Article 1. The basic concepts used in this Law of the Law on the Diplomatic Service of the Republic of Kazakhstan

  The following basic concepts are used in this Law:

     1) diplomatic courier "ad hawk" – an individual for whom a courier list is issued, delivering diplomatic mail;

     2) valise – a package, envelope, bag, suitcase, or other container intended for the transportation of diplomatic mail;

     3) diplomatic courier – the staff of the diplomatic service of the Republic of Kazakhstan, who holds, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, a government position paid from the national budget in the bodies of the diplomatic service, who carries out planning, acquisition, registration, dispatch, delivery and acceptance of diplomatic mail, for which the courier list is issued.;

     4) organization for work with diplomatic missions – a legal entity designated by the Government of the Republic of Kazakhstan, which is responsible for servicing diplomatic and equivalent missions of foreign states, international organizations and (or) their missions, as well as consular offices of foreign states accredited in the Republic of Kazakhstan, and heads, members of staff of diplomatic missions, international organizations, etc. organizations and (or) their representative offices, employees of consular institutions in the Republic of Kazakhstan.

     This Law and other laws of the Republic of Kazakhstan may assign other functions to the organization for work with diplomatic missions.;

     5) diplomatic mail – official unclassified or secret correspondence, items or equipment, the affiliation of which to the diplomatic mail is confirmed by the courier list;

     6) courier list – an official document of the Ministry of Foreign Affairs or a foreign institution confirming the status of the diplomatic post, the diplomatic courier and the diplomatic courier "ad hoc";

     7) a veteran of the diplomatic service of the Republic of Kazakhstan (hereinafter referred to as a veteran of the diplomatic service) is a person who previously held the position of staff of the diplomatic service of the Republic of Kazakhstan, who has a total work experience of at least twenty–five years, including ten years of work in the bodies of the diplomatic service and (or) an international organization in the direction of the Republic of Kazakhstan, and who has reached retirement age age in accordance with the legislation of the Republic of Kazakhstan on social protection;

     8) employees of the diplomatic service of the Republic of Kazakhstan (hereinafter referred to as employees of the diplomatic service) are civil servants who hold full–time administrative and technical positions in the bodies of the diplomatic service.;

     9) employees of the diplomatic service of the Republic of Kazakhstan (hereinafter referred to as diplomatic service employees) are civil servants who hold full–time diplomatic positions in the bodies of the diplomatic service, who, as a rule, have a diplomatic rank and exercise rights and duties in order to implement the tasks and functions assigned to the bodies of the diplomatic service.;

     10) the staff of the diplomatic service of the Republic of Kazakhstan (hereinafter – the staff of the diplomatic service) – employees of the diplomatic service and employees of the diplomatic service;

     11) accompanying family members of the diplomatic service staff of the Republic of Kazakhstan (hereinafter referred to as accompanying family members of the diplomatic service staff) – spouse, minor children, minor adopted children, as well as disabled adult children and (or) parents of the diplomatic service staff who need care in accordance with the conclusion of the medical organization, issued in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

     The procedure for including the persons specified in the first part of this subparagraph, as well as exceptional cases of inclusion of disabled parents in the number of accompanying family members of the diplomatic service staff, are defined in the rules of rotation of the diplomatic service staff of the Republic of Kazakhstan.;

     12) family members of the diplomatic service staff of the Republic of Kazakhstan (hereinafter referred to as family members of the diplomatic service staff) – spouse, children, adopted children, as well as parents of the diplomatic service staff;

     13) the diplomatic service of the Republic of Kazakhstan (hereinafter referred to as the diplomatic service) is the professional activity of citizens of the Republic of Kazakhstan in the bodies of the diplomatic service, carried out in accordance with the Constitution of the Republic of Kazakhstan, this Law, other regulatory legal acts and international treaties of the Republic of Kazakhstan;

     14) the consular service of the Republic of Kazakhstan is a part of the diplomatic service, whose activities are aimed at ensuring the protection of the rights and interests of the state, citizens and legal entities of the Republic of Kazakhstan within the limits permitted by international law, as well as to promote the development of friendly relations between the Republic of Kazakhstan and other states and the expansion of economic, trade, scientific, technical, humanitarian,cultural relations and cooperation in the field of tourism.

     The Consular Service of the Republic of Kazakhstan carries out its work in accordance with the Consular Charter of the Republic of Kazakhstan, approved by the President of the Republic of Kazakhstan.;

     15) The Ambassador Extraordinary and Plenipotentiary of the Republic of Kazakhstan is a political civil servant authorized by the President of the Republic of Kazakhstan to represent the Republic of Kazakhstan in relations with one or more foreign states;

     16) Permanent (Plenipotentiary) Representative of the Republic of Kazakhstan to an international organization is a political civil servant authorized by the President of the Republic of Kazakhstan to represent the Republic of Kazakhstan in relations with one or more international organizations.;

     17) the personnel reserve of the Ministry of Foreign Affairs is a systematic list of persons who previously held positions of staff of the diplomatic service, applying for vacant or temporarily vacant positions in the bodies of the diplomatic service, formed in accordance with the procedure established by the legislation of the Republic of Kazakhstan.;

     18) foreign institutions – diplomatic and equivalent representative offices located abroad, as well as consular offices of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated March 7, 2002, No. 299.

       This Law defines the legal basis, as well as the procedure for organizing the activities of the diplomatic service of the Republic of Kazakhstan.
