Article 1. The basic concepts used in this Law of the Law on Science and Technology Policy

Article 1. The basic concepts used in this Law of the Law on Science and Technology Policy

     The following basic concepts are used in this Law:

     1) accreditation is a procedure for the official recognition by an authorized body of the compliance of subjects of scientific and (or) scientific and technical activities with the requirements established by the legislation of the Republic of Kazakhstan;

     2) scientist – an individual who carries out scientific research and receives the results of scientific and (or) scientific and technical activities;

     3) science is a sphere of human activity, the functions of which are the study of the laws of nature, society and thinking, the development and theoretical systematization of objective knowledge about reality for the rational use of natural resources and effective management of society.;

 4-1) scientific ethics is a set of principles, rules and norms of ethics, which are adhered to by subjects of scientific and (or) scientific and technical activities;

4-2) the classifier of scientific directions is a document that establishes the classification and coding of scientific directions.;

     5) classifier of scientific directions – a document that establishes the classification and coding of scientific directions;

     6) scientific and educational consortium is a temporary voluntary equal association based on an agreement on joint economic activities in the field of science, scientific and technical activities, in which scientific organizations, organizations of higher and (or) postgraduate education and other legal entities, including those engaged in the field of production, combine intellectual, financial and other resources for conducting fundamental and applied scientific research, developing technological innovations and training highly qualified specialists;

     7) scientific, scientific and technical project and program – a document that includes the content of the proposed scientific and technical work, representing scientific, scientific and technical, development, marketing research with justification of the purpose and objectives, relevance, novelty, scientific and practical significance and expediency of the planned work;

     8) implementation (use) of the results of scientific and (or) scientific and technical activities – activities aimed at the implementation of the final stage of the scientific and production cycle of the development of new products or new technology;

     9) commercialization of the results of scientific and (or) scientific and technical activities - activities related to the practical application of the results of scientific and (or) scientific and technical activities, including the results of intellectual activity, in order to bring new or improved goods, processes and services to the market, aimed at generating income;

    10) grant for the commercialization of the results of scientific and (or) scientific and technical activities - funds provided free of charge and irrevocably, except in cases provided for by the legislation of the Republic of Kazakhstan, for the implementation of projects for the commercialization of the results of scientific and (or) scientific and technical activities within the priority sectors of the economy;

     11) center (office) for the commercialization of the results of scientific and (or) scientific and technical activities - a legal entity, a structural or separate subdivision of a scientific organization, organizations of higher and (or) postgraduate education, autonomous or other educational organizations that commercialize the results of scientific and (or) scientific and technical activities;

     12) the result of intellectual activity in the field of commercialization of the results of scientific and (or) scientific and technical activities (hereinafter referred to as the result of intellectual activity) - inventions, utility models, industrial designs, breeding achievements, integrated circuit topologies, software and other intellectual activity results obtained as a result of scientific and (or) scientific and technical or other activities;

     13) report on the commercialization of the results of scientific and (or) scientific and technical activities - a document containing information on the results and effectiveness of the project of commercialization of the results of scientific and (or) scientific and technical activities;

     14) the result of scientific and (or) scientific and technical activities is new knowledge or solutions obtained by appropriate scientific methods and means in the course of scientific and (or) scientific and technical activities and recorded on any information medium, as well as scientific developments and technologies introduced into production, models, layouts, samples of new products, materials and substances;

     15) state policy in the field of scientific and (or) scientific and technical activities is an integral part of socio-economic policy that defines the main priorities, goals, directions, principles and procedures for the activities of scientists and organizations in the field of science and technology, commercialization of scientific and technical achievements, and stimulation of the creation of new technologies;

     16) report on scientific and (or) scientific and technical activities - a document containing information on the implementation of scientific and technical work, scientific, scientific and technical, development, marketing research, as well as information on the expediency of further planned work or the result of completed scientific, scientific and technical projects and programs;

