Article 10. Objects and types of internal trade Chapter 3. Internal trade of the Law on Regulation of Trade Activities
1. Domestic trade facilities include retail and catering facilities.
2. Stationary retail facilities are divided into:
category 1, which includes retail facilities with a retail area of more than ten thousand square meters, selling food and non-food products, provided with retail, administrative, storage facilities and a parking area for vehicles within the boundaries of their territory, as well as catering facilities and other facilities;
category 2, which includes retail facilities with a retail area of two thousand to ten thousand square meters, specializing in the sale of food and non-food products, provided with retail, administrative, storage facilities and a parking area for vehicles within the boundaries of their territory, as well as catering facilities and other facilities;
category 3, which includes retail facilities with a retail area of five hundred to two thousand square meters, provided with retail, utility, administrative and household premises, premises for receiving, storing and preparing food and non-food products for sale, catering facilities (if any) and other facilities (if any);
category 4, which includes retail facilities with a retail area of one hundred to five hundred square meters, provided with retail, utility rooms, rooms for receiving, storing and preparing food and non-food products for sale, catering facilities (if any) and other facilities (if any);
category 5, which includes retail facilities with a retail area of less than one hundred square meters, provided with retail premises, premises for receiving, storing and preparing food and non-food products for sale, catering facilities (if any) and other facilities (if any).
The types and requirements for stationary retail facilities are approved by the authorized body.
2-1. Non-stationary retail facilities are divided into:
1) automatic machine – an automated device designed for the sale of goods;
2) a portable counter is a portable temporary structure (structure), which is a trading place located in a specially designated place.;
3) a car stall is a specialized vehicle equipped with commercial equipment;
4) a tent (pavilion) is an easily erected structure made of collapsible structures, equipped with trading equipment for one or more trading places, having an area for trading stock and located in a specially designated place.;
5) kiosk is a non–capital portable structure equipped with commercial equipment, which does not have a sales hall and food storage facilities, designed for one or more retail outlets.
When selling goods through car counters, a specialized vehicle must be technically serviceable.
2-2. Trade markets, depending on the goods sold, are divided into:
1) Universal;
2) Specialized.

2-3. A universal trade market is a trade market in which retail outlets are designed to sell goods of different classes.:
on the territory of the capital, a city of national significance, a shopping market consists of one or more stationary retail facilities, inside which non-stationary retail facilities may be located, with the exception of car stalls;
on the territory of a city of regional significance, a city of district significance, a settlement, a village, a shopping market consists of stationary and (or) non-stationary retail facilities.

2-5. A specialized trade market is a trade market in which seventy percent or more of the total number of goods are intended for the sale of goods of the same class.
A specialized trading market consists of stationary and (or) non-stationary trading facilities.
2-6. Trading markets should have:
1) retail outlets are equipped in accordance with the scheme of their placement, administrative and household, storage facilities and common areas;
2) equipped with accessible viewing areas, which are placed:
information containing the layout of retail locations on the trading market;
evacuation scheme in case of emergency or emergency situations;
information on the procedure and conditions for the provision of retail space for rent (use);
information about the availability of free retail spaces;
contact details (phone number and/or email address) of the person authorized to negotiate the provision of retail space for rent (use);
information provided by the legislation of the Republic of Kazakhstan on consumer protection.
2-7. Individual entrepreneurs and (or) legal entities whose main activity is the provision of rental (use) of retail outlets in large retail facilities, as well as in trade markets, ensuring the functioning of such facilities and organizing their work in accordance with the legislation of the Republic of Kazakhstan on the regulation of trading activities:
1) approve the rules of operation of a large trading facility, a trading market, including its operating mode for domestic trade entities and employees of their administration;
2) provide equal access for domestic trade entities to trade facilities and trade infrastructure;
3) approve the list of additional services provided by large retail facilities and trade markets to domestic trade entities (if any);

4) inform the subjects of domestic trade (who sell socially significant food products) of the maximum allowable retail prices for socially significant food products at retail facilities;
5) are registered in the information system, have access to it and carry out their activities through the information system;
6) conclude or amend lease agreements in the information system;
7) create and modernize the trading infrastructure;
8) delimit the sales zones of wholesale and retail trade on the territory of a large shopping facility, a shopping market;
9) organize trade from car counters in trade markets if there are technical conditions on their territory.;
10) ensure acceptance of payment for the rental (use) of a retail space through an information system by wire transfer or by issuing an invoice for payment through second-tier banks.
2-8. The rules for organizing the activities of trade markets, requirements for the maintenance of the territory, equipment and equipping of the trade market are approved by the authorized body in the field of regulating trade activities.
3. Public catering facilities are divided into the following categories:
1) restaurant is a catering and recreation facility offering a range of complex dishes, including customized and branded dishes, as well as alcoholic beverages with the mandatory provision of waiter services to consumers;
2) cafe - a catering and recreation facility offering an assortment of simple dishes, as well as alcoholic beverages with the mandatory provision of waiter services to consumers;
3) bar - a catering and recreation facility offering consumers snacks, desserts and confectionery, as well as alcoholic beverages;
4) canteen - a catering facility with self-service for consumers.
4. The specialization of a shopping facility is determined by its owner.
5. Types of domestic trade include wholesale and retail trade, catering and other types of trade established by this Law.
6. The procedure and requirements for wholesale, retail trade and catering, as well as for domestic trade facilities, are established in accordance with the legislation of the Republic of Kazakhstan.

This Law regulates public relations in the sphere of trade activity, establishes the principles and organizational bases of its state regulation.
