The following basic concepts are used in this Law:

1) excluded by the Law of the Republic of Kazakhstan dated 11.12.2009 No. 229-IV (for the procedure of entry into force, see art. 2);

1-1) is excluded by the Law of the Republic of Kazakhstan dated 04.12.2015 No. 435-V (effective from 01.01.2016);

2) attestation - the establishment (confirmation) of compliance of individuals and (or) legal entities with the status of a subject of seed production;

3) attestation certificate – a document issued within the competence of the local executive body of the region (city of republican significance, capital), attesting to the recognition by the state of the activities of certified entities in the field of seed production;

4) agricultural plants - cereals, legumes, cereals, fodder, oilseeds, essential oils, technical, vegetable, medicinal, flower, fruit, berry crops, potatoes, grapes;

5) approbator - an individual who has notified the relevant local executive body of a district, a city of regional significance, a region, a city of republican significance and the capital about the start of activities for testing varietal crops of agricultural plants.;

6) control tests - establishing the preservation of the characteristics of an agricultural plant variety and the conformity of the variety to this variety;

7) original seeds - seeds produced by the author of an agricultural plant variety, a person authorized by him or the originator of the variety and intended for the production of elite seeds;

8) seeds of the first, second and third reproductions - subsequent reproduction of elite seeds by year: the first year is the first reproduction, the second year is the second reproduction, the third year is the third reproduction;

9) approbation of crops - determination of the varietal qualities of crops of agricultural plants: varietal purity, varietal typicity, degree of contamination, disease damage and pest damage;

10) soil assessment - the establishment of the belonging of seeds to a certain type, variety and their varietal purity by sowing in special areas and subsequent verification of varietal qualities of plants;

11) laboratory varietal testing - establishing the affiliation of seeds to a certain variety and determining the varietal purity of seeds by conducting laboratory analysis;

12) excluded by the Law of the Republic of Kazakhstan dated 05.10.2018 No. 184-VI (effective six months after the date of its first official publication);

12-1) The State Commission for Variety Testing of Agricultural Crops is an organization under the jurisdiction of an authorized body that carries out the examination and testing of plant varieties for patentability and economic usefulness.;

13) variety exchange - replacement by seed producers of old varieties cultivated in production with new varieties recommended for use, more productive or superior to the replaced varieties in terms of economically valuable characteristics and properties;

14) variety renewal - replacement of seeds, the varietal and biological qualities of which have deteriorated during use in production, with the best seeds of the same variety.;

15) varietal typicity is an indicator of the varietal purity of cross-pollinated agricultural plants;

16) originator of a variety - a natural or legal person who ensures the preservation of the variety;

17) varietal control - control over the implementation of measures to determine the varietal purity of crops of agricultural plants and to establish the affiliation of seeds to a certain variety;

18) variety testing - examination and testing of a breeding achievement for patentability and economic usefulness, conducted in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

19) varietal purity - the percentage ratio of the number of plants or stems of the main variety to the total number of plants or stems of a given agricultural plant;

20) super elite seeds - seeds belonging to the original ones, obtained from the crop of the breeding nursery, meeting the requirements of national standards and other regulatory documents in the field of seed production and intended for the production of elite seeds;

20-1) seed certificate – a document confirming the varietal and sowing qualities of original and elite seeds;

21) seeds - generative and vegetative organs of plants used for the reproduction of varieties: seeds themselves, fruits, parts of complex fruits, spikelets, spikelets, seedlings, bulbs, tubers, cuttings, meristem and others;

22) seed conditioning - seed compliance with the requirements of national standards and other regulatory documents in the field of seed production;

23) varietal qualities of seeds - a set of characteristics characterizing the belonging of seeds to a certain variety of an agricultural plant;

24) a batch of seeds is a certain number of seeds of uniform origin and quality, confirmed by an appropriate document (act of approbation, certificate of seeds, certificate of seed conditioning, certificate of seed analysis, quarantine certificate, phytosanitary certificate).;

25) seed control - control over the implementation of measures to determine the seeding qualities of seeds, for compliance with the requirements of the legislation of the Republic of suitability for sowing (planting);

26) seed certificate - a document confirming the varietal and sowing qualities of seeds of the first and subsequent reproductions;

27) seed quality - a set of seed quality indicators that characterize the degree of their suitability for sowing (planting);

28) seed producers - individuals and legal entities engaged in activities in the field of seed production in accordance with this Law;

29) seed farming is an economic entity certified by the local executive body of the region (city of republican significance, capital), which produces and sells seeds of the first, second and third reproductions.;

29-1) seed distributor - an individual or legal entity certified by the local executive body of the region (city of republican significance, capital), engaged in the sale of batches of seeds of agricultural plants and (or) the issuance of seed loans;

30) seed quality examination laboratory – a legal entity accredited in accordance with the established procedure and engaged in research of varietal and seed qualities of seeds for their compliance with the requirements of national standards and other regulatory documents in the field of seed production;

31) seed expertise – a set of measures to determine the varietal and seed qualities of seeds for their compliance with the requirements of technical regulations and standardization documents in the field of seed production;

32) seed expert - a specialist of the laboratory for the examination of seed quality, who notified the relevant local executive body of the district, the city of regional significance, the region, the city of republican significance and the capital about the beginning of activities to conduct an examination of varietal and sowing qualities of seeds.;

33) seed production - an activity that includes a set of measures for the production, harvesting, processing, storage, transportation, sale and use of seeds, as well as state control, including varietal and seed;

34) state seed inspector – an official of the local executive body exercising state control in the field of seed production;

35) the seed production scheme is a group of interconnected nurseries and seed crops in which the process of variety reproduction is carried out in a certain sequence by selection and reproduction;

36) the authorized state body in the field of seed production (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of seed production;

37) elite seeds are seeds of agricultural plants that are obtained from original or super elite seeds and comply with the requirements of the legislation of the Republic of Kazakhstan on seed production;

38) elite seed farming is an economic entity certified by the local executive body of the region (city of republican significance, capital), which produces and sells elite seeds.

The Law of the Republic of Kazakhstan dated February 8, 2003 No. 385.

This Law defines the legal, economic and organizational bases for carrying out activities in the field of seed production and is aimed at regulating the organization and functioning of the seed production system and state control over the production, harvesting, processing, storage, transportation, sale and use of seeds of agricultural plants.
