Article 1. The basic concepts used in this Law of the Law on Gas and Gas Supply
The following basic concepts are used in this Law:
1) a gas filling station is a technological complex and equipment that provides storage and retail sale of liquefied petroleum gas to owners of motor vehicles using it as fuel.
Gas filling stations are divided into the following types:
stationary – a gas filling station with underground or above-ground storage tanks for liquefied petroleum gas, designed for refueling motor vehicles through gas dispensers;
modular (monoblock) is a gas filling station with ground–based storage of liquefied petroleum gas, the technological system of which is characterized by the placement of gas dispensers on a platform with storage tanks for liquefied petroleum gas, made as a single factory product.;
2) a gas filling compressor station is a technological complex designed for the compression, storage and retail sale of commercial gas to vehicle owners who use it as fuel;
3) excluded by the Law of the Republic of Kazakhstan dated 04.07.2018 No. 173-VI (effective from 01.01.2022).
4) retail sale – business activity for the sale of commercial and (or) liquefied petroleum gas to consumers in the territory of the Republic of Kazakhstan for their own needs without the purpose of further sale;
5) a single technical corridor is a set of main gas pipelines (or sections) and systems of main gas pipelines (including those with different pressures) that ensure the transportation of commercial gas in a single direction (traffic flow), laid in parallel along one highway;
6) gas – crude, commercial, liquefied petroleum and liquefied natural gas;
7) gas supply – activities in the field of production, transportation (transportation), storage and sale of commercial, liquefied petroleum and (or) liquefied natural gas;
8) the security zone of gas supply system facilities is an area with special conditions of use, which is established around gas supply system facilities in order to ensure safe operating conditions and exclude the possibility of their damage.;
9) gas supply system – a complex of technologically interconnected facilities designed for the production, transportation (transportation), storage, sale and consumption of commercial or liquefied petroleum gas;
10) gasification – a set of measures aimed at using commercial and (or) liquefied petroleum gas as fuel at housing and communal services, industrial, agricultural and other facilities;
11) gas equipment – technical products of full factory readiness used as components of gas pipelines (expansion joints, condensate collectors, safety valves, shut-off valves), as well as gas-using installations (gas appliances, furnaces and stoves);
12) partnership in the field of gas and gas supply is a form of interaction between the state and the investor to solve strategic and social tasks to ensure deep processing of associated gas owned by the Republic of Kazakhstan and the production of high–value-added products on mutually beneficial terms;
13) Excluded by the Law of the Republic of Kazakhstan dated 12/30/2021 No. 96-VII (effective sixty calendar days after the date of its first official publication).
14) gas pipeline – a structure consisting of interconnected pipes with shut-off valves and designed to transport gas in a gaseous or two-phase state;
15) gas distribution system – a complex of technologically interconnected structures consisting of gas pipelines (linear part) and associated facilities designed to transport commercial gas from the main gas pipeline to gas-consuming systems;
16) gas distribution organization – a legal entity engaged in the transportation of commercial gas through a gas distribution system, the technical operation of a gas distribution system, as well as the wholesale and retail sale of commercial gas under the conditions established by this Law;
17) a gas transportation organization is a legal entity that provides services for the transportation of commercial gas through connecting, main gas pipelines and (or) storage of commercial gas in commercial gas storages under the conditions established by this Law.;
18) gas filling station – an engineering facility designed for storing, draining and filling liquefied petroleum gas into household cylinders, as well as repairing and disposing of household cylinders;
19) gas filling station – a complex of technologically interconnected production and other facilities designed for storage, discharge and filling of liquefied petroleum gas into railway tanks, gas trucks, household cylinders, as well as repair and disposal of household cylinders;
20) gas–consuming system - a complex of gas pipelines (linear part) and gas equipment designed to receive commercial gas from a gas distribution system or liquefied petroleum gas from a group tank installation, as well as their use as fuel and (or) raw materials;
21) metering devices – measuring instruments and other technical means that perform the following functions: measurement, accumulation, storage, display of information about the flow rate, volume, temperature, gas pressure and operating time of the devices;
22) connecting gas pipeline – a gas pipeline designed to transport crude gas from the contract territory to a gas processing plant or an industrial consumer of crude gas, or to transport commercial gas from a gas processing plant to a main gas pipeline;
23) field gas pipeline – a gas pipeline designed to transport gas within the contract territory;
24) utility consumer - a natural or legal person who purchases commercial and (or) liquefied petroleum gas for municipal needs (cooking, hot water supply, heating) while carrying out entrepreneurial, non–commercial or other activities without the purpose of its further sale;
At the same time, the accounting limit for the consumption of commercial gas for utility consumers purchasing commercial gas should not exceed sixty-five cubic meters per hour.;
25) excluded by the Law of the Republic of Kazakhstan dated December 30, 2019 No. 297-VI (effective ten calendar days after the date of its first official publication);
26) wholesale sale – business activity for the sale of commercial, liquefied petroleum and (or) liquefied natural gas on the domestic market for the purpose of further sale or outside the territory of the Republic of Kazakhstan, as well as in cases of sale of gas to a gas distribution organization for regulatory technical losses;
27) internal needs of the Republic of Kazakhstan – volumes of commercial and (or) liquefied petroleum gas required for consumption in the territory of the Republic of Kazakhstan;
