Article 1. The basic concepts used in this Law of the Law on Accreditation in the field of Conformity Assessment

      The following basic concepts are used in this Law:  

      1) accreditation is a procedure for the official recognition by the accreditation body of the applicant's competence to perform work in a specific area of conformity assessment;  

     2) an accreditation certificate is a document issued by an accreditation body certifying the competence of accredited entities to perform work in a specific area of conformity assessment;

      2-1) revocation of the accreditation certificate - the decision of the accreditation body on temporary invalidation of the accreditation certificate or part of the accreditation area of the accreditation entity in case of non-compliance of the accreditation entity with the accreditation criteria for which it was accredited, until the reasons that served as the basis for the revocation of the accreditation certificate are eliminated.;  

      3) an accreditation mark is a designation provided by the accreditation body to the subject of accreditation to inform third parties about the passage of the accreditation procedure.;  

     3-1) The Accreditation Council is a permanent consultative and advisory body established for the strategic development of the accreditation system, ensuring openness and accessibility of information in the field of accreditation.;

     4) the accreditation body is a republican state enterprise that carries out accreditation activities and is a member of international accreditation organizations.;

     4-1) accreditation audit experts are individuals certified in accordance with the procedure determined by the accreditation body.;

      5) the accreditation system is a set of government agencies, individuals and legal entities working in the field of accreditation in the field of conformity assessment within their competence.;  

      6) accreditation criteria - a set of requirements that must be met by the applicant for his/her accreditation and the subject of accreditation;  

      7) updating of accreditation materials - making changes to the documents of the accreditation entity that do not entail the renewal of the accreditation certificate;  

      8) scope of accreditation - officially recognized conformity assessment facilities that are accredited;  

      9) expansion of the scope of accreditation - the process of increasing the list of conformity assessment objects by the subject of accreditation;  

      10) reduction of the scope of accreditation - the process of reducing the list of conformity assessment objects by the subject of accreditation;  

      11) excluded by the Law of the Republic of Kazakhstan dated 29.03.2016 No. 479-V (effective twenty-one calendar days after the date of its first official publication);

      12) register of subjects of accreditation - a unified system of registration of subjects of accreditation;  

     13) the subject of accreditation is a conformity assessment body that has been accredited in accordance with the procedure established by this Law.;

     13-1) monitoring of the activities of an accredited entity – a set of measures to collect, process, analyze and use information and information about the activities of accredited entities for compliance with the accreditation criteria carried out by the accreditation body in accordance with this Law;

     13-2) accreditation scheme – rules and processes related to the accreditation of conformity assessment bodies to which identical requirements apply;

     13-3) assessment is a process carried out by the accreditation body in order to determine the competence of the applicant (subject of accreditation) on the basis of standardization documents and in accordance with the legislation of the Republic of Kazakhstan.;

     13-4) assessment technique is a method used by an accreditation body to conduct an assessment in accordance with standardization documents, including international accreditation organizations of which the accreditation body is a member.;

     14) excluded by the Law of the Republic of Kazakhstan dated 12/30/2020 No. 397-VI (effective six months after the date of its first official publication);  

     14-1) calibration laboratory (center) – a legal entity or a structural subdivision of a legal entity acting on its behalf, performing calibration of measuring instruments;

     15) witness assessment – supervision by an accreditation body of a conformity assessment body that performs conformity assessment activities within its area of accreditation;

     15-1) re-accreditation is another procedure for the official recognition by the accreditation body of the applicant's competence to perform work in a specific area of conformity assessment;

     15-2) excluded by the Law of the Republic of Kazakhstan dated 12/30/2020 No. 397-VI (effective six months after the date of its first official publication);  

      16) legal entities carrying out metrological certification of measurement methods - legal entities accredited to carry out work on metrological certification of measurement methods;  

      17) comparison of the results of verification and calibration of measuring instruments - comparison of research results, metrological characteristics of measuring instruments;  

      18) the applicant is a legal entity that has applied for accreditation.;  

      19) comparative tests - conducting and evaluating test results at the same or similar test facilities by two or more laboratories (centers);  

      20) verification laboratory (center) - a legal entity or a structural subdivision of a legal entity acting on its behalf, performing verification of measuring instruments;  

      21) conformity assessment – direct or indirect determination of compliance with the requirements imposed on the conformity assessment object;  

     21-1) conformity assessment body – a legal entity or its structural subdivision that performs conformity assessment activities;

     22) conformity assessment objects – objects defined by technical regulations and (or) standardization documents that are subject to conformity assessment, research, testing, measurement, verification, calibration, certification and other types of assessment;

      23) conformity assessment bodies - legal entities engaged in conformity assessment of products, processes, services, management systems or personnel;  

     23-1) expert auditors for conformity assessment - individuals certified in accordance with the procedure determined by the authorized body;

      24) testing laboratory (center) - a legal entity or a structural subdivision of a legal entity acting on its behalf, carrying out research, testing;  

      25) technical expert - an individual with special knowledge or experience in relation to an object subject to conformity assessment;  

      26) authorized body - a state body that carries out state regulation in the field of technical regulation and ensuring the uniformity of measurements.  

 

 

The Law of the Republic of Kazakhstan dated July 5, 2008 No. 61-IV.

     This Law regulates public relations in the field of accreditation of conformity assessment bodies, as well as related relations.
