Authorized body on migration issues:

1) formulates and implements the state policy in the field of population migration;

1-1) implements, within its competence, the State policy in the field of population migration;

2) excluded by the Law of the Republic of Kazakhstan dated 04/16/2018 No. 147-VI (effective ten calendar days after the date of its first official publication);

3) provides methodological guidance to local executive bodies in the field of population migration;

4) establishes a quota for attracting foreign labor and distributes it between regions, cities of national significance, and the capital;

4-1) is excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).

4-2) establishes a regional quota for the admission of refugees and displaced persons for the coming year and distributes it between regions, cities of national significance, the capital;

4-3) monitors the implementation of the regional quota for the admission of refugees and displaced persons;

4-4) excluded by the Law of the Republic of Kazakhstan dated 05/13/2020 No. 327-VI (effective ten calendar days after the date of its first official publication);

4-5) determines the procedure for inclusion in the regional quota of admission of refugees and displaced persons;

5-1) forms a centralized database of foreign workers, creates an information system "Foreign labor force" and ensures their interaction with the information systems of the relevant authorized state bodies;

5-2) excluded by the Law of the Republic of Kazakhstan dated 05/13/2020 No. 327-VI (effective ten calendar days after the date of its first official publication);

6) provides social protection for migrants in accordance with the legislation of the Republic of Kazakhstan;

6-1) approves the list of required professions for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan and the procedure for its formation;

6-2) carries out interdepartmental coordination on the protection of labor rights of citizens of the Republic of Kazakhstan engaged in labor activity abroad;

7) monitors migration processes within its competence.;

9) determines the procedure for assigning or extending the status of candace;

9-1) is excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).

9-2) develops and approves the procedure for providing the Ata Zholy card for ethnic Kazakhs living abroad;

10) considers complaints about the refusal to grant or extend the status of candace;

11) determines the procedure for the activities of the adaptation and integration centers of kandas, temporary accommodation centers;

11-1) develops and approves the rules for determining the Kazakh nationality of persons applying for the status of a candidate and citizenship of the Republic of Kazakhstan in a simplified (registration) procedure, in the absence of a corresponding entry in identity documents, as well as in other documents confirming the nationality of applicants.;

12) forms a unified database of migrants and ethnic Kazakhs and ensures interaction with the relevant information systems of the internal affairs bodies, the national security agency, and the Ministry of Foreign Affairs;

13) monitors, within its competence, compliance with the legislation of the Republic of Kazakhstan on population migration;

14) organizes and carries out, within its competence, cooperation with authorized bodies of foreign states and international organizations in the field of migration regulation;

14-1) carries out interdepartmental coordination in the field of population migration;

14-2) develops a system of measures in the field of regulation and monitoring of migration processes;

14-3) is excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).

14-4) develops and approves the procedure and conditions for issuing or extending permits to employers to attract foreign labor, as well as for carrying out intra-corporate transfers;

14-5) develops and approves rules for issuing or extending certificates to foreigners or stateless persons on their qualifications for self-employment, a list of priority sectors of the economy (types of economic activity) and professions in demand in them for self-employment of foreigners and stateless persons;

14-6) develops and approves a list of professions for seasonal foreign workers in coordination with the authorized state bodies responsible for the management of the relevant field of public administration.;

14-7) approves the rules for establishing quotas for attracting foreign labor to the Republic of Kazakhstan and its distribution between regions, cities of national significance, and the capital;

14-8) determines the procedure for issuing certificates to a foreign employee on the compliance of qualifications for self-employment, a list of priority sectors of the economy (types of economic activity) and professions in demand in them for self-employment of foreign workers in coordination with authorized state bodies responsible for the management of the relevant field of public administration.;

15) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

This Law regulates public relations in the field of population migration, defines the legal, economic and social foundations of migration processes.
