The following basic concepts are used in this Law:

1) excluded by the Law of the Republic of Kazakhstan dated 29.03.2016 No. 479-V (effective twenty-one calendar days after the date of its first official publication);

1-1) excluded by the Law of the Republic of Kazakhstan dated 17.11.2015 No. 407-V (effective ten calendar days after the date of its first official publication);

 2) metering devices with remote data transmission – technical devices designed to account for the consumption of energy resources and water, transmitting data in automatic mode;

2-1) Quasi-public sector entities – state-owned enterprises, limited liability partnerships, joint-stock companies, including the National Welfare Fund, national management holdings, national holdings, national companies of which the state is the founder, participant or shareholder, as well as subsidiaries, dependent and other legal entities affiliated with them in accordance with the legislative acts of the Republic of Kazakhstan, the Fund social health insurance, State Social Insurance Fund, non-profit organization, providing conditions for the activities of bodies, their organizations and participants of the Astana International Financial Center;

3) The State Energy Register is a systematized set of information about the subjects of the State Energy Register;

4) excluded by the Law of the Republic of Kazakhstan dated 17.11.2015 No. 407-V (effective ten calendar days after the date of its first official publication);

5) subjects of the State Energy Register – individual entrepreneurs and legal entities that consume energy resources in an amount equivalent to one thousand five hundred and more tons of conventional fuel per year, as well as government agencies, quasi-public sector entities and natural monopolies;

5-1) targeted energy audit – an energy audit conducted on a voluntary basis, having a targeted nature and limited scope.;

5-2) training center – a business entity that carries out activities in the field of retraining and (or) advanced training of personnel in the field of energy conservation and energy efficiency;

5-3) customers are government agencies, as well as state–owned enterprises, legal entities, fifty or more percent of the voting shares (participation shares in the authorized capital) of which belong to the state, and legal entities affiliated with them, with the exception of national management holdings, national holdings, national management companies and legal entities affiliated with them;

6) thermomodernization is an action to improve the thermal characteristics of buildings, structures and structures, leading to a reduction in thermal energy losses in them.;

7) energy efficiency class of a building, structure, or structure - the level of energy efficiency of a building, structure, or structure that characterizes its energy efficiency at the operational stage;

8) conditional fuel is a unit adopted in technical and economic calculations, regulated in regulations and standards, which serves to compare the thermal value of various types of organic fuels.;

8-1) express energy audit - an energy audit conducted according to a shortened program and in order to confirm the results of the energy analysis carried out within the framework of the management system in the field of energy conservation and energy efficiency improvement and the previous conclusion on energy conservation and energy efficiency improvement;

8-2) energy auditor (hereinafter referred to as energy auditor) is an individual who holds a certificate of conformity in the field of energy conservation and energy efficiency improvement;

9) energy audit (hereinafter referred to as energy audit) – collection, processing and analysis of data on the use of energy resources in order to assess the possibility and potential of energy conservation and prepare an opinion on energy conservation and energy efficiency improvement;

10) energy resources - a set of natural and produced energy carriers, the stored energy of which is currently being used or may be used in the future in economic and other types of activities, as well as types of energy (atomic, electrical, chemical, electromagnetic, thermal and other types of energy);

11) efficient use of energy resources - achieving a technically feasible and economically justified level of use of energy resources;

12) energy efficiency (hereinafter referred to as energy efficiency) is the quantitative ratio of the volume of services provided, works, products (goods) produced or energy resources produced to the initial energy resources spent on it.;

12-1) energy auditing organization – a legal entity that performs energy audits;

12-2) Is excluded by the Law of the Republic of Kazakhstan dated 30.06.2022 No. 130-VII (effective sixty calendar days after the date of its first official publication).

12-3) an energy service company is a legal entity that performs work (services) in the field of energy conservation and energy efficiency improvement, including with the involvement of contractors, at the expense of its own and (or) borrowed funds within the framework of an energy service agreement.;

13) energy efficiency class of an electric energy consuming device - the level of energy efficiency of an electric energy consuming device, characterizing its energy efficiency at the operational stage;

14) energy saving - the implementation of organizational, technical, technological, economic and other measures aimed at reducing the amount of energy resources used;

14-1) unified information system in the field of energy conservation and energy efficiency improvement (hereinafter referred to as the unified information system) is an information system of an authorized body containing information on energy conservation and energy efficiency improvement in the Republic of Kazakhstan;

14-2) energy conservation and energy efficiency improvement management (hereinafter referred to as energy management) is a set of administrative actions aimed at ensuring rational consumption of energy resources and increasing the energy efficiency of an object;

14-3) certificate of conformity in the field of energy conservation and energy efficiency improvement – a document issued by the conformity assessment body certifying the competence of the energy auditor to carry out work in the field of energy conservation and energy efficiency improvement;

15) excluded by the Law of the Republic of Kazakhstan dated 29.03.2016 No. 479-V (effective twenty-one calendar days after the date of its first official publication);

16) excluded by the Law of the Republic of Kazakhstan dated January 14, 2015 No. 279-V (effective ten calendar days after the date of its first official publication);

16-1) excluded by the Law of the Republic of Kazakhstan dated 17.11.2015 No. 407-V (effective ten calendar days after the date of its first official publication);

17) the authorized body in the field of energy conservation and energy efficiency improvement (hereinafter referred to as the authorized body) is the central executive body responsible for energy conservation and energy efficiency improvement;

17-1) national Institute for Development in the field of energy conservation and energy efficiency improvement – a legal entity, fifty percent or more of the voting shares (participation shares in the authorized capital) of which belong to the state;

17-2) energy efficiency map – a unified republican list of projects in the field of energy conservation and energy efficiency improvement, indicating sources of financing, schedules and action plans for their implementation;

18) excluded by the Law of the Republic of Kazakhstan dated January 14, 2015 No. 279-V (effective ten calendar days after the date of its first official publication);

19) energy-saving equipment - equipment that makes it possible to increase the efficiency of using energy resources;

20) energy-saving material is a material that makes it possible to increase the efficiency of using energy resources.

This Law regulates public relations and defines the legal, economic and organizational foundations of the activities of individuals and legal entities in the field of energy conservation and energy efficiency improvement.
