Article 1. The basic concepts used in this Law Chapter 1. GENERAL PROVISIONS of the Law on Culture

    The following basic concepts are used in this Law:

     1) creative circle for children and youth – an activity for the development of creative abilities of children and youth, conducted by a teacher, mentor, cultural worker or creative worker, organized on a regular basis;

     1-1) printed products – periodicals, books, brochures, albums, posters, booklets and other printed products;

     1-2) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication); 1-3) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication);

     1-4) a mandatory free copy of the publication is a copy of the publication on paper and (or) in electronic form (text, music, cartographic, and photo editions) that has undergone editorial and publishing processing, has output data, and is subject to transfer free of charge to cultural organizations defined by this Law.;

     1-5) artistic values – works of culture, literature and art created as a result of creative activity;

     2) the sectoral incentive system is a form of moral incentive for cultural, literary and artistic workers for their contribution to the development of the industry;

     2-1) creative industries – industries for the creation, production, reproduction and mass dissemination of the results of creative activities of individuals and legal entities;

     2-2) creative activity – types of economic activity related to the commercialization of the results of creative activity;

     2-3) consolidated electronic catalog of libraries of Kazakhstan – an electronic information resource containing bibliographic information about the collections of libraries of the Republic of Kazakhstan;

     2-4) the Press Archive of the Republic of Kazakhstan (hereinafter referred to as the press archive) is a collection of printed materials held by the National State Book Chamber of the Republic of Kazakhstan;

     2-5) intangible cultural heritage of the Republic of Kazakhstan – customs, forms of representation and expression, knowledge and skills, as well as related tools, objects passed down from generation to generation and being an intangible cultural value;

     2-6) The State Catalog of the Museum Fund of the Republic of Kazakhstan is an electronic information resource containing information about all museum objects and museum collections included in the museum fund of the Republic of Kazakhstan;

     2-7) cultural centers of the Republic of Kazakhstan abroad – organizations engaged in cooperation on the development and dissemination of cultural values of the Republic of Kazakhstan, using educational, scientific and cultural potential;

     3) cultural heritage of the people of the Republic of Kazakhstan - a set of cultural values of national importance, exclusively belonging to the Republic of Kazakhstan without the right to transfer them to other states;

     3-1) The Kazakhstan National Electronic Library is a state information system designed to preserve the collections of Kazakhstani libraries, museums and archives, as well as to provide users with free access to the historical, scientific and cultural heritage of Kazakhstan through information and communication technologies;

     3-2) the large language model of the Kazakh language is an artificial neural network trained on large amounts of text data for subsequent processing, generation and analysis of texts in the Kazakh language;

     3-3) the vocabulary of the Kazakh language is a set of words, terms and phrases corresponding to the linguistic norm contained in lexico-orthographic, terminological, onomastic and other dictionaries, reference books, the National Corpus of the Kazakh language, a means of preserving the language as a cultural value;

     3-4) The National Corpus of the Kazakh language is an information and reference system containing texts in all styles and genres of the Kazakh language, equipped with a search engine and other means of working with the text;

     3-5) The National Dictionary Fund of the Kazakh language is a state information system that provides access to the dictionary fund of the Kazakh language and ensures the processing of information contained therein through information and communication technologies;

     3-6) socially significant literature – relevant works aimed at increasing the spiritual, educational, intellectual and cultural potential of society;

     3-7) production director (production director, choreographer, production designer) (hereinafter referred to as the production designer) is an individual who, on the basis of an independent artistic decision, performs works of theatrical, circus or other art;

     3-8) protection of the intangible cultural heritage – taking measures to ensure the viability of the intangible cultural heritage, including its identification, documentation, research, preservation, protection, promotion, enhancement, and revival;

     3-9) National List of intangible Cultural Heritage elements – a list of cultural values of the intangible cultural heritage of the people of Kazakhstan;

     3-10) cultural and mass event – a cultural event aimed at musical and aesthetic education of the population, satisfaction of their spiritual and aesthetic needs;

     4) culture is a set of cultural values aimed at the harmonious development of personality, fostering patriotism and meeting the aesthetic needs and interests of citizens of the Republic of Kazakhstan.;

     5) cultural worker - an individual whose professional activity is related to the preservation, development, dissemination, use of cultural values and the familiarization of citizens with them;

     6) socially significant cultural events – events for commemorations and anniversaries, days of culture, festivals, screenings, contests, exhibitions and perpetuation of the memory of prominent figures of the state at the international, national and local levels;

     7) cultural activities – the activities of subjects of cultural activities for the creation, revival, preservation, protection, development, dissemination and use of cultural values, as well as the introduction to them of citizens of the Republic of Kazakhstan;