28) main gas pipeline – an engineering structure consisting of one or more gas pipelines (linear part) and related facilities that increase and decrease the pressure of the transported gas, remote control, communications and other communications, intended for the transportation of commercial gas. The composition of the main gas pipeline facilities is determined by the design documentation and the requirements of the technical regulations;
28-1) petrochemical products – products obtained from hydrocarbon raw materials through chemical processes and used as finished products (with the exception of petroleum products) or raw materials for subsequent chemical transformations;
29) producer – a legal entity engaged in the production of commercial, liquefied petroleum and (or) liquefied natural gas;
29-1) production passport – a document of the established form containing indicators of the manufacturer's production capacity, its main characteristics, regulating the use of existing equipment to comply with the production process;
30) industrial consumer – an individual entrepreneur or a legal entity that purchases gas for use as fuel and (or) raw materials in agricultural production;
Industrial consumers also include utility consumers who purchase commercial gas, whose gas consumption limit exceeds sixty-five cubic meters per hour.;
30-1) industrial consumer-investor is a legal entity that purchases commercial gas for use as fuel and (or) raw materials in industrial production in order to implement investment projects for the production of petrochemical products and included in the list approved by the authorized body, as well as a legal entity that purchases commercial gas for the production of compressed and (or) liquefied natural gas for further sale to consumers;
31) liquefied petroleum gas is a mixture of light hydrocarbons (propane–butane fraction, propane, butane) converted to a liquid state for transportation and storage, meeting the requirements of technical regulations and national standards in terms of qualitative and quantitative content of components.;
31-1) a production facility of a liquefied petroleum gas producer is a complex of buildings and structures, including technological equipment, a tank farm, overpasses for automobile and railway (if any) filling of liquefied petroleum gas, technical devices and communications designed for receiving hydrocarbon raw materials, production, storage, discharge, filling, pumping, transportation, shipment and the sale of liquefied petroleum gas that meets the requirements of the legislation of the Republic of Kazakhstan in the field of technical regulation;
34-1) production of commercial, liquefied petroleum and (or) liquefied natural gas – a complex of operations for processing hydrocarbon raw materials and (or) products of its processing, ensuring the production of commercial, liquefied petroleum and (or) liquefied natural gas in accordance with the production certificate;
32) liquefied natural gas is a multicomponent mixture of hydrocarbons with a predominant methane content, converted to a liquid state for transportation and storage, which is a product of crude gas processing and meets the requirements of technical regulations and national standards in terms of qualitative and quantitative content of components.;
33) transportation is the technological process of pumping raw or commercial gas through gas pipelines;
34) commercial gas is a multicomponent mixture of hydrocarbons with a predominant methane content, which is in a gaseous state, is a product of crude gas processing and meets the requirements of technical regulations and national standards in terms of qualitative and quantitative content of components.;
35) commercial gas storage – a complex of technologically interconnected production and other facilities intended for storage of commercial gas;
36) group tank installation – an engineering structure consisting of a group of tanks, safety, shut-off and control valves, gas pipelines and intended for storage and supply of liquefied petroleum gas to gas-consuming systems;
36-1) household cylinder accounting system – a set of technical devices and software designed for automated collection, processing, storage and transmission of information on the turnover of household cylinders and volumes of liquefied petroleum gas sold in household cylinders;
37) household consumer – an individual who purchases commercial and (or) liquefied petroleum gas for household needs without the purpose of using it in business activities and their further sale;
38) consumption rate is an estimated value for household consumers, reflecting the average monthly amount of commercial or liquefied petroleum gas consumed by them.;
39) consumer – household, utility, industrial consumer, industrial consumer-investor or consumer included in the list of power plants, large commercial consumer, digital miner;
40) authorized body – the central executive body responsible for state regulation of production, transportation (transportation), storage and wholesale sale of gas, as well as retail sale and consumption of commercial and liquefied petroleum gas;
40-1) the digital system of the authorized body is an integrated digital system "Unified State System of management of subsoil use of the Republic of Kazakhstan", designed to collect, store, analyze and process information in the field of subsoil use;
41) national operator is a legal entity owned by the state or a national managing holding, a national company or a company belonging to the National Welfare Fund group, designated by the Government of the Republic of Kazakhstan and operating in the field of gas and gas supply in order to meet the domestic needs of the Republic of Kazakhstan in commercial gas.;
42) crude gas – any hydrocarbons, regardless of their specific gravity, extracted from the subsurface in a gaseous state at normal atmospheric temperature and pressure, including crude natural, associated, shale gas, coalbed methane, as well as non-hydrocarbon gases contained in them.;
42-1) a large commercial consumer is a legal entity, with the exception of an industrial consumer, an investor, and a consumer included in the list of power plants, who purchases commercial gas for use in their activities that meets the criteria set out in paragraph 4-1 of Article 8 of this Law.;

44) a consumer included in the list of power plants is a legal entity included in the list of power plants in accordance with the Law of the Republic of Kazakhstan "On Electric Power Industry", which uses or will use commercial gas as fuel for the production of electric energy.

This Law defines the legal, economic and organizational bases for regulating public relations in the field of gas and gas supply in the Republic of Kazakhstan and is aimed at creating conditions for meeting the domestic gas needs of the Republic of Kazakhstan, as well as for efficient, reliable and safe operation of gas supply facilities.
