Article 10. Grounds for conducting counterintelligence activities The Law on Counterintelligence Activities

     1. The grounds for conducting counterintelligence activities are:

     1) implementation of measures established by the legislation of the Republic of Kazakhstan to protect the national interests of the Republic of Kazakhstan from intelligence and subversive activities;

     2) the availability of counterintelligence information, including information obtained during the pre-trial investigation;

     3) the need to ensure the safety of protected persons and facilities;

     4) the need to obtain information about actions, events, processes and phenomena that pose a threat to the national security of the Republic of Kazakhstan, as well as to identify the causes and conditions that contribute to the formation of threats to national security;

     5) the need for counterintelligence support for government agencies, state-owned legal entities, quasi-public sector entities, strategic and other facilities of the Republic of Kazakhstan of significant national importance;

     6) the need to identify radio emissions from transmitting electronic devices, the operation of which poses a threat to the national security of the Republic of Kazakhstan, as well as actions to use communication networks in intelligence and subversive activities;

     7) mandatory special verification of persons who are being processed (re-registered) for access to information constituting state secrets of the Republic of Kazakhstan, as well as special verification of those who enter public service for the first time or re-enter public service after its termination, as well as applicants for the position of a judge, an employee of the National Bank of the Republic of Kazakhstan and its departments and an employee of the authorized the authority for regulation, control and supervision of the financial market and financial organizations;

     8) mandatory special verification of foreigners employed by government agencies of the Republic of Kazakhstan, as well as state-owned legal entities or quasi-public sector entities for positions related to the performance of managerial functions;

     9) requests from special services, security agencies, law enforcement agencies of foreign states, international and other organizations in accordance with international treaties of the Republic of Kazakhstan;

     10) the need to ensure the protection of the forces, media and information of the body carrying out counterintelligence activities from intelligence and subversive activities.

     2. The organizational and legal form, nationality of legal entities, as well as citizenship, gender, nationality, place of residence, social, official and property status, membership in public associations, attitude to religion and political beliefs of individuals are not an obstacle to conducting counterintelligence activities, unless otherwise provided by the laws of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated December 28, 2016 No. 35-VI SAM.

     This Law defines the legal basis of counterintelligence activities and the system of guarantees of legality of their implementation.
