The following basic concepts are used in this Law:

1) excluded by the Law of the Republic of Kazakhstan dated 31.12.2021 No. 100 (effective from 01.01.2022). 1-1) is excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication). 1-2) excluded by the Law of the Republic of Kazakhstan dated 05.01.2021 No. 407-VI (effective from 01.01.2020);

1-3) pack – a unit of consumer packaging made of cardboard or paper or other material containing a certain amount of tobacco product;

1-4) packaging is a unit of a group consumer container containing a certain number of packs.;

1-5) identification is a procedure that ensures, in the field of production, circulation (turnover), and use, the unambiguous recognition of certain products among similar ones by distinctive features.;

1-6) identification means – a unique sequence of characters in machine-readable form, represented as a bar code, or recorded on a radio frequency tag, or presented using another means (technology) of automatic identification;

1-7) labeling – text, symbols and drawings that carry information for the consumer and are applied to bundles and packages.;

2) tobacco product turnover - export, import, storage, wholesale and retail sale of tobacco products;

3) wholesale sale of tobacco products - sale (shipment) of tobacco products for further resale;

4) production passport - a document reflecting the indicators of the production capacity of a tobacco manufacturer, its main characteristics regulating the use of existing equipment to comply with the production process;

5) tobacco product manufacturer - a natural or legal person who produces tobacco products for sale;

5-1) is excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).

6) production of tobacco products – a set of technological processes that ensure the manufacture of tobacco products that comply with standardization documents;

7) tobacco products – products made in whole or in part from a tobacco leaf and (or) other parts of a tobacco plant as raw materials prepared in such a way as to be used for smoking, sucking, chewing, sniffing or other methods of consumption, including using a tobacco heating system or any other device;

7-1) cigarettes with a filter are a type of smoking tobacco products formed from cut tobacco wrapped in cigarette paper using a filter;

7-2) unfiltered cigarettes are a type of smoking tobacco products formed from cut tobacco wrapped in cigarette paper without the use of a filter;

8) authorized body - a state body responsible for the control and regulation of the production and turnover of tobacco products.

The Law of the Republic of Kazakhstan dated June 12, 2003 No. 439.

This Law regulates public relations arising in the process of production and turnover of tobacco products.
