Article 1. The basic concepts used in this Law Chapter 1. General provisions of the Law on State Control over the Circulation of Certain Types of Weapons
The following basic concepts are used in this Law:
1) firearms - weapons in which the ejection of a bullet, projectile, grenade from the bore occurs as a result of the energy of a powder or other charge;
1-1) A mass-dimensional model made of firearms is a military hand–held small arms, civilian, and service firearms brought by making irreversible structural alterations of its main (component) parts into a state of impossibility to fire a shot and restore it to its original condition, as well as assembling functional firearms from its main (component) parts.;
2) signal weapon - a weapon used to give sound, light and smoke signals;
3) gas weapon - a weapon whose use is based on the use of tear or irritating substances;
4) forensic requirements – special technical requirements (parameters, design features, markings) applied to civilian, service weapons and ammunition, as well as products structurally similar to weapons;
5) weapons – devices and objects designed to destroy a live or other target, as well as to send signals.
Weapons do not include household and industrial products, sports equipment, as well as weapons with a muzzle energy of 0.5 to 3 joules that mimic the appearance of weapons and do not contain the main (component) parts of firearms (hereinafter referred to as structurally similar to weapons).;
6) arms trafficking – production, assembly, repair, alteration, sale (trade), transfer, donation, awarding, inheritance, acquisition, collecting, exhibiting, accounting, storage, carrying, transportation, use, seizure, destruction, importation into the territory of the Republic of Kazakhstan, export from the territory of the Republic of Kazakhstan and transit through weapons, including their main (component) parts and cartridges, on the territory of the Republic of Kazakhstan;
6-1) collecting weapons is a licensed activity of individuals and legal entities for the systematic collection of civilian and service weapons that are not prohibited for circulation in the territory of the Republic of Kazakhstan.;
6-2) constructive modification of weapons – replacement or modification of the shape and (or) size of the main (component) parts of firearms, pneumatic, signal, cooled, gas weapons, gas weapons with the ability to fire traumatic cartridges and small arms projectiles, which led to a change in the technical characteristics of the weapon.;
6-3) the main (component) parts of the weapon are the barrel, drum, bolt, frame, receiver of firearms, gas, gas-fired cartridges with traumatic action, pneumatic, signal, cooled weapons.;
6-4) display of weapons is a licensed activity of individuals and legal entities to demonstrate civilian and service weapons and (or) cartridges belonging to them, or weapons and (or) cartridges belonging to other owners that are not prohibited for circulation on the territory of the Republic of Kazakhstan (non–commercial or commercial exhibition, sale or auction);
7) arms manufacturer – an organization licensed to develop, manufacture, repair, and trade weapons;
8) weapon user – a natural or legal person who has received a weapon from the owner for temporary use;
9) purchase of weapons – purchase, receipt of weapons as a gift, reward;
10) the owner of a weapon is an individual or a legal entity who owns a weapon on the basis of a permit to purchase, carry and store weapons.;
11) manufacture of weapons - research, development, manufacture, testing, assembly, decoration, repair, alteration and destruction of weapons, their main (component) parts, manufacture of cartridges;
12) throwing weapon – a weapon designed to hit a target at a distance, thrown using human muscular strength (throwing throwing weapon), as well as weapons designed to hit a target at a distance with projectiles using mechanical energy (throwing small arms);
12-1) projectile – a device consisting of striking, supporting and stabilizing elements, or an object with damaging properties designed to mechanically destroy a target located at a distance as a result of throwing from small arms missiles;
13) ammunition (cartridges) - devices or objects structurally designed for firing a weapon of the appropriate type and hitting a target (hereinafter referred to as cartridges);
13-1) naked weapon – a specially manufactured weapon or firearm, firearmless, gas weapon, or gas weapon with the ability to fire traumatic cartridges, brought by making irreversible structural alterations of its main (component) parts into a condition suitable for simulating a shot exclusively with a light-and-sound cartridge (blank cartridge), for use in carrying out cultural activities., educational, collection activities;
14) pneumatic weapon - a weapon, the means of destroying the target of which receives directional movement due to the energy of compressed, liquefied or solidified gas;
15) cold steel – a weapon designed to directly hit a target with the help of human muscular strength;
16) an electric weapon is a special device, the use of which is based on the action of an electric discharge.
The Law of the Republic of Kazakhstan dated December 30, 1998 No. 339.
This Law regulates legal relations arising from the turnover of civilian, service, military handguns and cold steel weapons in the territory of the Republic of Kazakhstan, and is aimed at protecting the life and health of citizens, property, ensuring public safety, protecting environmental facilities, resources, and developing international cooperation in combating crime and illegal proliferation of weapons.
The provisions of this Law also apply to the circulation of ammunition (cartridges).
