Article 102. Land plots for personal subsidiary farming, gardening, cottage construction and horticulture of the Land Code of the Republic of Kazakhstan

1. Citizens of the Republic of Kazakhstan are provided with land plots from the lands of rural settlements for conducting personal subsidiary farming.
2. The land plot for personal subsidiary farming consists of household and field plots, the location of a fish-breeding pool in accordance with the legislation of the Republic of Kazakhstan in the field of aquaculture.
Household allotment is provided within the boundaries of rural settlements and is used for the production of agricultural products, as well as the construction of residential buildings, household buildings in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.
A field allotment is provided from the lands of rural settlements in accordance with the draft land management system of the territories of the populated part or on the territory transferred to administrative subordination, and is used exclusively for the production of agricultural products.
The type of allotment of the land plot provided for personal subsidiary farming, specified in part one of this paragraph, is reflected in the decision of the akim of the settlement, village, rural district on granting the right to the land plot and in the identification document for the land plot.
3. Citizens of the Republic of Kazakhstan are provided with land plots from agricultural lands, rural settlements and reserves, including aquaculture products using fish-breeding pools, for gardening, cottage construction and gardening.
4. Citizens who own land plots for personal subsidiary farming, gardening and cottage construction have the right, in the common interest, to form simple partnerships, horticultural or other consumer cooperatives, the legal status of which is determined by the laws of the Republic of Kazakhstan.
5. In cases where land plots intended for gardening or suburban construction are owned separately by citizens of the Republic of Kazakhstan, and land plots and other property intended to meet the common needs of land owners are jointly owned, the rules on condominiums apply to relations between owners connected by common property.
