Article 1. The basic concepts used in this Law Chapter 1. General provisions The Law on the Protection, Reproduction and Use of Wildlife

     The following basic concepts are used in this Law:

     1) aquaculture – artificial reproduction and cultivation of fish resources and other aquatic animals; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     2) full house – a sign indicating the name and boundaries of hunting farms, reproductive plots and resting areas, fishing ponds and (or) sites, as well as dates and places prohibited for hunting and fishing;

     3) hunter – an individual who has obtained the right to hunt in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     3-1) hunting dogs – Kazakh and other dog breeds used in hunting;

     4) hunter's certificate – a document of the prescribed form certifying the right of an individual to hunt;

     5) reserve fund of hunting grounds and fishery reservoirs and (or) sites – hunting grounds and fishery reservoirs and (or) sites that are not assigned to users of wildlife;

     6) hunting minimum (hereinafter referred to as the hunting minimum) is a special short course of the training program that examines the issues of legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife, safety techniques during hunting, knowledge of which is a prerequisite for issuing a hunter's certificate.;

     7) excluded by the Law of the Republic of Kazakhstan dated 01/3/2023 No. 185-VII (effective from 07/01/2023).  

     8) hunting trophy – an animal (except for fish resources and other aquatic animals), its parts and derivatives removed from the habitat in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     9) hunting is a type of economic activity for the sustainable use of wildlife in hunting grounds, the preservation of wildlife habitat, their protection and reproduction;

     10) hunting farm category – a unit of classification division of hunting farms based on the productivity of hunting grounds, the nature of conservation and reproduction measures, assigned to hunting farms on the basis of inter-farm hunting management;

     11) the subject of hunting economy – the natural or legal person conducting hunting economy on the fixed hunting grounds according to the procedure established by the legislation of the Republic of Kazakhstan;

     12) internal regulations of the hunting industry – a document establishing the procedure for hunting by an individual on the territory of the hunting industry, including the rate of animal production, the price list for services provided;

     13) hunting bird of prey – eagle, falcon, hawk and other types of birds of prey used in hunting;

     14) fishing – fishing of fish resources and other aquatic animals;

     15) angler – an individual who has obtained the right to amateur (sport) fishing in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     16) fishing trophy – an object of fish resources and other aquatic animals, their parts and derivatives, removed from their habitat in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     16-1) fish receiving point – a place specially equipped by a fisheries entity, intended for receiving, weighing, accounting, temporary storage and sale of fish resources and other aquatic animals caught in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

    16-2) fish planting material – juvenile fish (larvae, fingerlings and other age groups of fish) intended for stocking reservoirs;

     16-3) a permit for the use of fish resources and other aquatic animals is a document in a prescribed form that entitles individuals and legal entities to use fish resources and other aquatic animals, as well as to export and sell caught fish and other aquatic animals, their parts and derivatives, including fishing trophies;

     17) the fish breeding season is the period of time during which fish of a particular species spawn.;

     18) certificate of catch origin – a document established by the authorized body in the field of fisheries confirming the origin of fish resources and other aquatic animals caught in fishery reservoirs and (or) plots on the basis of a permit for the use of fish resources and other aquatic animals;

     19) fish protection device – a device for preventing fish resources and other aquatic animals from entering water intake and discharge facilities;

     20) zamor – mass death of fish resources and other aquatic animals caused by violation of hydrochemical and other regimes of a reservoir and (or) site;

     21) hazardous reservoir and (or) site – a fishery reservoir and (or) site subject to periodic flooding;

     22) fish migration is the mass movement of fish from one habitat to another;

     23) fish farming – the field of aquaculture for the artificial reproduction and cultivation of fish for business purposes;- Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM.  

     24) fish resources and other aquatic animals – the total set of all animals living in the aquatic environment, including aquatic biological resources, with the exception of plants;

     25) the basin principle of state management of fish resources and other aquatic animals (hereinafter referred to as the basin principle) is a unified management system for fish resources and other aquatic animals in fisheries reservoirs and (or) areas, taking into account the specifics of reproduction and migration of fish resources and other aquatic animals, applied by the authorized body in the field of fisheries, regardless of administrativeterritorial division;

     26) fisheries – a type of economic activity related to the protection, reproduction, fishing, as well as the processing and sale of fish resources and other aquatic animals;

  26-1) the authorized body in the field of fisheries is the central executive body responsible for the management of the protection, reproduction and use of fish resources and other aquatic animals, as well as inter–sectoral coordination within its powers.;