     17) scientific research – work related to scientific research, conducting research, experiments in order to expand existing and obtain new knowledge, test scientific hypotheses, establish patterns of development of nature and society, scientific generalization, scientific justification of projects;

     18) scientific research – applied, fundamental, strategic scientific research carried out by subjects of scientific and (or) scientific and technical activities within the framework of research, development and technological work using appropriate scientific methods and means in order to achieve the results of scientific and (or) scientific and technical activities;

18-1) research grant – funds provided free of charge and irrevocably, except in cases provided for by applicable law, for the implementation of scientific, scientific and technical projects within the framework of scientific and (or) scientific and technical activities;

     19) scientific infrastructure – scientific laboratory and engineering equipment, pilot production, unique facilities, as well as other movable and immovable property intended for scientific and (or) scientific and technical activities;

     20) scientific activity – activity aimed at studying the surrounding reality in order to identify the properties, features and patterns inherent in the studied objects, phenomena (processes), and the use of acquired knowledge in practice;

     21) researcher – an individual who works in a scientific organization, an organization of higher and (or) postgraduate education, or a scientific unit of an organization, who has a higher education, receives and implements the result of scientific and (or) scientific and technical activities.;

     22) scientific internship – internship of scientists in leading foreign and (or) domestic organizations of higher and (or) postgraduate education, research centers and other organizations in order to develop professional competencies in a chosen field of scientific research, with the exception of internships within the framework of the Bolashak international scholarship;

     23) scientific and technical information – information obtained in the course of scientific and (or) scientific, technical and industrial activities, containing information on national and foreign research results and achievements of science, technology, technology;

23-2) state order of a local executive body of a region, a city of republican significance and the capital – an order of a local executive body of a region, a city of republican significance and the capital to a subject of scientific and (or) scientific and technical activity on the basis of a contract for the performance of scientific research funded from the state budget in the form of grant financing;

     24) scientific and technical activities – activities aimed at obtaining and applying new knowledge in the fields of science, technology and production to solve technological, design, economic, socio-political and other tasks, ensuring the functioning of science, technology and production as a single system, including the commercialization of results and the development of regulatory and technical documentation necessary to conduct these studies;

     25) scientific and technological policy is a part of the state technological policy that defines the main goals, directions, principles of science development and mechanisms of state support for subjects of scientific and (or) scientific and technical activities.;

     26) candidate of Sciences, Doctor of Sciences – academic degrees awarded based on the defense of dissertations by applicants;

     27) the authorized body in the field of science (hereinafter referred to as the authorized body) is a state body that carries out intersectoral coordination and leadership in the field of science and scientific and technical activities.;

     28) a leading scientist is a scientist with a doctorate or candidate of sciences degree, a PhD degree, a doctor in a profile with scientific achievements and indicators determined by the relevant requirement of the authorized body.;

29) endowment fund -a fund for the organization of higher and (or) postgraduate education, subjects of scientific and (or) scientific and technical activities - an endowment fund formed through charitable assistance, gratuitous contributions, donations, grants, contributions from the founders (participants) of educational organizations and subjects of scientific and (or) scientific and technical activities, the investment income from which is used to finance scientific and (or) scientific-technical, innovative and (or) educational activities, as well as for venture financing of startups; - Excluded by the Law of the Republic of Kazakhstan dated June 30, 2025 No. 200-VIII SAM. 

