A serviceman who has been in military service for ten or more years in calendar terms as of January 1, 2013, who has a military service period of twenty years or more in calendar terms and lives in an office dwelling that is not subject to privatization, is entitled to receive monetary compensation in accordance with the rules for monetary compensation approved by the Government of the Republic of Kazakhstan.

The monetary compensation provided for in this article shall not be paid in cases where the serviceman or his (her) spouse:

1) have a dwelling by right of ownership in the territory of the Republic of Kazakhstan, with the exception of having a share of less than fifty percent in the dwelling or receiving a dwelling by inheritance;

2) have realized the right to privatize housing, except for the privatization of housing through a coupon mechanism;

3) received one-time housing payments or monetary compensation;

4) alienated the dwelling that belonged to him (her) by right of ownership (origin) in the territory of the Republic of Kazakhstan during the last five years.

In this case, the monetary compensation provided for in the first part of this article shall be paid to the serviceman without taking into account his (her) spouse, as well as his (her) child (children), if his (her) right to housing was realized before their marriage (matrimony).

The amount of monetary compensation is determined by multiplying the cost of one square meter of the sale of a new dwelling on average in the Republic of Kazakhstan according to the data of the authorized body in the field of state statistics for January of this year, published on its Internet resource, by the area of the dwelling at the rate of eighteen square meters of area for each family member, including the serviceman himself, minus the amount previously current housing payments made.

Persons to whom monetary compensation has been paid shall rent out their official dwelling in accordance with the established procedure no later than three months from the date of payment of monetary compensation.
