Article 1. The basic concepts used in this Law of the Law on Mail
The following basic concepts are used in this Law:
1) subscription box – a special box for receiving certain types of mail, installed at the production facilities of postal operators for use by addressees;
2) subscriber mailbox – a special cabinet with cells installed in buildings, residential buildings (residential buildings), individual residential buildings, for receiving mail by addressees;
3) addressee (recipient) – a user of the mail operator's services to whom a postal item or postal money transfer is addressed;
3-1) special postal service is a type of courier postal service carried out by a structural subdivision of the National Postal Operator and providing reception, processing, protection, transportation and delivery (delivery) of postal, special and other items containing any legally protected secret and valuables, including precious metals, precious stones and articles made from them;
4) nominal device – a device for applying prints to documents and mailings indicating the name of the mail operator, its production facility, as well as other information determined by the mail operator;
5) parcel is an unregistered and registered postal item with printed publications, business papers, documents and other items, the dimensions, weight and packaging method of which are provided in accordance with the rules for the provision of postal services.;
6) hybrid dispatch – an e-mail (message) accepted by the mail operator for forwarding and delivered to the addressee in the form of a letter (postcard), or a letter (postcard) accepted by the mail operator for forwarding and delivered to the addressee in the form of an e-mail (message) to an e-mail or an electronic subscriber mailbox;
7) hybrid shipment service – the activity of a mail operator for receiving, processing, delivering and (or) delivering a hybrid shipment;
8) The Universal Postal Union is an international organization consisting of member countries whose territories form a single postal territory for the mutual exchange of international postal items, whose goals are to ensure the organization and improvement of postal relations and create favorable conditions in this area for the development of international cooperation.;
9) acts of the Universal Postal Union – documents adopted at the Congress of the Universal Postal Union in accordance with its Charter;
10) written correspondence – unregistered and registered letters, postcards, parcels and small packages;
11) subscription distribution of periodicals – provision by the postal operator, on the basis of a contract concluded with the owner of the mass media or his representative, of services for accepting subscriptions to periodicals, including through the use of an Internet resource, and for receiving, processing, transporting and delivering periodicals to the user of the postal operator's services;
12) international commercial correspondence with a reply is a postal item issued in accordance with the acts of the Universal Postal Union, containing a return postal item pre–paid by the sender.;
13) expedited postal services – services for forwarding mail items with accelerated processing, transportation, delivery and (or) delivery of mail items;
14) sender is a user of the mail operator's services who transfers mail or money to the mail operator for forwarding;
15) parcel – a registered postal item with things, objects and goods, the dimensions, weight and packaging of which are provided in accordance with the rules for the provision of postal services.;
16) courier – an employee of the postal operator or an individual who has a contract with the postal operator, who accepts the registered mail from the sender outside the production facility and delivers the mail to the specified address on the postal item.;
17) courier postal services – services for the reception, transportation and delivery of registered mail items provided by the courier;
17-1) a postal item with declared value is a postal item (except for a postcard), upon submission of which the sender announces its value by submitting supporting documents in accordance with the procedure determined by the authorized body in the field of mail.;
18) business day – the working time during which the mail operator provides postal services;
19) production facility – a building, a room in a building designed and equipped for carrying out activities in the field of mail by a mail operator;
20) mail is a type of communication that ensures the provision of a range of services and other activities by postal operators in the territory of the Republic of Kazakhstan in accordance with the acts of the Universal Postal Union and this Law;
21) universal postal services – services that are part of universal communication services that are provided to any user of the postal operator's services in any locality within a specified period of time with established quality and price levels that ensure the availability of these services;
22) postal communication services – the activities of postal operators for the forwarding of registered and unregistered mail, postal money transfers, hybrid shipments, the distribution of periodicals, the sale of postage stamps and philatelic products;
23) postal communication facilities – technical facilities, equipment and technologies used to provide postal communication services;
24) excluded by the Law of the Republic of Kazakhstan dated 02/10/2025 No. 164-VIII (effective ten calendar days after the date of its first official publication).
