Article 105. The procedure for execution and consequences of non-execution of the executive document on reinstatement at work The Law on Enforcement Proceedings and the Status of Bailiffs
1. In case of non-fulfillment by the head of the organization (employer) of the executive document on reinstatement, the bailiff applies to the court with a proposal to order the payment of the average salary or wage difference to the employee for the entire time from the date of the decision on reinstatement of the employee to the day of its execution, as well as to recover from the head of the organization (employer) penalties to the state income in the amount of five monthly calculation indices from individuals and ten monthly calculation indices from legal entities for each day of delay.
2. The execution of the decision on reinstatement at work is considered completed from the moment of the actual admission of the unlawfully dismissed or transferred employee to perform his former duties, following the issuance of the employer's act on the cancellation of his illegal act on dismissal or transfer.
