Article 10-9. State control within the boundaries of settlements at social infrastructure facilities in the areas of housing management, gas and gas supply, and State control and supervision within the boundaries of settlements at social infrastructure facilities in the field of industrial safety for compliance with the requirements for the safe operation of dangerous technical devices of the Law on Housing Relations
1. State control is carried out by officials of the housing inspectorate in relation to subjects of control within the boundaries of settlements at social infrastructure facilities in the areas of housing management, gas and gas supply, as well as state control and supervision over subjects of control and supervision within the boundaries of settlements at social infrastructure facilities in the field of industrial safety, compliance with the requirements for the safe operation of hazardous technical devices is carried out through unscheduled inspections and preventive control with visits to the subject (object) of control and supervision in accordance with the Business Code of the Republic of Kazakhstan.
2. Subjects of state control and supervision are:
1) association of property owners;
2) subjects of management of the condominium facility.
3. The Housing Inspectorate shall exercise the powers to:
1) organization of the state technical inspection of an apartment building;
2) determining the list, periods and order of major repairs of the common property of the condominium facility;
3) participation in the commissions for the acceptance of completed major repairs of the common property of the condominium facility;
4) definition and appointment of a temporary management company;
5) maintaining the register of multi-family residential buildings according to the forms of management of the condominium facility and the subjects of management of the condominium facility;
6) maintaining a register of subjects of management of a condominium facility and managers of apartment buildings with its placement on the Internet resource of the local executive body;
7) making mandatory orders (submissions) to eliminate violations of this Law and the rules for managing the condominium facility and drawing up protocols on administrative offenses.
Officials of the housing inspectorate exercising the state control and supervision specified in paragraph 1 of this Article shall monitor compliance with the requirements for:
1) submission of monthly and annual reports on the management of the condominium facility on time when the owners of apartments, non-residential premises, parking spaces, storerooms apply.;
2) opening a current account for crediting money for the management of the condominium facility (current account) and a savings account for accumulating money for major repairs of the common property of the condominium facility (savings account) in second-tier banks in accordance with the requirements of this Law within the established time limits when the owners of apartments, non-residential premises, parking spaces, storerooms apply;
3) implementation of measures to prepare engineering networks and equipment for the heating season, proper operation of elevators and lifts for low-mobility groups of the population, smoke extraction systems, fire alarm systems, internal fire water supply;
4) availability of agreements on the management of the condominium facility;
5) the presence of registration of condominium facilities;
6) the availability of an annual cost estimate for the management of the condominium facility, approved by the minutes of the meeting;
7) the availability of supporting documents on the annual inspection report of the condominium facility based on the inventory of the common property of the condominium facility;
8) the availability of supporting documents on the performance of disinfection, disinfection and deratization of basements, parking lots and other public areas;
9) maintenance in operational (serviceable) condition of parts of the common property of the condominium object (facades, entrances, lobbies, halls, corridors, staircases and landings, elevators, roofs, canopies (canopies) of entrance groups, attics, technical floors, basements, communal engineering systems and equipment, subscriber mailboxes, land plot a plot under an apartment building and (or) a house plot, landscaping elements and other common property);
10) compliance with the terms of office of the chairman of the association of property owners, the Council of the house and the audit commission (auditor);
11) compliance of the minutes of meetings with the standard forms of the minutes of meetings of owners of apartments, non-residential premises of an apartment building;
12) the availability of a barrier-free environment for people with disabilities and other low-mobility groups of the population;
13) the presence of a document from the entity managing the condominium facility, managing an apartment building, confirming the qualification to perform the functions of managing the condominium facility.
4. The powers of the housing inspectorate include other issues stipulated by the laws of the Republic of Kazakhstan.
5. Actions (inaction) The Housing Inspectorate may be appealed in accordance with the procedure established by the laws of the Republic of Kazakhstan.
