Article 1. The basic concepts used in this Law are the Law on Military Service and the Status of Military Personnel

 The following basic concepts are used in this Law:

     1) adjunct is a military officer and non–commissioned officer who studies at a foreign military educational institution that implements postgraduate education programs.;

     1-1) persons of civilian personnel (employees) – citizens of the Republic of Kazakhstan who are in public service or are in employment relations in the Armed Forces of the Republic of Kazakhstan, other troops and military formations (hereinafter referred to as the Armed Forces, other troops and military formations);

     2) variable composition – a category of military personnel of the Armed Forces, other troops and military formations studying in military and special educational institutions that are not part of the regular strength of the Armed Forces, other troops and military formations;

     3) conscripted military personnel are citizens of the Republic of Kazakhstan who have been called up for military service in the Armed Forces, other troops and military formations for the period provided for by this Law.;

     4) postponement – postponement of the term of conscription of citizens for military service on the grounds provided for by this Law;

     5) pre–conscripts are male citizens of the Republic of Kazakhstan who are undergoing military service training before being accepted for military registration;

     6) conscripts are male citizens of the Republic of Kazakhstan assigned to conscription sites of local military authorities and subject to conscription for military service;

     7) military rank is a badge of military distinction awarded to a serviceman and a person liable for military service;

     8) military ID – a single indefinite personal military registration document of a citizen, determining his affiliation to military service and attitude to military duty;

     9) staff of a military unit (institution) – a document defining the composition, organizational and staff structure, the number of personnel and the number of fixed main weapons and military equipment in accordance with the inventory of weapons and military equipment of the Armed Forces, other troops and military formations;

     10) military accounting – a system of accounting and analysis of quantitative and qualitative data on conscripts, military personnel and mobilization resources;

     11) military training camps are events conducted by military management bodies authorized by state bodies for military training in order to acquire and improve military knowledge by military personnel and citizens, as well as in other cases provided for by the laws of the Republic of Kazakhstan.

     Military training camps are divided into:

     training camps are a type of military training conducted for the purpose of training and retraining of military personnel, conscripts upon admission to military educational institutions and students of military departments.;

     verification fees are a type of military training conducted in order to check the readiness of military units designed to perform tasks in the organizational and staff structure of wartime;

     special fees are a type of military fees conducted in order to implement measures to introduce and ensure a state of emergency, eliminate emergencies and their consequences, and in other cases determined by the President of the Republic of Kazakhstan.;

     12) military intern – a soldier studying in a military internship;

     13) military internship is a form of military personnel training in clinical specialties within the framework of basic higher medical education for admission to clinical practice, carried out by a structural unit of a higher military educational institution;

     14) military department – the department at the organization of higher and (or) postgraduate education of the Republic of Kazakhstan, which provides military training to citizens according to the programs of reserve officers and sergeants of the reserve;

     15) military uniform – uniforms approved by the President of the Republic of Kazakhstan with insignia and distinctions (uniforms) and equipment that identify military personnel as belonging to the Armed Forces, other troops and military formations;

     16) military service is a special type of public service of military personnel of the Armed Forces, other troops and military formations aimed at directly ensuring military security related to the armed protection of sovereignty, territorial integrity and inviolability of the State border of the Republic of Kazakhstan.;

     17) term of military service – the entire period of military service in the status of a serviceman in the Armed Forces, other troops and military formations;

     18) military service contract – an agreement between the authorized body and a citizen of the Republic of Kazakhstan on voluntary military service, establishing the rights, duties and responsibilities of the parties for the period of military service by the citizen;

     19) dismissal from military service is the exclusion of a serviceman from the lists of a military unit (institution) with admission to the reserve or retirement on the grounds provided for by this Law.;

     20) military personnel – citizens of the Republic of Kazakhstan serving in the Armed Forces, other troops and military formations;

     21) military position – a full-time unit of the Armed Forces, other troops and military formations, which is entrusted with official powers, official duties and special duties to perform the functions of military service;

     22) liable for military service – citizens of the Republic of Kazakhstan who are on military registration and remain in reserve until the age limit of military registration;

     23) reserve of military personnel (hereinafter referred to as the reserve) – military personnel of the age established by this Law who are registered in local military administration bodies of districts and cities of regional significance, used for the purpose of resupply, mobilization deployment and replenishment of losses of the Armed Forces, other troops and military formations during mobilization, martial law and during wartime;

     24) military duty is the constitutional duty of citizens of the Republic of Kazakhstan to protect the Republic of Kazakhstan;

     25) military educational institution – an educational organization subordinate to the Ministry of Defense, the National Security Committee and the National Guard of the Republic of Kazakhstan and implementing educational programs at various levels;

     25-1) teaching staff of military educational institutions - military personnel and civilian personnel of the Armed Forces engaged in educational, scientific, and methodological activities;

     25-2) military resident doctor – a military serviceman studying under the educational residency program under the supervision of a mentor of a medical organization;

