Article 1. The basic concepts used in this Law of the Law on Public Control

Article 1. The basic concepts used in this Law of the Law on Public Control

     The following basic concepts are used in this Law:

     1) public control is the activity of subjects of public control carried out in the manner and forms established by this Law and other laws of the Republic of Kazakhstan, aimed at analyzing and evaluating acts and decisions of objects of public control for compliance with public interests.;

     2) conflict of interests in the exercise of public control is a situation in which the personal interest of subjects of public control, an expert, a member (participant), a founder, a supervisor, an employee of subjects of public control affects or may affect the impartial and objective performance of their duties and (or) entails a contradiction between such interest and the principles of public control. established by this Law;

     3) final document based on the results of public control (hereinafter referred to as the final document) – protocol, conclusion, recommendation, other documents provided for by the laws of the Republic of Kazakhstan, developed by subjects of public control based on the results of public control;

     4) objects of public control – bodies, institutions of executive state power and local government, state institutions that are not state bodies, quasi-public sector entities, autonomous educational organizations, organizations that perform the functions of central and (or) local executive bodies whose activities are related to public interests, as well as other objects of public control provided for by the laws of the Republic of Kazakhstan.

     Public authorities and organizations classified as special regime facilities of the Republic of Kazakhstan are not objects of public control.;

     5) subjects of public control – citizens of the Republic of Kazakhstan;

 

     non–profit organizations registered in the territory of the Republic of Kazakhstan, with the exception of religious associations (hereinafter referred to as non-profit organizations);

     other entities authorized to exercise public control in accordance with the laws of the Republic of Kazakhstan;

      6) public control group – a group of citizens of the Republic of Kazakhstan and (or) representatives of non-profit organizations that are citizens of the Republic of Kazakhstan and (or) other entities that are authorized to exercise public control in accordance with the laws of the Republic of Kazakhstan, formed to exercise public control;  

     7) motivated response – information from the subject of public control on a comprehensive, complete and objective review of the circumstances specified in the final document based on the results of public control, including the elimination of the causes and conditions contributing to violations identified during public control.

 

     This Law defines the purpose, objectives and principles of public control, as well as regulates public relations related to the organization and implementation of public control in the Republic of Kazakhstan.
