Article 1. The basic concepts used in this Law of the Law on Flora

     The following basic concepts are used in this Law:

     1) a botanical collection is a systematic, documented collection of plants and (or) their parts, having scientific, educational, cultural, historical, aesthetic and other value.;

     2) genetic erosion is the loss of genetic diversity caused by anthropogenic activities, including the irrational use and improper conservation of plant genetic resources.;

     3) cultivated plants – plants specially grown for food, fodder, technical and other needs;

     4) wild relatives of cultivated plants – wild plants that are genetically close to cultivated plants, suitable for their introduction into culture or use in breeding;

     5) wild plants – plant species that grow and spread in their natural environment;

     6) green spaces – plantings of woody, shrubby and herbaceous plants that perform protective, sanitary, hygienic, social, aesthetic and other functions in the territories of settlements;

     7) plants – vascular, moss-like plants, algae, as well as lichens and fungi;

     8) flora – a set of plant species, their populations and communities growing in natural conditions, as well as artificially planted in a certain area;

     9) protection of flora – a set of measures for the conservation of flora, prevention and control of fires, illegal use of flora and other violations of the legislation of the Republic of Kazakhstan;

     10) the authorized body in the field of protection, protection, restoration and use of flora (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of protection, protection, restoration and use of flora;

     11) restoration of the flora – a set of measures to stabilize and (or) recreate the quantitative and qualitative characteristics of populations, communities of wild plants;

     12) protection of flora – a set of measures to protect flora from pests, diseases and the effects of adverse factors of a natural and anthropogenic nature;

     13) the use of the plant world is a legally regulated activity for the use of plant resources;

     14) the user of the flora is a natural or legal person who, in accordance with this Law and other laws of the Republic of Kazakhstan, has been granted the right to use the flora.;

     15) a plant community is a stable set of plants characterized by a certain species composition, structure, and relationships of plants with each other and with environmental factors;

     16) a place of plant growth is a land plot or a water body with natural conditions for the growth and development of a plant species.;

     17) a plant population is a collection of individuals of one plant species with a common gene pool and occupying a certain territory.;

     18) plant resources – plants, their parts and derivatives that are used or can be used for various needs;

      19) plant hybridization is the process of forming or obtaining hybrids based on combining the genetic material of cells of different plant species;  

     20) acclimatization of plants is the adaptation of plants to new or changed growing conditions in which they go through all stages of development and produce viable offspring.;

     21) plant introduction is the deliberate or accidental transfer of plant species outside their natural habitats and habitats.;

     22) plant reintroduction is the transfer of a certain plant species to their former places of natural growth and habitat.;

     23) an alien plant species is a plant species that is unusual for a given territory, which, if it enters natural plant communities, can harm the plant world.;

     24) plant genetic bank – a specially equipped repository for the maintenance of samples of plant genetic material;

     25) plant genetic material – material of plant origin, including reproductive and vegetatively propagated, containing functional units of heredity;

     26) plant genetic resources – plant genetic material of actual or potential value;

     27) collection of plant genetic resources – a systematic, documented collection of samples of plant genetic material preserved under controlled conditions;

     28) relict plants – plant species preserved from extinct, previously widespread flora;

     29) resource survey – a complex of scientific and survey work in a certain territory to study the raw material reserves of certain plant species and their communities and determine the possible volumes of their withdrawal;

     30) flora is a historically formed set of plant species distributed in a certain territory;

     31) endemic plants are plant species that are limited in their distribution and not found in other territories.

 

The Law of the Republic of Kazakhstan dated January 2, 2023 No. 183-VII SAM.

     This Law regulates public relations and establishes the legal basis of state policy in the field of protection, restoration, and use of flora.