     27) certification of fisheries reservoirs and (or) sites – a set of measures to determine the boundaries of fisheries reservoirs and (or) sites, their area, condition, species composition of fish resources and other aquatic animals produced before securing fisheries reservoirs and (or) sites;

     28) subject of fisheries – an individual and a legal entity, the main activity of which is the management of fisheries;

     28-1) fishery technological reservoir is an artificially created reservoir (pond, fish–breeding pool) designed to create conditions for growing aquaculture facilities, which is filled with water using hydraulic structures or devices.; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     29) excluded by the Law of the Republic of Kazakhstan dated 06/15/2017 No. 73-VI (effective ten calendar days after the date of its first official publication);  

     30) fisherman – an employee of a fisheries entity who, by virtue of his work duties, catches fish resources and other aquatic animals in designated fisheries reservoirs and (or) sites.;

     31) a fisherman's certificate is a document of the prescribed form issued by a fisheries entity certifying the right of an individual to exercise the functions of a fisherman;

     32) biological justification – a scientifically based conclusion on the use of wildlife, determination of the permissible amount of seizure of objects of the animal world, as well as activities that may affect objects of the animal world and their habitat;

     32-1) joint aquatic biological resources – aquatic biological resources, which are jointly managed by the States located on the coast of the Caspian Sea;

     33) derivative – a derivative of an animal and products made from it and its derivative;

     34) wild breeding – breeding of animals that are the object of hunting, subjects of the hunting industry;

     35) animals – wild animals (mammals, birds, reptiles, amphibians, fish, mollusks, insects and others) in a state of natural freedom on land, in water, atmosphere and soil;

     36) part of an animal (hereinafter referred to as part) is a fragment of an animal's body that allows its species to be identified.;

     37) animal hybridization is the crossing of individuals of different species or breeds of animals in order to obtain individuals with the best economically useful characteristics or properties.;

     38) wildlife – a set of animals permanently or temporarily residing on the territory of the Republic of Kazakhstan, as well as related to the natural resources of the continental shelf and the exclusive economic zone of the Republic of Kazakhstan;

     38-1) monitoring of wildlife – a system of observations, assessment and forecasting of the state and dynamics of wildlife objects for the purposes of public administration in the field of protection, reproduction and use of wildlife and conservation of biological diversity;

     39) withdrawal of objects of the animal world – extraction (extraction, fishing, shooting, collection, slaughter) from the habitat of animals living in a state of natural freedom, their parts and derivatives on the basis of a permit for the use of wildlife or a permit for the use of fish resources and other aquatic animals;

     40) artificial breeding of objects of the animal world – keeping and breeding of animal species in captivity and (or) semi-free conditions;

41) protection of wildlife – activities aimed at the conservation of wildlife, its habitat and biological diversity, the sustainable use and reproduction of wildlife, as well as a set of measures to prevent and combat offenses in the field of protection, reproduction and use of wildlife;

     42) state control in the field of protection, reproduction and use of wildlife – the activities of the authorized state body in the field of protection, reproduction and use of wildlife and the authorized body in the field of fisheries, their departments and their territorial divisions within their competence to verify and monitor the audited entities for compliance with their activities with the requirements established by the legislation of the Republic of Kazakhstan, during the implementation and as a result of which measures may be applied of a legally restrictive nature without prompt response;

     43) state supervision in the field of protection, reproduction and use of wildlife – the activities of the authorized state body in the field of protection, reproduction and use of wildlife and the authorized body in the field of fisheries, their departments and their territorial divisions within their competence to verify and monitor compliance by the audited entities with the requirements of the legislation of the Republic of Kazakhstan, during implementation and as a result of which law-restrictive measures may be applied, including prompt response;

     44) the authorized state body in the field of protection, reproduction and use of wildlife (hereinafter referred to as the authorized body) is the central executive body responsible for the protection, reproduction and use of wildlife, with the exception of fish resources and other aquatic animals in the field of conservation and reproduction of Kazakh dog breeds, as well as within its powers intersectoral coordination;

     45) sustainable use of wildlife – the use of objects of the animal world in ways that do not lead to the depletion of the species diversity of the animal world and preserve its ability to reproduce and meet the needs of current and future generations;

     46) use of the animal world – the use of objects of the animal world, their parts, derivatives and useful properties with or without removal from the habitat;

    47) permission to use wildlife is a document of a prescribed form that entitles individuals and legal entities to use wildlife (with the exception of fish resources and other aquatic animals), as well as to export and sell extracted objects of wildlife (with the exception of fish resources and other aquatic animals), their parts and derivatives, including including hunting trophies;

