Article 1. The basic concepts used in this Law of the Law on Cinematography

Article 1. The basic concepts used in this Law of the Law on Cinematography

     For the purposes of this Law, the following basic concepts are used:

     1) socially significant films are topical films, including historical ones, aimed at increasing the patriotic, spiritual, moral, intellectual and cultural potential of society, and educating the younger generation.;

     2) a co-production film is a film produced with the participation of foreign individuals and (or) legal entities and citizens of the Republic of Kazakhstan and (or) legal entities of the Republic of Kazakhstan.;

     3) The debut film is the director's first film.;

     4) Voice-over translation is a type of film translation in which the translated speech is superimposed on the original soundtrack of the work.;

     5) cinematography is a branch of culture that unites creative, organizational, production, economic, scientific, and educational activities aimed at the production, use, and storage of films.;

     5-1) subject of cinematographic activity – an individual who is a business entity, whose main activities are: production of films and (or) film recordings, film rental, film screening, film restoration, cinema hall maintenance, production of film materials, performance of works and services for the production of films, educational, scientific, research, publishing, advertising and propaganda activities in the field of cinematography, film storage; cinematographic organization;

     6) a cinematographic organization is a legal entity whose main activities are: production of films and (or) film recordings, film rental, film screening, film restoration, cinema hall maintenance, production of film materials, performance of works and services for the production of films, educational, scientific, research, publishing, advertising and propaganda activities in in the field of cinematography, film storage;

     7) film project - a set (package) of documents and materials (script, director's explication, estimate for the production of the film, production schedule, marketing plan, visual materials), on the basis of which the production and distribution of the film are carried out;

     8) film chronicle - documentary plots reflecting the characteristic features of time, place, circumstances and designed in the future for the production of a film;

      8-1) film series – a multi-part film production;  

      8-2) a film performance is a film adaptation of a theatrical performance performed by means of cinematography and (or) television;  

     8-3) A film festival is an event that shows specially selected films.;

     9) films produced in the Republic of Kazakhstan - films produced by citizens of the Republic of Kazakhstan and (or) legal entities of the Republic of Kazakhstan and the copyright holders of which are also citizens of the Republic of Kazakhstan and (or) legal entities of the Republic of Kazakhstan;

     10) The State Film Fund is a film collection of national films, films produced in the Republic of Kazakhstan, films of joint production and film recordings, including the source materials of national films and film recordings as an integral part of the national cultural heritage;

     11) The State Register of Films is a list of films that are distributed and shown on the territory of the Republic of Kazakhstan.;

     12) event films - films dedicated to anniversaries and commemorations of outstanding personalities, socially significant and significant events;

     12-1) producer – an individual and (or) a legal entity that performs the functions of organizing the financing, production and distribution of a film;

     13) subtitling is the process of adding text accompaniment to a film in the original language or translating, duplicating and (or) supplementing dialogues and actions in scenes.;

     14) authorized body - the central executive body responsible for the management and intersectoral coordination in the field of cinematography;

     15) national film certificate - a document of the established type certifying the right of an individual or legal entity to state support measures provided for by this Law.;

     16) film is an audiovisual work created on the basis of a creative idea, consisting of an image and a soundtrack recorded on a medium and combined into a thematic whole, including a film series, a film performance;

     17) dubbing of a film (dubbing) is a creative and production activity consisting in the simultaneous recreation of the linguistic part of the film's sound sequence in another language by translating it, which corresponds to the syllabic articulation of the characters.;

     18) a film rental certificate (hereinafter referred to as a rental certificate) is a standard document certifying the right of an individual or legal entity to distribute a film on the territory of the Republic of Kazakhstan, which contains technical information about the film, information about the creators, age category and genre of the film.;

     19) film storage - activities aimed at ensuring reliable, long-term storage of films and film recordings and their source materials, preventive processing, restoration and restoration of source materials and copies of films;

     20) source materials of films and film recordings - negative, counter-image, negative image, negative phonogram, reference copy, installation videos, passports and recordings to them, control copy of the film, original magnetic phonograms of re-recording, music, noise, video master, CD and other materials necessary for replicating the film in any form the material form;

     21) film screening - a public demonstration of a film carried out in a cinema hall, on television, radio channels distributed in telecommunications networks, and by other technical means;

     22) film rental - distribution of a film in ways not prohibited by the laws of the Republic of Kazakhstan for the purpose of its screening;

     23) registration of a film is the entry of information about a film intended for distribution in the territory of the Republic of Kazakhstan into the State Register of Films.;

     24) film replication - the production of one or more copies of a film (print run) in any material form;

     25) film production is the process of realizing the creative idea of the author, as a result of which the film is created;

     25-1) scenic and staging means of national films – a set of objects of material design formed and used in the production of national films;

     26) limited rental is a one-time screening of films in cinemas, the number of which does not exceed ten percent of the total number of cinemas operating in the territory of the Republic of Kazakhstan.

 

 

     This Law regulates public relations and defines the legal, economic and organizational foundations of the field of cinematography.
