Article 1.The basic concepts used in this Law of the Law on Special State Bodies of the Republic of Kazakhstan
The following basic concepts are used in this Law:
1) excluded by the Law of the Republic of Kazakhstan dated 13.11.2015 No. 398-V (effective ten calendar days after the date of its first official publication);
1-1) adjunct – an employee assigned, in accordance with international treaties, to study at an educational organization of a foreign country that implements postgraduate education programs.;
2) special fees – measures for the service and combat training of employees of special government agencies;
3) special rank – a badge of special distinction awarded to an employee;
3-1) military, special educational institutions – educational organizations of special state bodies that implement educational programs of higher, postgraduate and additional education;
4) special form of clothing – uniforms (uniforms) established by the legislation of the Republic of Kazakhstan and insignia that identify employees as belonging to national security agencies, the authorized body in the field of foreign intelligence, the State Security Service of the Republic of Kazakhstan;
5) employees of a special state body (hereinafter referred to as employees) are citizens of the Republic of Kazakhstan who serve in the national security agencies, the authorized body in the field of foreign intelligence, and the State Security Service of the Republic of Kazakhstan, who have been awarded a special title;
6) service in special state bodies is a special type of public service in positions in national security agencies, an authorized body in the field of foreign intelligence, in the State Security Service of the Republic of Kazakhstan;
7) special accounting of special state bodies – a system of accounting and analysis of personnel employees;
8) accounting of reserve officers of special state bodies – a system of accounting and analysis of quantitative and qualitative data of military personnel (officers) and other mobilization resources of special state bodies;
9) reserve of special state bodies (hereinafter referred to as the reserve) – employees who have been dismissed from service (with the exception of those dismissed for negative reasons) and are registered with reserve officers of special state bodies in the territorial national security bodies and the authorized body in the field of foreign intelligence, intended for staffing, mobilization deployment and replenishment of losses of special state bodies;
9-1) length of service – the duration of an employee's stay in military service, service in special state and law enforcement agencies, civil protection agencies, calculated both in calendar and preferential terms, as well as in other cases provided for by the laws of the Republic of Kazakhstan;
10) Higher Attestation Commission – a permanent supreme consultative and advisory body that reviews the conclusions and recommendations of the attestation of senior officials according to the list determined by the first heads of special government bodies on their compliance with their positions and the prospects for their further most appropriate official use, submitted by way of appeal attestations of employees who disagree with the conclusions and recommendations of the attestation commissions, as well as attestations, submitted for consideration by the Higher Attestation Commission on the instructions of the first head of a special state body;
11) cadet – an employee studying in a military or special educational institution or sent to study in accordance with international treaties in a foreign educational organization for higher education programs.;
12) active reserve – serving in a special order to perform special operational tasks;
13) a service contract (hereinafter referred to as a contract) is an agreement that establishes the rights, duties and responsibilities of the parties.;
13-1) undergraduates and doctoral students – employees studying in military and special educational institutions for postgraduate education programs;
14) resignation – dismissal of employees from service in special state bodies or exclusion from the register of reserve officers of special state bodies who have reached the age limit for service in the reserve, or persons deemed unfit to serve in special state bodies with exclusion from the register of reserve officers of special state bodies;
15) polygraph examination is a survey procedure that involves recording individual physiological reactions (respiration, heartbeat, skin resistance, and so on) using special sensors;
16) psychophysiological examination – a set of measures aimed at a comprehensive assessment of the individual psychological and psychophysiological properties of candidates for service, employees and military personnel of special government agencies;
16-1) student – an employee studying at a military or special educational institution or sent to study in accordance with international treaties at an educational organization of a foreign country in educational programs of additional education;
17) authorized supervisor – an official who has been granted the right to issue orders on the conclusion of a contract, appointment, transfer, dismissal, dismissal of employees, assignment of a special rank to them (personnel orders), as well as the appointment, suspension and extension of an official investigation in accordance with the procedure established by this Law;
18) organizational and staff measures – measures carried out in special state bodies for the creation, liquidation, redeployment, reformation, reassignment, increase and reduction of staff.
The Law of the Republic of Kazakhstan dated February 13, 2012 No. 552-IV.
This Law defines the status of special state bodies of the Republic of Kazakhstan (hereinafter referred to as special state bodies), regulates public relations related to admission to service in special state bodies, its passage and termination, and also defines the legal status, financial support and social protection of employees of special state bodies.