     48) users of the animal world – individuals and legal entities who, in accordance with this Law, are granted the right to use the animal world.;

     49) unavoidable harm to wildlife is a residual, non-preventable harm caused and (or) inflicted on wildlife or its habitat by the adverse effects of factors resulting from natural, climatic and anthropogenic influences.;

     50) biological diversity of the animal world – the diversity of objects of the animal world within the same species, between species and the diversity of ecological systems;

     51) habitat of the animal world – a natural environment in which objects of the animal world live in a state of natural freedom;

     52) protection of the habitat of the animal world – an activity aimed at preserving or restoring the conditions of sustainable existence and reproduction of objects of the animal world in a state of natural freedom;

     53) an object of the animal world – an individual or a population of animals;

     54) animal introduction is the deliberate or accidental spread of individuals of animal species beyond their ranges (distribution areas) to new places where these species did not previously live.;

     55) animal reintroduction – the deliberate relocation of individuals of animal species to their former habitats;

     56) reproduction of animal species – natural reproduction of animal species in natural conditions and their artificial breeding;

     57) excluded by the Law of the Republic of Kazakhstan dated 06/15/2017 No. 73-VI (effective ten calendar days after the date of its first official publication);  

     58) a permit is a document (one–time or seasonal) issued to an individual for visiting designated hunting grounds and (or) fishing ponds and (or) sites for the purpose of obtaining wildlife;

     58-1) illegal, unreported and unregulated fishing is the illegal and (or) unregulated activity of individuals and legal entities to remove aquatic biological resources from their natural habitat.;

     59) zoological collection – a collection of stuffed animals, eggs, cryopreserved germ cells, preparations and parts of objects of the animal world, objects of the animal world, including wild animals of zoos, zoo gardens, circuses, zoological nurseries, aquariums, oceanariums, representing scientific, cultural, educational, educational and aesthetic value;

     59-1) ichthyological observations – collection and study of data on the state of the ichthyofauna of a fishery reservoir;

     60) Ichthyofauna is a collection of fish and roundworts species of a reservoir or part of it.;

     60-1) fishing is the activity of individuals and legal entities, the purpose of which is to remove aquatic biological resources from their natural habitat.;

     60-2) fishing effort – the volume of production operations directly aimed at the extraction of fish resources and other aquatic animals, including the permissible number of fishing gear and equipment, floating equipment, fishermen in fixed fisheries reservoirs and (or) areas for commercial fishing;

     61) a commercial stock is a population or a spatially isolated part of it that is stable in time and has an independent commercial significance.;

     62) by–catch is a part of the catch consisting of individuals of fish species and other aquatic animals not specified in permits, and (or) fish below the established fishing sizes.;

     62-1) cynological activities – activities related to the training, training, and whipping of dogs of Kazakh breeds and their other preparation for practical use, including in sports and hunting, the organization and conduct of zootechnical, sports and other mass events using dogs of Kazakh breeds, the training of experts and specialists in working with Kazakh breeds dogs.

     The training, training, and whipping of Kazakh breed dogs and their other preparation for practical use should be understood as the upbringing and training of Kazakh breed dogs in work and (or) preparation for hunting, sports, and field trials.;

     62-2) commercial fish farming is a type of economic activity for the cultivation of fish and other aquatic animals under semi-voluntary controlled conditions by completely or partially replacing the ichthyofauna in natural and artificial reservoirs.; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     63) cryopreserved germ cells – samples of germ cells (gametes), embryos and various animal tissues in a state of low-temperature and other forms of conservation, which further enable their use for the purpose of obtaining offspring, isolation of genomes or for other scientific research;

     63-1) rice check – a plot of land for growing rice or other crops, filled with water, which can be used for growing fish; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     63-2) the fishing zone of the Republic of Kazakhstan (hereinafter referred to as the fishing zone) is a ten–nautical–mile wide marine belt measured from the State Border (the outer limit of territorial waters), taking into account the principles and norms of international law, within which the Republic of Kazakhstan has the exclusive right to fish for aquatic biological resources.;

     63-3) Kazakh dog breeds – ancient breeds – Kazakh tazy and Kazakh tobet, corresponding to the approved standard of Kazakh dog breeds;

     63-4) standard of Kazakh dog breeds – description of Kazakh breed dogs according to their external and constitutional characteristics and moral qualities;

