Article 1. The basic concepts used in this Law Chapter 1. GENERAL PROVISIONS of the Law on Consumer Rights Protection
The following basic concepts are used in this Law:
1) manufacturer - a natural or legal person who produces goods for sale;
2) expiration date - the period of time after which the product is considered unsuitable for its intended use.;
3) work is an activity aimed at meeting the needs of consumers, the results of which have a material expression.;
4) disadvantage - non-compliance of the product (work, service) with the mandatory requirements of technical regulations, standardization documents, terms of the contract, as well as information about the product (work, service) provided by the seller (manufacturer, contractor);
5) warranty period – the period of time established by the seller (manufacturer, contractor), the legislation of the Republic of Kazakhstan or the contract in days, months, years, or the operating time set in hours, cycles of operation, kilometers or other similar indicators, which are calculated from the date of manufacture, purchase of goods (work, services), in during which the seller (manufacturer, contractor) guarantees the quality of the product (work, service), provided it is properly used and stored;
6) service - an activity aimed at satisfying the needs of consumers, the results of which have no material expression;
7) service life – a period of time set in days, months, years, or operating time set in hours, trigger cycles, kilometers, or other similar indicators provided for by law or contract, based on the functional purpose of the product (work result), during which the product (work result) can be used for its intended purpose.;
8) contractor - a natural or legal person who performs work or provides a service under a contract;
9) shelf life – the period of time during which the product (result of work), subject to the established storage conditions, retains the quality, properties and characteristics specified in regulatory documents establishing requirements for the quality of the product (work, service), and (or) in the contract;
10) seller is a natural or legal person who sells goods in accordance with the civil legislation of the Republic of Kazakhstan.;
11) commodity – a product (product) of the manufacturer's (contractor's) activity intended for personal, family, home or other use not related to entrepreneurial activity;
12) safety of goods (work, services) - absence of unacceptable risk associated with the possibility of harm to the life, health and (or) property of the consumer, as well as the environment, under normal conditions of use, storage, transportation, disposal of goods or in the course of work (provision of services);
13) the quality of a product (work, service) is a set of characteristics of a product (work, service) related to its ability to meet the needs of the consumer;
14) a document confirming the purchase of goods (performance of work, provision of services) - a paper or electronic control (commodity) receipt or receipt for a cash receipt, a receipt for a tear-off coupon, a duly executed technical passport, or other document containing information about the name and cost of the goods (work, service), date of purchase, seller (manufacturer, contractor);
14-1) technically complex product is a non–food product with a technically complex internal structure, which includes many structural and (or) heterogeneous elements forming a single whole, allowing it to be used for its intended purpose, determined by the nature of the compound, which exclusively includes vehicles, agricultural machinery, water and aircraft.;
14-2) a significant disadvantage of a technically complex product is an unavoidable disadvantage or disadvantage of a technically complex product that cannot be eliminated without disproportionate costs or time, including waiting time for the delivery of a spare part that exceeds the time limit established by law or is so prolonged that such elimination is no longer relevant for the consumer or makes it impossible to use the product for its intended purpose, or a disadvantage that may lead to harm to the life, health and (or) property of the consumer, the environment;
15) consumer – an individual who intends to order or purchase or orders, purchases and/or uses goods (work, service) exclusively for personal, family, home or other use unrelated to entrepreneurial activity;
16) public consumer association – an organization created as a result of a voluntary association of citizens in order to protect the rights and legitimate interests of consumers;
16-1) The Interdepartmental Consumer Rights Protection Council is a consultative and advisory body established by the authorized body in the field of consumer rights protection in order to develop proposals and recommendations on consumer rights protection issues.;
16-2) the association (union) of public consumer associations (hereinafter referred to as the association) is a voluntary association of public consumer associations established to coordinate the activities of its members and protect their common interests.;
17) the authorized body in the field of consumer rights protection (hereinafter referred to as the authorized body) is a government body responsible for management and cross–sectoral coordination in the field of consumer rights protection.
The Law of the Republic of Kazakhstan dated May 4, 2010 No. 274-IV.
This Law defines the legal, economic and social foundations of consumer protection, as well as measures to provide consumers with safe and high-quality goods (works, services).