25) postal network – a set of production facilities and postal routes used in the provision of postal services by a mail operator;
26) postal items – written correspondence, parcels accepted for forwarding by the mail operator;
27) delivery of a postal item – transfer of a postal item from the production facilities of the destination to a subscription box or a subscription mailbox, or to another address specified by the sender;
28) forwarding of a postal item – a set of operations of receiving, processing, transportation and (or) transfer, delivery and (or) delivery of a postal item;
29) acceptance of a postal item – registration by the mail operator for further transportation of a postal item received from the sender;
30) postal item processing – production operations with postal items, ensuring their preparation for transportation;
31) delivery of a postal item – delivery of a postal item personally to the addressee or his legal representative, or to an attorney acting on the basis of a power of attorney, or to third parties by obtaining the addressee's consent through the process of confirming the right by entering a password (pin) or scanning a barcode;
32) transportation of a postal item – movement (transportation) of a postal item from the point of departure to the production facilities of the destination for delivery and (or) delivery of the postal item;
33) postal code is a conditional numeric and letter designation of an address assigned to real estate objects for their administrative–territorial identification and systematization in order to speed up the shipment of mail or postal money transfer;
34) postal card – unregistered or registered mail with a written message on a special standard letterhead;
35) postal activity – provision of postal communication services through postal networks;
36) subjects of postal activity – mail operators and users of mail operator services;
37) mail operator – an individual or legal entity registered in the territory of the Republic of Kazakhstan, providing services in the field of postal activities;
38) the user of the mail operator's services is an individual or legal entity who is a consumer of the services provided by the mail operator, including on the basis of contracts concluded with the mail operator.;
39) the authorized body in the field of mail (hereinafter referred to as the authorized body) is the central executive body of the Republic of Kazakhstan, which carries out, within its competence, the implementation of state policy, state control, coordination and regulation of activities in the field of mail in the territory of the Republic of Kazakhstan.;
40) postal payment signs – signs confirming payment for postal services applied by the mail operator to shipments of written correspondence, including postage stamps, blocks, marked envelopes and (or) postcards, franking machine prints, electronic and other signs;
41) state postage stamps – postage stamps, blocks, marked envelopes and (or) postcards, stamps of franking machines, electronic and other signs put into circulation by an authorized body that confirm payment for the services of the National Postal Operator;
42) a postmark is a device for applying impressions to documents and mailings indicating the name of the production facility that received the mail, the place of departure, the date and time of receipt of the mail, the name of the production facility that received the mail, the destination, the date and time of receipt, the name of the production facility that delivered and (or) who delivered the mail, the date and time of delivery and (or) delivery;
43) postal money transfer is a postal communication service for the mail operator to fulfill the sender's instructions to forward money to the addressee in accordance with this Law and the acts of the Universal Postal Union.;
44) postal secrecy – information about the postal address, personal data of users of the mail operator's services, postal items, their internal contents and location;
45) postal address (hereinafter referred to as address) is a place designated by the user of the mail operator's services for the delivery and (or) delivery of mail and postal money transfers;
46) a postal machine is an automated device designed for receiving, sending, storing, delivering (handing over) and receiving mail, with the exception of postal money transfer;
47) postman – an employee who is in an employment relationship with a postal operator who accepts mail from the sender, as well as delivers and/or delivers the mail.;
48) identification is a procedure for comparing submitted information with information about an individual, necessary for the provision of services.;
49) designated operator – a mail operator appointed by an authorized body to ensure the provision of postal services and the fulfillment of related obligations arising from acts of the Universal Postal Union throughout the territory of the Republic of Kazakhstan;
50) tariff – the amount of payment for the services of the mail operator;
51) registered postal item – written correspondence, parcel, accepted with the issuance of a supporting document to the sender on paper or in electronic form with the assignment of a postal registration number (identification alphanumeric barcode) to the postal item and delivered against signature or otherwise using automated (electronic) devices, equipment, information systems, confirming such delivery;
52) unregistered postal item – written correspondence received through production facilities without issuing a receipt to the senders (without assigning a postal registration number, an alphanumeric barcode identification number) and delivered without receiving a receipt;
53) national postal network – the postal network of the National Postal Operator operating throughout the territory of the Republic of Kazakhstan, through which the services of the postal operator are provided to users;
54) National mail operator is a mail operator designated by the authorized body in the field of mail, established in the organizational and legal form of a joint–stock company, which is responsible for the obligations provided for by this Law.;
55) cash on delivery mail – a postal item, upon submission of which the sender instructs the mail operator to receive from the addressee the amount of money set by him (the amount of cash on delivery) and send it to the sender's address;
56) philatelic products – state postage stamps, which are objects of collectibles, removed from postal circulation in accordance with the rules for the release and sale of state postage stamps and philatelic products;
57) franking machine – a device designed to apply to written correspondence prints confirming payment for postal services, the date of receipt of written correspondence and other information;
58) international return coupon is a document put into circulation by the Universal Postal Union, which can be exchanged in any member country of the Universal Postal Union for postage stamps, representing the minimum fee for a simple international letter weighing up to twenty grams, sent by air;
59) the place of international postal exchange is a production facility where incoming and outgoing international mail items are processed, as well as customs control of these items is carried out by state revenue authorities.;
60) international postal item – postal item accepted for shipment outside the territory of the Republic of Kazakhstan, entering the territory of the Republic of Kazakhstan or following transit through the territory of the Republic of Kazakhstan;
61) letter is an unregistered and registered postal item sent with a written message and other small items, the dimensions, weight and packaging of which are provided in accordance with the rules for the provision of postal services.;
62) internal postal item – postal item accepted for shipment within the territory of the Republic of Kazakhstan;
63) electronic subscriber mailbox – the domain name of the user of the mail operator's services, which is an e-mail address and is created in the information system of the mail operator, the National Mail Operator for the transmission of e-mails (messages), documents, information and (or) hybrid shipments and their storage;
64) e–mail (message) - information sent in electronic form using a telecommunications network, the Internet or electronic media.

This Law establishes the legal basis of activity and regulates public relations in the field of mail in the territory of the Republic of Kazakhstan, defines the rights and obligations of subjects of postal activity, the competence of state bodies in the field of mail.
