Article 10. Employers' participation in ensuring equal rights and equal opportunities for men and women in the field of labor relations The Law on State Guarantees of Equal Rights and Equal Opportunities for Men and Women
1. Men and women are guaranteed equal rights and equal opportunities in the field of labor relations, including:
1) when concluding an employment contract;
2) equal access to vacant jobs;
3) in matters of professional development, retraining and career advancement.
2. The employer has no right to require the submission of documents not provided for by the labor legislation of the Republic of Kazakhstan.
3. General, sectoral (tariff), regional agreements and collective agreements may include provisions ensuring:
1) equal rights and equal opportunities for men and women in the labor market;
2) equal rights and equal wage opportunities for men and women;
3) measures aimed at improving the situation of persons with family responsibilities;
4) equal conditions in the recruitment of personnel in the organization and its structural divisions.
4. Persons who believe that they have been discriminated against in the field of work have the right to apply to bodies and organizations that carry out activities in the field of ensuring equal rights and equal opportunities for men and women.
5. An employer has no right to create obstacles for an employee who has filed a complaint about cases of gender discrimination with the competent authorities.
The Law of the Republic of Kazakhstan dated December 8, 2009 No. 223-IV.
This Law regulates public relations in the field of ensuring State guarantees of equal rights and equal opportunities for men and women and establishes basic principles and norms concerning the creation of conditions for gender equality in all spheres of State and public life.
