers, baggage, storage, maintenance and repair of vehicles;
5) Transport Logistics – a set of interrelated actions of participants in the transportation process to plan and manage transportation (transportation) from the shipper (manufacturer) to the consignee on the optimal route using various modes of transport (rail, road, sea, inland water, air), including monitoring the movement of goods at each stage of transportation (transportation) ;
5-1) transport and logistics center this is an object of transport infrastructure intended for the performance of manufacturing, distribution and final technological operations, including inspection, carried out in parallel with transportation, with cargo and vehicles, including customs and border operations, in accordance with the legislation of the Republic of Kazakhstan, including a specially designated site where structures are placed;
5-2) object of supervision-goods (products) and vehicles concluded within the framework of the Eurasian Economic Union, determined in accordance with international treaties ratified by the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan;
6) transport of the Republic of Kazakhstan-railway, road, sea, inland water, air transport, urban rail transport registered in the territory of the Republic of Kazakhstan, as well as main pipeline transport in the territory of the Republic of Kazakhstan;
7)urban rail transport – a type of transport intended for the transportation of passengers along roads within the city limits and in the suburban area (metro, tram, light rail, monorail transport);
8 – Metro-a type of urban rail transport that carries out regular socially significant transportation of passengers and baggage along roads isolated from networks of other types of transport and pedestrian crossings to them (separated, without intersections of the same level) ;
8-1) navigation seal – a technical device consisting of a sealing element and an electronic unit, operating on the basis of technologies of navigation satellite systems and ensuring the transmission of information related to the object of supervision, meeting the requirements established by the law of the Eurasian Economic Union;
8-2) tracking of transportation using navigation seals – a process that includes the activation of the navigation seal, monitoring of the tracking object, deactivation of the navigation seal and transmission of data obtained in the process of monitoring the tracking object;
8-3) unmanned transport system – a transport system that includes an unmanned vehicle and elements associated with the Unmanned Vehicle necessary for its safe and effective operation (including communication channels and components that control the unmanned vehicle;
8-4) zone of operation of unmanned vehicles-a part of the ground space of the established size on the territory of the Republic of Kazakhstan, within which unmanned vehicles are used (light rail transport overpass);
8-5) unmanned vehicle – a vehicle equipped with automated technical controls, used without the participation of an individual (with the exception of an unmanned aircraft system);
8-6) remote operator of an unmanned vehicle – an individual who has the right to assume control of an unmanned vehicle at any stage of its movement;
8-7) digital transport tracking system – a digital system that includes a hardware and software complex operating on the basis of navigation satellite systems technologies and a navigation seal;
8-8) national operator of the digital transportation tracking system – a legal entity that provides transportation tracking using navigation seals;
9) carrier – an individual or legal entity that owns a vehicle on the right of ownership or on other legal grounds, providing services for the transportation of passengers, baggage, cargo and postal items for a fee or for hire and having an appropriate permit issued in accordance with the established procedure;
10)excluded by the law of the Republic of Kazakhstan dated 27.10.2015 No. 363 - V (entered into force on the expiration of ten calendar days after the date of its first official publication);
11) authorized state body – the central executive body that carries out the implementation of the state policy in the field of Transport, Coordination and regulation of the activities of the transport complex of the Republic of Kazakhstan.
Other concepts used in this law are used in the sense used in international treaties ratified by the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan, concluded within the framework of the Eurasian Economic Union for the purpose of tracking traffic using navigation seals.
