Article 10. Ensuring the protection of historical and cultural monuments in the territory of the city of Turkestan by the Law on the Special Status of the City of Turkestan
1. In accordance with the Law of the Republic of Kazakhstan "On the protection and use of objects of historical and cultural heritage", historical and cultural monuments located on the territory of the city of Turkestan are divided into:
1) historical and cultural monuments of international importance, having special significance for world history and culture:
Mausoleum of Khoja Ahmed Yasawi;
2) historical and cultural monuments of national significance, which are of particular importance for the history and culture of the Republic of Kazakhstan:
the ancient city of Turkistan, the ancient settlement of Kultobe, the underground mosque of Hilvet, the underground mosque of Aulie Kumshyk ata, Chillakhana, the mausoleum of Tauke Khan, the mausoleum of Rabiya Sultan Begim, the Nameless mausoleum, the fortress wall of the citadel, the eastern bath, the mausoleum of Yesim Khan, the gates of the fortress wall of the citadel, the Zhuma mosque, the mausoleum of Gauhar ana, the mausoleum Alkozha ata, mosque-Zhudir ana Madrasah, Shamet Ishan Madrasah mosque, railway station complex and garrison headquarters building;
3) historical and cultural monuments of local importance, which are of particular importance for the history and culture of the city of Turkestan:
Bala bi Mausoleum, city executive committee building, children's sports school, pharmacy building, barracks.
2. For the preservation and protection of historical and cultural monuments of the city of Turkestan, protection zones are established for each monument in accordance with the legislation of the Republic of Kazakhstan on the protection and use of historical and cultural heritage sites.
In order to preserve historical and cultural monuments:
scientific and restoration work is underway;
historical and architectural reference plans and maps of the corresponding area of historical and cultural monuments are compiled, which are included in the general plan of the city of Turkestan.
3. When planning new construction works on the territory of the protected area of the mausoleum of Khoja Ahmed Yasawi, a notification is sent to the UNESCO World Heritage Committee in accordance with the Convention on the Protection of the World Cultural and Natural Heritage of 1972.
4. When carrying out construction work in the area of development regulation, it is not allowed to exceed their architectural appearance over the historical and cultural monuments of the city of Turkestan. Within the building regulation zone, a high-rise building regime is established and requirements for the reconstruction of buildings, structures and their complexes are determined.
In order to preserve the uniqueness of the mausoleum of Khoja Ahmed Yasawi, in order to prevent the development of the territory around it, the construction of facilities is not allowed at a distance of one hundred meters from the border of the protected area of the mausoleum of Khoja Ahmed Yasawi.:
more than seven meters high;
incompatible with historical and cultural monuments in terms of scale, color, and building materials.
5. It is prohibited to carry out works that may endanger the existence of objects of historical and cultural heritage in the territory of the city of Turkestan.
This Law regulates the legal basis of the special status of the city of Turkestan and is aimed at its preservation, study and promotion as a unique heritage.
