Article 1. The basic concepts used in this Law Chapter 1. General provisions of the Law on Highways
The following basic concepts are used in this Law:
1) automated measuring station is a complex of certified special control and measuring equipment, devices and equipment integrated with an intelligent transport system, which have passed metrological verification, take photos and videos, operate in automatic mode, record the type, make, state registration mark, weight and dimensional parameters, axial loads and speed of motor vehicles funds;
1-1) The National Highway Management Operator (hereinafter referred to as the National Operator) is a joint–stock company with one hundred percent state participation in the authorized capital, exercising the powers established by this Law.;
1-2) highway managers – individuals and legal entities who own highways or carry out activities related to the management of highways on the right of economic management or operational management on the basis of contracts within the framework of a state assignment, public-private partnership agreements, trust management of property, gratuitous use of public roads of regional or district significance or their by land plots;
2) road users - individuals and legal entities who are road users or carry out other activities within the boundaries of the right-of-way and roadside lane;
3) highway - a complex of engineering structures designed for the movement of vehicles, ensuring continuous, safe movement of cars and other vehicles with established speeds, loads, dimensions, as well as land plots provided for the placement of this complex (transport lands), and the airspace above them within the established size;
4) routine repair of a highway - a complex of works performed in order to prevent the occurrence of emergencies, defects on highways, as well as urgent restoration and repair of a highway carried out throughout the year, including measures to repair destroyed sections carried out by route;
5) repair of a highway is a complex of works aimed at preventing and eliminating defects, as well as restoring and improving the transport and operational qualities of a highway, including current, medium and major repairs.;
6) major repair of a highway - a complex of works to restore and (or) improve the transport and operational characteristics of a highway without changing the existing technical category;
7) maintenance of a highway - a complex of works to maintain the proper technical condition of a highway, assess its technical condition, as well as to organize and ensure road safety;
8) average repair of a highway is a complex of works related to the restoration of the original operational qualities of a highway and road structures.;
9) reconstruction of a highway is a complex of works that ensure the improvement of transport and operational qualities, safety and convenience of movement with the transfer of a highway or a separate section of it to a higher technical category.;
9-1) a section of highway (hereinafter referred to as a section) is a segment of highway located within the boundaries of its total length.;
10) the length of a highway is the actual length of the road between objects or localities, indicated in kind (on the ground) by kilometer signs.;
11) toll roads (sections) – highways (sections) in respect of which a decision has been made to use them on a paid basis and for which a fee is charged;
11-1) organization of toll traffic – measures for toll collection on toll roads (sections) through the implementation and installation of software and hardware systems for toll collection, as well as toll road management;
12) heavy-duty vehicle - a vehicle with or without cargo, the total mass or load distribution along the axes of which exceeds the maximum permissible loads for this category of roads and structures on them.;
13) bulky vehicle - a vehicle with or without cargo exceeding the overall dimensions established by regulatory legal acts.;
13-1) road assets – highways and structures on them, taking into account their actual transport and operational condition and valuation;
13-2) road asset management – activities related to diagnostics and instrumental inspection of road assets, as well as monitoring the safety of road infrastructure, aimed at effective planning of budget expenditures for the repair and maintenance of highways;
13-3) The National Center for Quality of Road Assets is a legal entity under the jurisdiction of the authorized state body for highways, which is entrusted with the functions of conducting an expert examination of the quality of works and materials, managing road assets, organizing mobilization training on highways of international and national importance, as well as conducting departmental expertise of technical documentation for average repair of highways, implementation of new technologies and maintenance of experimental sites;
14) roadside lanes - plots of land adjacent to the right-of-way, within the boundaries of which special conditions for the use of land are established to ensure the safety of traffic and the public;
14-1) roadside service facilities – buildings and structures (motels, hotels, campsites, service stations, gas stations, electric charging stations, food outlets, trade, communications, medical care, outdoor (visual) advertising facilities and other service facilities) located on the roadside and intended to serve road users in the following routes;
15) right-of-way - transport lands occupied by highways for the placement of appropriate structural elements and engineering structures of the highway, as well as buildings, structures, protective and decorative forest plantations and road communication devices necessary for their operation;
15-1) the road database is an information system of the authorized state body for highways open to users, containing information on the transport and operational condition of highways.;
15-2) monitoring the safety of road infrastructure – a set of measures aimed at ensuring the safe functioning, maintenance and improvement of the existing road infrastructure of highways;

15-3) unified database of road-building materials and new technologies – the information system of the road authority containing information on road-building materials and new technologies;
16) road activity – activities related to the design, construction, reconstruction and repair, maintenance and use of highways and structures on them, management of road assets, as well as the organization of toll traffic;
17) traffic management - a set of measures aimed at organizing and ensuring the safety and convenience of traffic on roads, improving the transport and operational condition of highways and structures, ensuring their protection, organizing the design, construction, reconstruction, repair, maintenance and use of highways based on national standards and the introduction of advanced technologies;
18) objects of the road service – road maintenance complexes, residential buildings for employees of the maintenance service, bus stops, pavilions, recreation areas, sites for short-term parking of cars, devices for technical inspection of cars, structures and devices designed to ensure road safety, forest belts, service points and protection of bridges, technological and emergency call system, toll collection software and hardware;
19) the road authority – the authorized state body on highways carrying out management of the state highways of public use;
19-1) examination of the quality of works and materials is a type of expert work on technical inspection during construction, reconstruction, repair and maintenance of highways;
20) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective ten calendar days after the date of its first official publication);
20-1) toll collection software and hardware complex - a set of equipment, software and elements of a highway intended for toll collection;
21) street (carriageway of a street) - a highway within the boundaries of localities.

This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
