Article 10-2. Competence of the authorized body of the Law on Housing Relations

Article 10-2. Competence of the authorized body of the Law on Housing Relations

      Authorized body:  

      1) formulates and implements state policy in the field of housing relations and housing and communal services;  

     1-1) carries out coordination and methodological guidance of local executive bodies in the field of housing relations and housing and communal services;

1-2) carries out the coordination and methodological guidance of the housing construction savings bank, which has the status of a national development institute, in the implementation of the functions provided for by this Law;

     1-3) monitors the lists of citizens of the Republic of Kazakhstan, residents registered in need of housing in the unified republican electronic database, the electronic database "Housing Provision Center";

     2) excluded by the Law of the Republic of Kazakhstan dated 09/29/2014 No. 239-V (effective after ten calendar days after the date of its first official publication); 3) excluded by the Law of the Republic of Kazakhstan dated 01/13/2014 No. 159-V (effective after ten calendar days after the date of its first official publication);  

     4) develops and approves, within its competence, regulatory legal acts, regulatory and technical documentation in the field of housing relations and housing and communal services;  

     5) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective ten calendar days after the date of its first official publication);  

     6) provides information and methodological assistance on the application of housing legislation of the Republic of Kazakhstan;  

     7) monitors the condition of the housing stock;  

     8) excluded by the Law of the Republic of Kazakhstan dated 07/22/2011 No. 479-IV (effective after ten calendar days after its first official publication);  

     9) develops and approves the rules for decision-making on the management of the condominium facility and the maintenance of the common property of the condominium facility, as well as standard forms of meeting minutes;

     9-1) Approves the rules for the provision of housing assistance;

     9-2) determines the procedure for registration of citizens of the Republic of Kazakhstan in need of housing from the state housing stock or housing rented by a local executive body in a private housing stock; - Excluded by the Law of the Republic of Kazakhstan.

     10) excluded by the Law of the Republic of Kazakhstan dated December 29, 2014 No. 269-V (effective from 01.01.2015);  

     10-1) develops and approves a methodology for the proportional distribution of dwellings from the state housing stock or dwellings rented by a local executive body in a private housing stock; - Excluded by the Law of the Republic of Kazakhstan.

     10-2) develops and approves a methodology for calculating the amount of payment for the use of housing from the state housing stock;

     10-3) excluded by the Law of the Republic of Kazakhstan dated 09/29/2014 No. 239-V (effective ten calendar days after the date of its first official publication);  

     10-4) develops and approves a methodology for calculating the cost estimates for the management of the condominium facility and the maintenance of the common property of the condominium facility, as well as a methodology for calculating the minimum amount of costs for the management of the condominium facility and the maintenance of the common property of the condominium facility;

     10-5) develops and approves a model regulation on housing inspection;

     10-6) is excluded by the Law of the Republic of Kazakhstan dated 03/15/2023 No. 207-VII (effective sixty calendar days after the date of its first official publication).       10-7) excluded by the Law of the Republic of Kazakhstan dated December 26, 2019 No. 284-VI (effective after ten calendar days after the date of its first official publication);  

     10-8) monitors the provision of housing assistance;

     10-9) provides methodological support for the introduction of modern methods of housing stock management;

     10-10) approves the rules for the management of the condominium facility and the maintenance of the common property of the condominium facility;

     10-11) develops and approves standard cooperation agreements between an association of property owners or a simple partnership, or the manager of an apartment building, or a management company and organizations providing public utilities;

  10-12) develops and approves the rules for the implementation of state accounting of the housing stock of the Republic of Kazakhstan;

     10-13) approves the technical requirements for housing;

     10-14) approves the rules for the provision of housing certificates; - Excluded by the Law of the Republic of Kazakhstan.

     10-15) develops and approves the list of utilities and standard rules for the provision of utilities;

     10-16) develops and approves the rules for organizing the activities of a housing and construction cooperative and the payment of share contributions by members of a housing and construction cooperative and the standard form of a contract for participation in a housing and construction cooperative, as well as the standard charter of a housing and construction cooperative;

     10-17) develops and approves the standard charter of the association of property owners;

     10-18) develops and approves the rules for registration by local executive bodies of contracts of participation in a housing and construction cooperative;

     10-19) develops and approves checklists and criteria for assessing the degree of risk within the boundaries of settlements at social infrastructure facilities in the areas of housing management, gas and gas supply;

     10-20) develops and approves a standard agreement of a simple partnership on joint activities;

     10-21) develops and approves a standard housing lease agreement;

     10-22) participates in the development of professional standards, industry qualifications frameworks, educational training programs, the creation of a certification system, confirmation and advanced training of specialists in the management and maintenance of apartment buildings;

     10-23) develops and approves the procedure for major repairs of the common property of the condominium facility;

     10-24) develops and approves rules for the formation, processing, as well as centralized collection and storage of information in electronic form, including the functioning of informatization facilities in the field of housing relations and housing and communal services in coordination with the authorized body in the field of informatization;

     10-25) develops and approves standard forms of contracts between an association of property owners or a simple partnership with the manager of an apartment building, or a management company, or service entities;

     10-26) develops and approves the forms of monthly and annual reports on the management of the condominium facility and the maintenance of the common property of the condominium facility;

     10-27) develops and approves rules for the use of lump-sum pension payments to improve housing conditions in accordance with the legislation of the Republic of Kazakhstan;

     10-28) develops and approves the rules for the definition and appointment by the housing inspectorate of a temporary management company for the management of a condominium of an apartment building;

     10-29) develops and approves rules for subsidizing the costs of employers who have built rental housing in a village, village, rural district;

     10-30) subsidizes the costs of employers who have built rental housing in a village, village, rural district;

     10-31) develops and approves rules for the use of payments of target savings from the unified accumulative pension fund in order to improve housing conditions in accordance with the legislation of the Republic of Kazakhstan;

10-32) develops and approves the rules for registration of citizens of the Republic of Kazakhstan in need of housing, records in the electronic database "Housing Provision Center";

     10-33) develops and approves rules for the implementation of state support measures aimed at improving housing conditions;

     10-34) develops and approves rules for registering persons in need of housing and providing housing from the housing stock of state institutions and state-owned enterprises;

     10-35) subsidizes part of the rent for a dwelling rented from a private housing stock;

     10-36) develops and approves, in coordination with the central authorized body for budget planning, the procedure for subsidizing part of the rent for housing rented from a private housing stock;

   10-37) develops and approves rules for subsidizing the coupon interest rate on bonds issued by the issuer for the further issuance of housing mortgage loans in order to improve housing conditions;

     10-38) provides subsidies for the coupon interest rate on bonds issued by the issuer for the further issuance of housing mortgage loans in order to improve housing conditions

     11) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