     8) state policy in the field of culture is a set of measures taken by state bodies aimed at the creation, revival, preservation, protection, development, dissemination and use of cultural and spiritual values;

     9) the authorized body in the field of culture (hereinafter referred to as the authorized body) is the central executive body responsible for leadership and intersectoral coordination in the field of culture.;

     10) cultural organizations - legal entities established in accordance with the legislation of the Republic of Kazakhstan, the main subject of which is the implementation of activities in the field of culture;

     11) certification of employees of state cultural organizations is a procedure carried out in order to determine the compliance of the qualification level of employees of state cultural organizations with the qualification requirements;

     12) cultural values – tangible and intangible values of a secular and religious nature, having historical, artistic, scientific or other cultural significance;

     12-1) subjects of cultural activity – state bodies, local executive bodies, individuals and legal entities involved in cultural activities;

     12-2) cultural event – an event related to the creation, revival, preservation, protection, development, dissemination and use of cultural and spiritual values, aimed at the harmonious development of personality, fostering patriotism and meeting the aesthetic needs and interests of each person.;

     12-3) the State Museum Fund (hereinafter referred to as the museum fund) is a set of cultural values held in the funds of state museums, museum reserves and other state organizations and owned by the Republic of Kazakhstan.;

     13) state creative order – a state-funded volume of cultural services for children and youth, determined according to the methodology of per capita regulatory financing of the state creative order and placed with suppliers regardless of their forms of ownership, departmental subordination, types and types;

     13-1) the per capita standard for financing the state creative order is the standard for financial support of the guaranteed state cost of cultural services for children and youth for creative circles for children and youth;

     13-2) museum database – a set of information about each museum object and museum collection included in the museum's collection and included in the museum fund of the Republic of Kazakhstan, providing state accounting of museum objects and museum collections;

     13-3) spectacular cultural and mass event - a cultural and mass event held in places for spectacular cultural and mass events and involving the simultaneous presence of two hundred or more spectators at this event.;

     13-4) places for holding spectacular cultural events - objects and structures adapted for holding spectacular cultural events, as well as other places not designed specifically for these purposes (stadiums, sports palaces, hippodromes, recreation areas, parks, squares, squares, streets);

13-5) time of spectacular cultural events - the time from the moment the first spectator enters (arrives) the places for spectacular cultural events until the end of the events and the exit (departure) of the last spectator from these places;

     13-6) the organizer of a spectacular cultural event is an individual or legal entity on whose initiative the spectacular cultural event is being held;

     13-7) outside creative workers – creative workers who are not in an employment relationship with the inviting cultural organization;

     13-8) theatrical production – a work of theatrical art created on the basis of dramatic, musical, dramatic or literary works, having an artistic idea and a specific name;

     14) national cultural heritage – tangible cultural values of special importance for the history and culture of the country and included in the State Register of Objects of National Cultural Heritage;

     15) special treatment of objects of national cultural heritage - measures taken by the state for the preservation, maintenance, restoration, protection and use of objects of historical and cultural heritage;

     16) The State Register of Objects of National Cultural Heritage is a list of national cultural heritage of particular importance for the history and culture of the country (hereinafter referred to as the State Register);

     16-1) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication); 16-2) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication); 16-3) excluded by the Law RK No. 213-VI dated 03.01.2019 (effective ten calendar days after the date of its first official publication);      16-4) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication); 16-5) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication); 16-6) excluded by the Law RK No. 213-VI dated 03.01.2019 (effective ten calendar days after the date of its first official publication);      16-7) excluded by the Law of the Republic of Kazakhstan dated 03.01.2019 No. 213-VI (effective after ten calendar days after the date of its first official publication);

     17) creative worker - an individual whose professional or amateur creative activity is aimed at creating artistic values, reproducing or interpreting (translating) works of literature and art;

     18) creative activity is an activity aimed at creating artistic values or interpreting (translating) works of literature and art in any form and in any way.;

     18-1) commercialization of the results of creative activity – an activity related to the practical application of the results of creative activity, including the results of intellectual activity, in order to bring new or improved goods, processes and services to the market, aimed at generating income;

     19) creative union - a public association of professional creative workers of one or several genres of culture, created on the basis of their individual membership.

 

The Law of the Republic of Kazakhstan dated December 15, 2006 No. 207.

     This Law regulates public relations in the field of creation, revival, preservation, development, dissemination and use of culture in the Republic of Kazakhstan and defines the legal, economic, social and organizational foundations of state policy in the field of culture.
