Article 10. Independence of judges of the Constitutional Court of the Constitutional Law On the Constitutional Court of the Republic of Kazakhstan

     1. Judges of the Constitutional Court, when performing their duties, are independent and subject only to the Constitution of the Republic of Kazakhstan and this Constitutional Law. Any interference in their activities, as well as exerting pressure or other influence on them in any form is not allowed and entails liability under the law.

     2. Judges of the Constitutional Court are not accountable for constitutional proceedings. No one has the right to demand from them a report on the implementation of their powers.

     3. Judges of the Constitutional Court are prohibited from expressing opinions or disclosing the contents of materials on issues that are the subject of consideration by the Constitutional Court, except at a session of the Constitutional Court.

     4. Judges of the Constitutional Court are irremovable during their term of office. The powers of judges of the Constitutional Court may be terminated or suspended only in cases stipulated by this Constitutional Law.

     5. A judge of the Constitutional Court is obliged to recuse himself, which is subject to satisfaction by the Constitutional Court, provided that there are circumstances giving grounds to believe that the judge of the Constitutional Court is personally, directly or indirectly interested in the issue being considered by the Constitutional Court.

     6. A judge of the Constitutional Court shall not have the right to defend or represent, except for legal representation, in court or other state bodies.
