Article 1. The basic concepts used in this Law of the Law on Standardization

Article 1. The basic concepts used in this Law of the Law on Standardization

      The following basic concepts are used in this Law:  

     1) military national standard is a document on standardization of products, processes and services, which, for the purposes of specific and special use, establishes rules, general principles and characteristics for military and dual–use facilities (applications), including information related to state secrets and limited dissemination.;

     2) manufacturer – a natural or legal person who manufactures products for sale;

     3) service – an activity aimed at meeting the needs of individuals and legal entities, the results of which have no material expression.;

     4) interstate standard is a regional standard adopted by the regional organization for standardization – the Interstate Council for Standardization, Metrology and Certification of the Commonwealth of Independent States;

     5) the fundamental national standard is a standardization document that establishes the general organizational and methodological provisions of the national standardization system and has a wide range of applications or contains general provisions for a specific area of standardization.;

     6) the unified state fund of normative technical documents is a publicly available state information resource containing normative technical documents, standardization documents (with the exception of military national standards and standards of organizations), as well as information about them, with the exception of information constituting state secrets and other legally protected secrets, formed in accordance with the procedure established by the legislation of the Republic of Kazakhstan in the field of standardization;

     7) interrelated standards – national standards and (or) interstate standards that ensure compliance with the requirements established by technical regulations;

     8) products are the result of an activity presented in a tangible form and intended for further use for economic and other purposes.;

     9) product lifecycle – processes of design, production, operation or consumption, storage, transportation, sale, destruction and disposal of products;

     10) regional standard – a standardization document adopted by a regional organization for standardization;

     11) process – a set of interrelated and consistent actions (works) upon achieving any given result, including the stages of the product lifecycle;

     12) official publication – a printed or electronic text of a standardization document (with the exception of military national standards and standards of organizations) with a national standardization mark, issued by the unified state fund of normative technical documents;

     13) the information index of standards is a periodically published index that contains information about accepted standardization documents, changes to them, as well as the dates of their entry into force and additional information.;

      14) standardization is an activity aimed at ensuring the safety and quality of standardization facilities and achieving an optimal degree of streamlining of requirements for standardization facilities by establishing provisions for universal, reusable use in relation to actual and potential tasks.;  

     15) standardization document – a document that establishes norms, rules, characteristics, and principles related to various types of standardization activities or their results;

     16) updating of standardization documents is the process of keeping standardization documents up to date by making changes to them in accordance with the established procedure, information on their validity, revision, limitation or cancellation;

     17) the catalog of standardization documents is an information resource containing information on national, interstate standards and national classifiers of technical and economic information;

     18) regional organization for standardization – an organization for standardization, whose participation in the activities is open to one region: geographical or economic;

     19) the technical committee for Standardization is a consultative and advisory body established in the sectors of the economy on a voluntary basis to carry out activities in the field of standardization and participate in the creation of a national standardization system for designated standardization facilities or areas of activity;

     20) the basic organization of the technical committee for standardization is the organization on the basis of which the technical committee for standardization was established and operates;

     21) technical expert on standardization – an individual who participates in activities in the field of standardization, has special knowledge of the object of standardization and meets the characteristics established by this Law.;

     22) recommendations on standardization – a standardization document containing information of an organizational and methodological nature related to the work on standardization and (or) ensuring the uniformity of measurements and conformity assessment;

     23) the International Organization for Standardization is an organization for standardization, membership in which is open to any country.;

     24) a foreign standardization organization is a standardization organization recognized at the national level of a foreign state as carrying out activities in the field of standardization.;

     25) standardization activities – planning, development, approval, registration, accounting, publication, dissemination, application, monitoring and updating of standardization documents;

     26) the authorized body in the field of standardization (hereinafter referred to as the authorized body) is the central executive body responsible for the management of standardization;

     27) distribution – provision or sale of official publications and (or) copies thereof on the basis of relevant requests from individuals and legal entities in accordance with the procedure established by this Law;

     28) classifiers of technical and economic information – standardization documents, which are systematized sets of codes and names of classification groups of objects of technical and economic information, which include national classifiers of technical and economic information, classifiers of technical and economic information of international organizations for standardization, classifiers of technical and economic information of regional organizations for standardization and classifiers of technical and economic information.economic information of foreign countries;

     29) the depository of classifiers of technical and economic information (hereinafter referred to as the depository) is a specialized fund representing a set of classifiers of technical and economic information having an interdepartmental character, ensuring their formation, accounting, storage, updating, information and regulatory support in the interests of users of the depository;

     30) an organization's standard is a standardization document adopted by an organization independently to achieve its goals.;

      31) national standard – a standardization document approved by an authorized body, accessible to a wide range of users;  

     32) national standardization mark is a mark used for marking documents developed and applied in the national standardization system.;

     33) national standardization system – a set of subjects and their relations in the process of carrying out activities in the field of standardization, as well as standardization documents and regulatory technical documents that are objects of a publicly accessible state information resource;

     34) the register of the national standardization system is an electronic database that keeps systematic records of national standards, national classifiers of technical and economic information, recommendations on standardization, and technical committees for standardization.;

     35) harmonization – activities aimed at creating conditions for the introduction and use of international and regional standards in the national interest, reflecting the latest achievements in science and technology and defining modern requirements for the level of quality and competitiveness of standardization facilities;

     36) international standard – a standardization document adopted by the International Organization for Standardization, accessible to a wide range of users;

     37) a standard of a foreign state is a standardization document adopted by the national standardization body of a foreign state or an organization of a foreign state;

     38) subjects of standardization of foreign states – state bodies, individuals or legal entities authorized to represent the interests of their countries in the field of standardization.

 

 

     This Law defines the legal framework for the functioning of the national standardization system.
