Article 1. The basic concepts used in this Law Chapter 1. General provisions The Law on Motor Transport

  The following basic concepts are used in this Law:

     1) the emergency call system in case of accidents and catastrophes (hereinafter referred to as the emergency call system) is a state automated information system operating using signals and data from navigation satellite systems, providing formalized information about road accidents and other emergency situations on the highways of the Republic of Kazakhstan to emergency operational services;

     1-1) bus – an automobile vehicle designed to transport passengers and luggage, having more than eight seats, excluding the driver's seat;

     2) bus station - a complex of facilities designed to serve passengers and bus drivers, whose passenger traffic is more than five hundred people per day, and includes: a capital building with a waiting room with a capacity of over seventy-five people and ticket offices, medical examination points for drivers and primary health care, luggage storage, an apron for boarding and disembarking passengers, bus parking area, bus inspection posts, control rooms and a mother and child room, located on an area of at least five thousand square meters;

     2-1) services of bus stations, bus stations and passenger service points – activities carried out by individuals and (or) legal entities at bus stations, bus stations and passenger service points related to the provision of automobile transportation of passengers and luggage;

     3) technical operation of motor vehicles - a set of measures, technical impacts (diagnosis, maintenance, repair) aimed at organizing and ensuring the safe operation of motor vehicles;

     3-1) automated measuring station is a complex of certified special control and measuring equipment, devices and equipment integrated with an intelligent transport system, which have passed metrological verification, take photos and videos, operate in automatic mode, record the type, make, state registration mark, weight and dimensional parameters, axial loads and speed of motor vehicles funds;

     4) road transport is a branch of the economy, the sphere of activity of which is the organization and implementation of transportation of passengers, baggage, cargo and mail using vehicles and infrastructure;

     5) road transport infrastructure – a complex of facilities (bus terminals, bus stations, passenger service points, cargo terminals, stations (workshops) for maintenance and repair of vehicles, facilities for storage of vehicles), ensuring the continuity of the transportation process, as well as the safe operation of vehicles;

     6) an automobile vehicle (hereinafter referred to as a motor vehicle) is a unit of rolling stock of motor transport, including buses, minibuses, cars and trucks, trolleybuses, car trailers, semi–trailers for tractor units, as well as specialized vehicles (designed to transport certain types of goods) and special vehicles (designed to perform various predominantly non–transportation tasks). works);

     6-1) a weighing station for motor vehicles is a stationary or mobile point designed to perform work on measuring the weight and overall parameters of motor vehicles, having for these purposes a measuring instrument, stationary–type weighing equipment or portable mobile scales that provide information interaction with an intelligent transport system.;

     6-2) the operator of the weighing station of motor vehicles is an individual entrepreneur or a legal entity engaged in measuring the weight and dimensional parameters of motor vehicles.;

     7) automobile transportation – transportation of passengers, baggage, cargo and mail carried out by motor vehicles on highways;

     8) an automobile carrier (hereinafter referred to as a carrier) is an individual or legal entity that owns motor vehicles, with the exception of passenger cars, by right of ownership or on other legal grounds, and carries out business activities for the transportation of passengers, baggage, cargo and mail;

     9) bus station - a complex of facilities designed to serve passengers and bus drivers, whose passenger traffic is less than five hundred people per day, and includes: a capital building with a waiting room with a capacity of up to seventy-five people and ticket offices, luggage storage, an apron for boarding and disembarking passengers, a bus parking area, control rooms, located on an area of at least two and a half thousand square meters;

     9-1) taxi information and dispatch service - a service created by a carrier or other person who is an individual entrepreneur or a legal entity of the Republic of Kazakhstan to process customer orders and transfer them to a taxi carrier for execution, including using a hardware and software package, Internet platforms and (or) a mobile taxi ordering application;

     9-2) Is excluded by the Law of the Republic of Kazakhstan dated December 29, 2022 No. 174-VII (effective sixty calendar days after the date of its first official publication).

     9-3) socially significant transportation – transportation of passengers in regular traffic, affecting the socio-economic situation of society and organized in order to ensure an affordable level of tariffs and the possibility of free movement of the population on the territory of the Republic of Kazakhstan;

     10) baggage - passenger's property packed and transported in the luggage compartment of a bus, minibus or in a baggage car accompanying a bus, minibus, within the limits of the norms established by the Rules for transporting Passengers and Luggage by Road, as well as in a taxi on the basis of an additional agreement with the carrier;

     10-1) indivisible cargo – bulky and (or) heavy cargo that cannot be divided into two or more parts during transportation without changing its purpose, excessive costs or the risk of damage.;

     11) passenger car - a motor vehicle designed for the automobile transportation of passengers and luggage and having no more than eight seats, excluding the driver's seat;

     12) passenger - an individual who uses the carrier's services on the basis of a concluded contract of automobile transportation or other legal basis;

     12-1) passenger agency – a person providing services for the sale of travel documents (tickets) through its points of sale on the basis of an agreement with the carrier, ensuring compliance with the requirements for the registration of travel documents (tickets);

     12-2) passenger service point – an object designed to serve passengers in settlements that do not have bus stations or bus stations, equipped for the sale of travel documents (tickets) and baggage receipts, a platform for safe stopping of vehicles, boarding, disembarking passengers and a facility to protect passengers from various weather conditions;

     13) irregular automobile transportation of passengers and baggage - transportation that is not regular, carried out using buses and minibuses by carriers who have licenses issued in accordance with the established procedure;

