1. The rules of Articles 93 and 95 of this Law do not apply to the use of dwellings equated to official ones.

2. The procedure for the provision and use of dwellings equated to official ones shall be approved by the authorized body.

3. Civil servants and employees of budgetary organizations, state-owned enterprises, candidates for cosmonauts, cosmonauts, persons holding public elected positions may privatize the housing they occupy, equated to office, at a residual value if they have worked in the civil service, a state-owned enterprise or in budgetary organizations (including their term of office).) for at least ten years (in aggregate), as well as regardless of the period of employment, if the employment relationship is terminated for the following reasons:

1) liquidation of the organization, reduction of the number or staff of employees;

2) due to an illness that prevents further work;

3) in connection with retirement.

Candidates for cosmonauts, cosmonauts with more than fifteen years of experience in the field of space activities, have the right to privatize housing free of charge.

In the event of the death of an employee who has been provided with housing equivalent to official housing, the right of privatization passes to the family members of the deceased (deceased), regardless of the period of work of the deceased (deceased).

4. Military personnel or employees of special state bodies who have ten years or more of service in calendar terms, as well as persons discharged from military service or from service in special state bodies, civil protection bodies, upon reaching the age limit for service, for health reasons or in connection with staff reductions, have the right to privatize at a residual value. the dwellings they occupy are equivalent to official ones.

Military personnel, employees of special state bodies, as well as persons dismissed from military service or from service in special state bodies upon reaching the age limit for service, for health reasons or in connection with staff reductions, having a length of service of twenty years or more in calendar terms, have the right to privatize the housing they occupy, equated to official, free of charge.

In the event of the death (death) of a person discharged from military service or from service in special state bodies, specified in parts one and two of this paragraph, who has been provided with housing equivalent to official housing, the right of privatization passes to the family members of the deceased (deceased).

5. A dwelling from the housing stock of a state-owned enterprise may be exchanged for another dwelling from the housing stock of a state-owned enterprise with the written consent of the owner or a state body authorized by him.

6. If there are grounds established by paragraph 3 of this Article, the housing commission shall make a decision on the privatization of housing.

This dwelling is transferred to the communal housing stock for its subsequent privatization by the tenant.

7. The eviction of the persons referred to in this article is permitted on the grounds provided for in Chapter 14 of this Law.

8. The procedure for the privatization of dwellings equated to official ones is determined by the Government of the Republic of Kazakhstan.
