The following basic concepts are used in this Law:

1) refugee - a foreigner who, due to well-founded fears of becoming a victim of persecution on the basis of race, nationality, religion, citizenship, belonging to a certain social group or political beliefs, is located outside the country of his nationality and cannot enjoy the protection of his country or does not wish to enjoy such protection due to such fears, or a stateless person, those who are outside their country of permanent residence or nationality and who are unable or unwilling to return to it due to these concerns;

2) refugee certificate – a document confirming the identity and refugee status;

3) excluded by the Law of the Republic of Kazakhstan dated 05/13/2020 No. 327-VI (effective from 01/01/2021).

4) safe third country - a country in which an asylum seeker temporarily stayed before arriving in the Republic of Kazakhstan and where he can be provided or has been provided with access to effective protection mechanisms and refugee status determination;

5) asylum - granting protection in the territory of the Republic of Kazakhstan to asylum seekers by granting refugee status;

6) an asylum seeker is a foreigner or a stateless person who has expressed a desire to apply for asylum in the Republic of Kazakhstan, until the final decision on their application for refugee status is made by the local executive body of the region, the city of republican significance and the capital.;

7) the certificate of an asylum seeker is a document issued by the local executive body of the region, the city of republican significance and the capital confirming the registration of an application for refugee status;

8) authorized body - a state body responsible for regulating relations on refugee issues;

9) country of origin - the country of nationality of a foreigner or permanent place of residence of a stateless person.

This Law defines the legal status of asylum seekers and refugees in the territory of the Republic of Kazakhstan.