     14) regular automobile transportation of passengers and baggage - transportation carried out by carriers using buses, minibuses, trolleybuses, according to pre-agreed routes, timetables with established starting and ending points, points of embarkation and disembarkation of passengers;

     15) a waybill is a document in paper or electronic–digital form intended for accounting and monitoring the work of a driver and a motor vehicle.;

     15-1) travel document (ticket) – a document in paper or electronic form, by which a passenger transportation contract is concluded.;

     16) consignee - a natural or legal person authorized to receive cargo on the basis of a contract for the carriage of goods by road or on other legal grounds.;

   17) shipper - an individual or legal entity on whose behalf the shipment is processed;

     17-1) cargo – property accepted for transportation in accordance with the requirements established by the Rules of Cargo Transportation by road;

17-2) invataxi – a taxi designed to provide transportation services for persons with disabilities;;

     IZPI's note!      Article 1 is provided to be supplemented by subparagraph 17-3) in accordance with the Law of the Republic of Kazakhstan dated 30.06.2025 No. 204-VIII (effective sixty calendar days after the date of its first official publication).

   17-3) intelligent transport system is a complex of interconnected automated systems that provide management, monitoring and control of traffic and transportation activities, including certified special control and measuring equipment, devices and equipment operating in automatic mode, recording offenses in the field of motor transport and traffic;

     18) the unified transport document management system is an information system that ensures the registration, accounting, processing and storage of documents related to transportation activities in the field of motor transport, and the transmission of formalized information about such documents to the relevant authorized state bodies and participants in the transportation process;

     18-1) transport control post - a stationary or mobile checkpoint equipped with technical means of control, equipped with a capital building or special vehicles;

     18-2) public transport – public transport that carries out regular and irregular automobile transportation of passengers and luggage, as well as taxis;

     19) excluded by the Law of the Republic of Kazakhstan dated December 28, 2010 No. 369-IV (effective after ten calendar days after its first official publication); 20) excluded by the Law of the Republic of Kazakhstan dated December 28, 2010 No. 369-IV (effective after ten calendar days after its first official publication); 21) excluded by the Law of the Republic of Kazakhstan dated 12/28/2010 No. 369-IV (effective ten calendar days after its first official publication);      22) excluded by the Law of the Republic of Kazakhstan dated December 28, 2010 No. 369-IV (effective after ten calendar days after its first official publication);

     23) hand luggage - personal belongings of a passenger carried by him in the cabin of a bus, minibus or taxi, the weight and dimensions of which meet the requirements established by the Rules for the Carriage of Passengers and Luggage by road;

     23-1) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective three months after the date of its first official publication);

     23-2) dump truck – a self-unloading truck, trailer or semi-trailer with a body mechanically tilted for unloading cargo;

     23-3) permitted maximum mass is the mass of an equipped motor vehicle with cargo, driver and passengers, set by the manufacturer as the maximum permitted. The sum of the permitted maximum masses of the vehicles included in the composition is taken as the permitted maximum mass of the composition of vehicles, that is, coupled and moving as one unit.;

     23-4) service center (workshop) – an individual or legal entity engaged in the installation and maintenance of tachographs;

     23-5) certification center is a legal entity that digitally certifies electronic cards for electronic (digital) tachographs in accordance with the provisions of the European Agreement concerning the Work of Crews of Motor Vehicles Engaged in International Road Transport (AETR) of 1970;

     23-6) satellite navigation equipment is a hardware and software device installed on a motor vehicle to determine its current location, direction and speed based on signals from global navigation satellite systems, exchange data with additional on–board equipment, as well as to exchange information over mobile radiotelephone communication networks;

     24) excluded by the Law of the Republic of Kazakhstan dated December 28, 2010 No. 369-IV (effective after ten calendar days after its first official publication);

     25) taxi is a passenger car designed for the automobile transportation of passengers and luggage, equipped in accordance with the Rules for the Transportation of Passengers and luggage by road;

     25-1) Mobile taxi ordering application is a mobile employment platform application that provides access to taxi ordering and renting a vehicle with a crew through cellular or Internet services;

     25-2) taxi carrier – an individual engaged in the provision of services or work using Internet platforms and (or) mobile applications for platform employment, an individual entrepreneur or a legal entity providing passenger and baggage transportation services for taxis;

     25-3) taximeter is a device designed to calculate the cost (price) of transporting passengers and luggage by taxi;

     25-4) tachograph – a mechanical or electronic (digital) monitoring device for recording the working and rest conditions of drivers;

     26) excluded by the Law of the Republic of Kazakhstan dated 17.07.2009 No. 188-IV (for the procedure of entry into force, see art. 2);

     27) authorized body - the central executive body responsible for management in the field of motor transport, as well as, within the limits provided for by the legislation of the Republic of Kazakhstan, inter-sectoral coordination;

     28) international road transport - transportation carried out by carriers between points located on the territory of different states;

     28-1) is excluded by the Law of the Republic of Kazakhstan dated 05/21/2024 No. 86-VIII (effective six months after the date of its first official publication).

     29) minibus - a bus of a particularly small class, having no more than sixteen seats, excluding the driver's seat provided by the manufacturer;

     30) emergency operational services – services that provide emergency assistance in case of road accidents and other emergency situations on the highways of the Republic of Kazakhstan.

      This Law regulates the relations that arise between carriers, passengers, shippers, consignees, and other individuals and legal entities in the field of road transport.