     30) Industrial and Scientific technology Consortium – a temporary voluntary equal association based on an agreement on joint economic activities aimed at commercializing the results of scientific and (or) scientific and technical activities, formed by scientific organizations, organizations of higher and (or) postgraduate education and business entities to conduct research and (or) development work and commercialize the results of scientific and (or) scientific and technical activities for the purpose of participating in a competition for program-specific financing;

     31) engineering and technical worker – an individual who works in a scientific organization or an organization of higher and (or) postgraduate education, or in an enterprise with secondary professional or higher education, contributing to obtaining the result of scientific and (or) scientific and technical activities and its implementation;

     32) the unified information system "Kazakhstan Science" is an object of informatization designed to ensure the digitalization of scientific and (or) scientific and technical activities, competitive procedures for the forms of science financing, state scientific and technical expertise, analysis, collection, processing of scientific and technical information, scientific and technical electronic library and digital archive, the unified database of scientists of Kazakhstan and the scientific citation system of Kazakhstani scientists;

     33) academician of the National Academy of Sciences of the Republic of Kazakhstan – a scientist with outstanding achievements in the field of science, elected by the National Academy of Sciences of the Republic of Kazakhstan in accordance with the rules and criteria for the election of academicians of the National Academy of Sciences of the Republic of Kazakhstan;

     34) associate professor (associate professor), professor – academic titles awarded by the authorized body;

     35) applied scientific research – research aimed at obtaining and applying new knowledge to achieve practical goals and solve specific problems;

     36) state order – an order from an authorized body and (or) branch authorized bodies to a subject of scientific and (or) scientific and technical activity on the basis of a contract for the performance of scientific research funded from budgetary funds in the form of basic, grant and program-targeted financing, financing scientific organizations engaged in basic scientific research, financing of scientific and technical support and commercialization of the results of scientific and (or) scientific and technical activities;

     37) state order of a local executive body of a region, a city of republican significance and the capital – an order of a local executive body of a region, a city of republican significance and the capital to a subject of scientific and (or) scientific and technical activity on the basis of a contract for the performance of scientific research funded from budgetary funds;

      38) industry authorized body – the central executive body responsible for the implementation of state policy in the field of science and scientific and technical activities and the coordination of scientific research in the relevant industry;

     39) service company – a legal entity providing consulting, engineering, certification, patent and other services necessary for the commercialization of the results of scientific and (or) scientific and technical activities;

     40) startup company - an individual entrepreneur or a legal entity registered in the territory of the Republic of Kazakhstan, related to small or medium–sized businesses, established with the participation of organizations of higher and (or) postgraduate education, scientific organizations whose activities are aimed at commercializing the results of scientific and (or) scientific and technical activities, developing innovations;

     41) strategic scientific research – scientific research aimed at solving strategic tasks;

     42) development work – a complex of works performed during the creation or modernization of products, the development of design and technological documentation for prototypes, the manufacture and testing of prototypes and utility models;

     43) pilot production – a production site of a legal entity intended for testing, manufacturing and approbation of prototypes and utility models, new products, methods, processes and systems;

     44) technology transfer is the process of transferring the results of scientific and (or) scientific and technical activities, knowledge, technologies and intellectual property rights before their introduction by subjects of industrial and innovative activity;

     45) a full scientific cycle project is a complex of coordinated scientific, scientific and technical works carried out by subjects of scientific and (or) scientific and technical activities aimed at creating products with scientific content (goods, works, services);

     46) The "single window" of the national innovation system is an object of informatization that provides access to measures to support the development of innovation activities and innovations through a single portal;

     47) Doctor of Philosophy (PhD), doctor in profile – degrees awarded to persons who have completed a doctoral program in a scientific and pedagogical field or a relevant field of professional activity and defended their dissertation in the Republic of Kazakhstan or abroad, recognized in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     48) fundamental scientific research is theoretical and (or) experimental research aimed at obtaining new scientific knowledge about the basic laws of the development of nature, society, and man and their interrelationships.

     49) endowment fund (target capital) – the property of the endowment fund, which is formed and (or) replenished at the expense of endowments (target contributions) and investment income, as well as the endowment fund's own funds and is used to finance charity facilities provided for by the endowment fund's (target capital) charitable program

     This Law regulates public relations in the field of science, scientific and (or) scientific and technical activities, commercialization of the results of scientific and (or) scientific and technical activities, defines the basic principles and mechanisms of functioning and development of the national scientific system of the Republic of Kazakhstan.
