Article 1. The basic concepts used in this Law of the Law on Public Services

     The following basic concepts are used in this Law:

     1) The State Corporation "Government for Citizens" (hereinafter referred to as the State Corporation) is a legal entity established by decision of the Government of the Republic of Kazakhstan to provide public services in accordance with the legislation of the Republic of Kazakhstan, organize work on accepting applications for public services and issuing their results to the service recipient on the "one–stop shop" basis, and ensure the provision of public services. services in electronic form;

     1-1) authorized body in the field of informatization – the central executive body responsible for the management and inter-sectoral coordination in the field of informatization and e-government;

     1-2) partnership agreement – an agreement concluded by a State Corporation with business entities that meet the requirements and have been selected by an authorized body in the field of public services to provide services for accepting applications for public services and issuing their results to the recipient;

     1-3) a partner organization is a business entity that has concluded a partnership agreement in accordance with this Law.;

     1-4) the "one application" principle is a form of public service provision that provides for a combination of several public services provided on the basis of a single application.;

     2) the "one window" principle is a form of centralized provision of public services that provides for minimal participation of the recipient in the collection and preparation of documents for the provision of public services and limits his direct contact with service providers.;

     2-1) a hidden public service is a public function that meets the criteria of a public service, but is not included in the register of public services.;

     3) service recipient – individuals and legal entities, with the exception of central government agencies, foreign institutions of the Republic of Kazakhstan, local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance, akims of districts in the city, cities of regional significance, towns, villages, rural districts;

     4) service provider – central government agencies, foreign institutions of the Republic of Kazakhstan, local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance, akims of districts in the city, cities of regional significance, towns, villages, rural districts, as well as individuals and legal entities providing public services in accordance with the legislation of the Republic Kazakhstan;

     4-1) socially significant service is a public service provided on a continuous basis and aimed at satisfying the legitimate interests of society.;

     4-2) a mobile application of a State Corporation is an object of informatization for the provision of public services through video communication with a State Corporation;

     5) a public service is one of the forms of realization of individual state functions or their totality, carried out with or without the request of service recipients and aimed at realizing their rights, freedoms and legitimate interests, providing them with appropriate tangible or intangible benefits.;

     5-1) additional service to a public service is a service provided individually at the request of the recipient in addition to the public service.;

5-2) measure of state support for individuals – public services or other forms of state support aimed at improving the well-being of individuals, with the exception of individual entrepreneurs and individuals engaged in private practice, legal consultants, in accordance with the legislation of the Republic of Kazakhstan;

     6) excluded by the Law of the Republic of Kazakhstan dated 25.11.2019 No. 272-VI (effective ten calendar days after the date of its first official publication);      

7) excluded by the Law of the Republic of Kazakhstan dated 07/14/2022 No. 141-VII (effective ten calendar days after the date of its first official publication);  

     8) the register of public services is a classified list of public services;

     9) A single contact center is a legal entity designated by the authorized body in the field of public services, performing the functions of an information and reference service for providing information to service recipients on the provision of public and other services, as well as information to government agencies on the provision of information and communication services.;

     10) information system for monitoring the provision of public services – an information system designed to automate and monitor the process of providing public services, including those provided through the Government for Citizens State Corporation;

     10-1) a pilot project in the field of public services provision is a process for testing changes in processes and approaches in the provision of public services;

     11) public monitoring of the quality of public services – the activities of individuals and non-profit organizations to collect and analyze information on the quality of public services and develop recommendations;

     12) assessment of the quality of public services – activities aimed at determining the effectiveness of measures to provide service recipients with affordable and high-quality public services provided by central government agencies, local executive bodies of regions, cities of republican significance, the capital, districts, cities of regional significance, akims of districts in the city, cities of regional significance, towns, villages, rural districts;

     13) excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).  

     14) the authorized body for the assessment and control of the quality of public services is a central government body that carries out, within its competence, activities for the assessment and control of the quality of public services.;

     15) automation of the public service provision process is a procedure for transforming the administrative processes of a service provider to ensure the provision of public services in electronic form;

     16) excluded by the Law of the Republic of Kazakhstan dated 07/14/2022 No. 141-VII (effective ten calendar days after the date of its first official publication);  

     17) authorized body in the field of public services provision – the central government body responsible for the management and inter-sectoral coordination in the field of public services provision;

     17-1) proactive service – a public service provided without the application of the service recipient on the initiative of the service provider;

     17-2) reengineering – transformation of the current workflow in order to improve the efficiency, quality and effectiveness of the organization;

     17-3) a stationary subscriber device is a means of communication that provides transmission or reception at a distance of information specified by the subscriber using electrical signals transmitted by wire or radio signals;

     17-4) cellular subscriber device is a means of communication for individual use that generates electrical communication signals for transmitting or receiving information specified by the subscriber and is connected to the network of a cellular operator that does not have a permanent geographically defined location within the serviced territory, operating in cellular networks;

     18) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);  

     19) the e-government web portal is an information system that provides a single window of access to all consolidated government information, including the regulatory legal framework, and to government services, services for issuing technical specifications for connection to the networks of natural monopoly entities and services of quasi-public sector entities provided in electronic form.

 

 

The Law of the Republic of Kazakhstan dated April 15, 2013 No. 88-V.

     This Law regulates public relations in the provision of public services.
