Article 1. The basic concepts used in this Law Chapter 1. General provisions of the Law on Plant Protection
The following basic concepts are used in this Law:
1) special storages (burial grounds) - storages intended for safe storage with subsequent disposal or destruction of prohibited or obsolete pesticides, as well as containers from under them;
2) special equipment - a device and (or) equipment designed for the use of pesticides;
3) agricultural facilities - agricultural and other lands, granaries, vegetable storages, warehouses, open areas, production and other premises intended for the production, storage and processing of crop products;
4) especially dangerous harmful organisms - plant pests and diseases capable of periodic mass reproduction and spread, causing economic and environmental damage and included in the list of especially dangerous harmful organisms approved by the authorized body;
4-1) bioagents are organisms that reproduce in natural conditions, destroy and (or) suppress the vital activity of harmful, especially dangerous harmful organisms, as well as quarantine facilities used for plant protection;
5) harmful organisms - pests, weeds and plant diseases that adversely affect the soil, vegetation and agricultural products;
6) the economic threshold of harmfulness is the number of harmful and especially dangerous harmful organisms that cause losses of crop production, which requires phytosanitary measures.;
7) state control in the field of plant protection (hereinafter referred to as state phytosanitary control) is the activity of the department of the authorized body and its territorial divisions to verify and monitor the compliance of the activities of individuals and legal entities, as well as officials with the requirements of the legislation of the Republic of Kazakhstan on plant protection;
8) plant protection is a field of activity aimed at the development and practical application of methods of phytosanitary monitoring, phytosanitary measures in order to prevent losses of crop production from harmful and especially dangerous harmful organisms;
8-1) plant protection products – pesticides, bioagents, as well as technical and other means used for plant protection;
9) crop production - products intended to meet the needs of the population in food, animal husbandry - in feed and industry - in raw materials;
10) pesticides – chemical and (or) biological preparations (insecticides, rodenticides, fungicides, herbicides, anti-emergence agents and plant growth regulators, defoliants, desiccants) used to control harmful and especially dangerous harmful organisms, quarantine facilities and alien species, pests of stored agricultural products, as well as for seed treatment, pre-harvest drying, leaf removal and plant growth regulation;
11) pesticide neutralization - measures aimed at the disposal, destruction of prohibited or unusable pesticides and containers from under them, as well as containers from under used pesticides in accordance with the legislation of the Republic of Kazakhstan;
12) state registration of a pesticide is a procedure based on the results of which a registration certificate for a pesticide is issued to the registrant (applicant) in accordance with the legislation of the Republic of Kazakhstan.;
13) the initial components of pesticides are chemical and other substances intended for the production of pesticides;
14) residual amount of pesticides is a quantitative indicator of the content of pesticides in crop production and environmental objects, which is used to assess their safety for humans and animals.;
15) the production (formulation) of pesticides is the technological process of manufacturing pesticides based on the initial components;
15-1) temporary registration of pesticides – temporary state registration of pesticides;
16) list of pesticides – a list of registered pesticides authorized for production (formulation), import, storage, transportation, sale and use in the territory of the Republic of Kazakhstan;
16-1) registration (small–scale and production) tests of pesticides - a procedure for confirming the effectiveness and safety of the use of pesticides, carried out in small-scale experiments and in production conditions, including biological, economic, toxicological, hygienic and environmental assessments of pesticides, in accordance with the rules for registration (small-scale and production) tests and state registration of pesticides;
17) the authorized body in the field of plant protection (hereinafter referred to as the authorized body) is the central executive body responsible for plant protection management, as well as inter-sectoral coordination within its powers.;
17-1) registrant (applicant) – a natural or legal person who has submitted an application for registration (small-scale and industrial) tests of pesticides, as well as state registration of pesticides in order to obtain a registration certificate;
18) phytosanitary situation - the current state of agricultural facilities, determined by the number and harmfulness of harmful and especially dangerous harmful organisms;
19) phytosanitary forecast - a preliminary determination of the possible spread and degree of development of harmful and especially dangerous harmful organisms in order to plan the timing and scope of phytosanitary measures;
20) phytosanitary monitoring is a system of measures that includes inspection, monitoring, accounting for the development and spread of harmful and especially dangerous harmful organisms, as well as the development of a phytosanitary forecast based on them.;
21) phytosanitary standards - established parameters of quantities used to determine the volume of phytosanitary measures;
22) phytosanitary measures – a set of measures ensuring the destruction and (or) reduction of the number and harmfulness of harmful and especially dangerous harmful organisms below the economic threshold of harmfulness.
The Law of the Republic of Kazakhstan dated July 3, 2002 No. 331.
This Law defines the legal, economic and organizational bases for carrying out activities in the field of plant protection from pests, weeds and plant diseases and is aimed at preserving crops, their quality and preventing harmful effects on human health and the environment when implementing phytosanitary measures in the territory of the Republic of Kazakhstan.