     26) primary military and technological training is a compulsory subject of study (academic discipline) on the basics of military science, robotics and IT technologies in organizations of secondary, technical and vocational education, determined by the authorized body in the field of education;

     26-1) crisis training camps – events held with military personnel serving in the reserve to participate in the localization and liquidation of a crisis situation, as well as in other cases provided for by the laws of the Republic of Kazakhstan;

     26-2) field payments – payments made at the expense of budgetary funds to military personnel (with the exception of conscripts, cadets and cadets of military educational institutions, conscripts called up for military training, military personnel serving in the reserve) for the period of field trips, trips to sea, participation in exercises or ship trips of more than one days;

     27) field exit – training in combat, mobilization and operational training programs in the field, as well as performing special field work in the interests of the Armed Forces, other troops and military formations;

     28) doctoral student – a military man studying for a doctorate;

     29) length of service – the duration of a citizen's stay in military service, service in special state and law enforcement agencies, civil protection agencies, courier service, as well as in other cases provided for by the laws of the Republic of Kazakhstan, calculated both in calendar and preferential terms;

     30) universal military training – compulsory education of citizens of the Republic of Kazakhstan for military training during the period of martial law;

   30-1) combat training camps – events held with military personnel serving in the reserve, according to combat training programs;

     31) personnel – military personnel and civilian personnel (employees);

     32) cadet is a serviceman studying at a military educational institution that implements educational programs for technical and vocational or post–secondary education.;

     33) military personnel undergoing military service under a contract are citizens of the Republic of Kazakhstan who voluntarily entered military service in the Armed Forces, other troops and military formations for a period determined by this Law.;

     34) cadet – a serviceman studying at a military, special educational institution that implements educational programs of higher education, or at a foreign military educational institution, after graduation from which the first military rank of an officer is awarded.;

     35) course training is a form of additional education for military personnel and civilian personnel of the Armed Forces, carried out in military educational institutions, training centers or educational organizations of foreign countries in accordance with international treaties or invitations.;

     35-1) is excluded by the Law of the Republic of Kazakhstan dated January 10, 2025 No. 156-VIII (effective ten calendar days after the date of its first official publication).

     36) active reserve – military personnel performing assigned operational tasks within the framework of intelligence activities;

     37) specialized organization of the Ministry of Defense – an organization that provides training and retraining of citizens in military-technical and other specialties for the purpose of training conscripts liable for military service on a gratuitous, paid basis, as well as for driving vehicles based on economic activities and educational programs of technical and vocational education;

     38) master's student – a military man studying for a master's degree;

     39) conscription military service is the military service of male citizens based on their conscription into the Armed Forces, other troops and military formations for military positions of enlisted and non–commissioned personnel in accordance with the procedure established by this Law.;

     40) retirement – the condition of persons discharged from military service or excluded from military registration, who have reached the age limit for remaining in the reserve, or persons deemed unfit for military service with exclusion from military registration;

     41) officers – military personnel who have been awarded the appropriate military ranks of officers;

     42) psychophysiological and polygraphological examinations – a set of verification measures aimed at a comprehensive assessment of the individual psychological and psychophysiological qualities of military personnel and citizens of the Republic of Kazakhstan, carried out during selection for military service in positions, the list of which is approved by the head of the authorized body;

     42-1) military personnel serving in the reserve (hereinafter referred to as military reservists) are citizens of the Republic of Kazakhstan who voluntarily entered military service in the reserve in the Armed Forces, other troops and military formations.;

     43) rotation – the transfer of military personnel to equivalent and other positions in the Armed Forces, other troops and military formations;

     44) soldiers (sailors) – military personnel who have been awarded the appropriate military ranks of the rank and file;

     45) sergeants (foremen) – military personnel who have been awarded the appropriate military ranks of non-commissioned officers;

     46) pupils are citizens of the Republic of Kazakhstan who study in educational organizations that implement educational programs of general secondary, technical and vocational, post–secondary education with additional educational programs for military training;

     47) going to sea – the exit of the crews of ships, boats and vessels, military personnel at sea to perform tasks;

     48) authorized official – an official who has been granted the right to conclude a contract for military service or a contract for military service in the reserve in accordance with the procedure established by the Rules of Military Service.;

     49) authorized body – a state body, the structure of which provides for military service;

     50) organizational and staff measures – measures carried out in the Armed Forces, other troops and military formations to create, liquidate, reorganize, redeploy, reassign, change the staff of state institutions and their structural divisions, as well as to change the composition and staffing of the Armed Forces, other troops and military formations;

     51) ulan – a person studying in the first or second year at a military educational institution that implements educational programs for technical and vocational education based on basic secondary education.

 

The Law of the Republic of Kazakhstan dated February 16, 2012 No. 561-IV SAM.

     This Law regulates public relations in the field of military service by citizens of the Republic of Kazakhstan and defines the foundations of the state policy on social security for military personnel.
