Article 10. Use of Electronic Digital Signature Chapter 3. Electronic digital signature of the Law on Electronic Document and Electronic Digital Signature
1. An electronic digital signature is equivalent to a handwritten signature of the signatory and entails the same legal consequences if the following conditions are met:
1) the authenticity of the electronic digital signature has been verified using a public key with a registration certificate;
2) the person who signed the electronic document lawfully owns the private key of the electronic digital signature;
3) the electronic digital signature is used in accordance with the information specified in the registration certificate.;
4) an electronic digital signature has been created and a registration certificate has been issued by an accredited certification center of the Republic of Kazakhstan or a foreign certification center registered with a trusted third party of the Republic of Kazakhstan.
2. The private keys of an electronic digital signature are the property of the persons who legally own them.
A person may have the private keys of an electronic digital signature for various information systems. The private keys of an electronic digital signature cannot be transferred to other persons.
It is allowed to store the private keys of an electronic digital signature in the certification center in accordance with the rules for creating, using and storing private keys of an electronic digital signature in the certification center.
3. The head of a legal entity or a person replacing him/her has the right to authorize an employee of this legal entity or a person appointed by him/her to sign an electronic document. At the same time, each employee uses a registration certificate and the corresponding private key of an electronic digital signature received in his name.
The Law of the Republic of Kazakhstan dated January 7, 2003 No. 370.
This Law is aimed at regulating relations arising from the creation and use of electronic documents certified by electronic digital signatures, providing for the establishment, modification or termination of legal relations, as well as the rights and obligations of participants in legal relations arising in the field of electronic document circulation, including civil law transactions.
