Article 10. Conditions and limits of the use of physical force, special means and weapons The Law on Military Police Agencies
1. Military personnel of the military police have the right to carry, store and use weapons, special equipment, as well as the use of physical force.
2. Military personnel of military police bodies are required to undergo special training, as well as periodic verification of their suitability for actions involving the use of physical force, special means, and weapons.
3. When using physical force, special means, or weapons, a military police officer must:
1) to warn of the intention to use them, while giving sufficient time to fulfill their requirements to persons against whom physical force, special means or weapons are intended to be used, except in cases where delay in the use of physical force, special means or weapons poses a danger to the life and health of individuals, may entail other grave consequences. consequences or when such a warning is inappropriate or impossible in the current situation, as well as cases provided for by the laws of the Republic of Kazakhstan;
2) take measures to provide first aid to individuals who have been injured as a result of their use;
3) immediately report to the immediate supervisor on each fact of their use.
4. The military prosecutor is immediately informed about each case of the use of physical force, special means, weapons by military personnel of the military police, resulting in the death of people or other grave consequences.
5. Military personnel of military police bodies are not responsible for moral, property and physical harm caused in connection with the use of physical force, special means, weapons, if their actions correspond to the nature and degree of danger of encroachment on military personnel, other individuals, protected objects or the military personnel of military police bodies.
The use of physical force, special means and weapons by military personnel of military police bodies in excess of their authority entails liability established by the laws of the Republic of Kazakhstan.
This Law regulates public relations related to the activities of the military police.