     63-5) The Unified Pedigree Book of dogs of Kazakh breeds (hereinafter referred to as the Unified Pedigree Book) is a set of data on dogs of Kazakh breeds with information on origin, pedigree, exterior and constitutional characteristics and other qualities.;

     63-6) certificate of origin of a Kazakh breed dog (hereinafter referred to as the certificate of origin) is a document containing information about its pedigree;

     64) huntsman – a specially authorized person of the huntsman service who protects wildlife on designated hunting grounds and fisheries reservoirs and (or) sites;

65) the certificate of the huntsman – the document of the established form certifying the rights of the huntsman;

     66) the hunting service is a structural subdivision of hunting and fishing enterprises that performs the functions of protecting wildlife on fixed hunting grounds and fisheries reservoirs and (or) sites.;

     67) wintering pit – a place of mass accumulation of fish in winter in the recesses of the bottom of the reservoir;

     67-1) common water area is a part of the water area of the Caspian Sea located beyond the outer limits of fishing zones and used by states located on the coast of the Caspian Sea;

     68) river basin (seas, lakes) – a part of the earth's surface and soil strata bounded by watersheds from which water flows into the river (sea, lake);

     69) recreational fishing zone – a section of a fishing reservoir and (or) a section and an adjacent coastal strip, determined by a local executive body in accordance with the established procedure for amateur (sports) fishing;

     70) easement – the right of limited targeted use of someone else's land and water body, including a fixed fishing reservoir and (or) a plot for the needs of hunting and fishing farms;

     71) stocking of reservoirs is the release of fish planting material and fish into reservoirs and (or) areas in order to create self–reproducing populations, preserve valuable, rare and endangered fish species and (or) obtain marketable products;

     71-1) aquatic biological resources – fish, mollusks, crustaceans, mammals and other species of aquatic animals and plants living in territorial waters, fishing zone and common water area;

     71-2) fish farming with a closed water supply cycle is a type of economic activity associated with the artificial breeding of fish and other aquatic animals using closed water supply cycle technology.; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     72) fisheries reclamation of water bodies is a set of measures aimed at preserving and increasing the fish productivity of reservoirs, improving the living conditions and reproduction of fish resources and other aquatic animals;

     73) sweeping is a complex process carried out by sweeping a certain part of the water area of reservoirs with straining fishing gear (seines) for fishing purposes both in the coastal zone and in open water;

     73-1) pond fish farming is a type of economic activity for the cultivation of fish and other aquatic animals using fishery technological reservoirs.; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     73-2) cage fish farming is a type of economic activity for the cultivation of fish and other aquatic animals in special devices (cages) located in natural and artificial reservoirs and allowing them to be kept in semi–voluntary controlled conditions.; - Excluded by the Law of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated June 12, 2025 No. 194-VIII SAM. 

     73-3) purebred Kazakh breed dog is a Kazakh Tazy or Kazakh Tobet breed dog that meets the approved standard of Kazakh dog breeds and has a certificate of origin containing information about at least three continuous generations of ancestors belonging to the same breed.;

     74) rest zone – an area of special importance for the conservation or restoration of wildlife, determined by the subject of hunting, within which certain types and forms of economic activity are (permanently or temporarily) prohibited or regulated.;

     75) specialized organizations – state institutions for the protection, reproduction and sustainable use of wildlife and republican state enterprises for the protection, reproduction and sustainable use of wildlife, as well as the preservation and reproduction of Kazakh dog breeds;

     76) spawning is the process of fish sweeping out mature eggs and then fertilizing them.;

     77) spawning ground – a place of fish spawning;

     78) tonya (tonevoy area) – a section of a river and other flowing reservoir with a limited water area of the reservoir and an adjacent coastal strip, designed and adapted for the needs of commercial fishing;

     78-1) farm hunting – a hunting farm specializing in the artificial breeding of privately owned animals for hunting purposes;

     79) inter–farm hunting management - defining the boundaries and categories of a hunting farm, calculating its area, determining the state of the animal world and its habitat, animal accounting methods, control routes and animal accounting sites for the projected hunting farm;

     80) excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).      

The Law of the Republic of Kazakhstan dated July 9, 2004 No. 593.

     This Law regulates public relations in the field of protection, reproduction and use of wildlife, as well as the conservation and reproduction of Kazakh dog breeds and is aimed at ensuring conditions for the conservation of wildlife and its biological diversity, sustainable use of wildlife in order to meet environmental, economic, aesthetic and other human needs, taking into account the interests of present and future generations..
