Article 10. The procedure for filing and registering an application for refugee status under the Refugee Act
1. An asylum seeker may, within five calendar days of arrival in the territory of the Republic of Kazakhstan or from the moment when, while in the territory of the Republic of Kazakhstan, he learned of the circumstances of becoming a victim of persecution based on race, nationality, religion, citizenship, membership in a particular social group or political beliefs, apply personally or through an authorized representative with a written application for refugee status to the local executive body of the region, cities of national importance and capitals at their place of residence.
2. Excluded by the Law of the Republic of Kazakhstan dated 12/30/2021 No. 95-VII (effective ten calendar days after the date of its first official publication).
3. When crossing the State Border of the Republic of Kazakhstan, a person submits a written request to the structural subdivision of the territorial subdivision of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan.
In the absence of a checkpoint across the State border of the Republic of Kazakhstan, a person, in case of forced illegal crossing of the State Border of the Republic of Kazakhstan, must contact the local executive body of the region, the city of republican significance and the capital within 24 hours.
4. In cases where persons detained for illegal entry or stay in the territory of the Republic of Kazakhstan express their intention to apply for refugee status, the competent authorities notify the local executive body of the region, the city of republican significance and the capital within one day from the moment of detention.
The local executive body of the region, the city of republican significance and the capital, within two calendar days, clarifies the circumstances of their stay in the territory of the Republic of Kazakhstan and registers an application for refugee status.
5. Information about family members who have arrived with a person who have not reached the age of eighteen is entered on the basis of birth documents in the petition of one of the parents, and in the absence of parents - in the petition of their legal representatives.
6. On the day of registration of an application for refugee status in the Republic of Kazakhstan, an asylum seeker's certificate is issued, the asylum seeker is registered at the place of stay until a decision is made on his application, and his fingerprint registration is carried out in accordance with the legislation of the Republic of Kazakhstan.
7. Information about family members under the age of eighteen is entered in the certificate of the asylum seeker, one of the parents or legal representatives.
An asylum seeker who has not reached the age of eighteen and has arrived in the territory of the Republic of Kazakhstan without parents or legal representatives is issued a certificate of an asylum seeker.
8. The local executive body of the region, the city of republican significance and the capital, within five working days from the date of the relevant decision, informs the authorized body and the internal affairs bodies about the assignment, extension of refugee status or refusal to grant, extension of refugee status.

This Law defines the legal status of asylum seekers and refugees in the territory of the Republic of Kazakhstan.
